This vacation sha11 be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the Saint Paul Legislative Code as amended, and to the following conditions: 1. That the petitioners, their successors and assigns sha11 pay $1200.00 as an administrative fee for this vacafion which is due and payable within 60 days of the effective date of this resolution. 2. That an easement be retained on behalf of the Board of Water Commissioners with conditions as follows: That a permanent utility easement shall be retained on, over, under and across the vacated area on behalf of the Board of Water Commissioners of the City of Saint Paul to reserve the right of the Board to maintain and operate any water facility in or upon said easement and to enter upon said easement, or any portion thereof, at any time and from time to time, for the purposes of fuhxre construction, reconshuction, inspection, maintenance or repair of the same, or any part thereof. Said utility easement shall be subject to the following requirements: a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any other objects which may prohibit normal access to water facilities for maintenance purposes will be permitted within the easement area. b. Improvements in or upon the above described easement that do not prohibit the Board from exercising its reserved rights may be allowed by obtaining written permission from Saint Paul Regional Water Services with the understanding that the restoration and costs of such improvements shall be the sole responsibility of the petitioner, its successors and assigns in the event the Boazd exercises its reserved easement rights. The petitioner or its successor shall provide new easements if required and the petitioner or its successor shall assume all costs of relocating facalities to the new easements. 4. That an easement is retained on behalf of Xcel Energy—Electric Division over, under and across that part of the drainage and utility easement subject to this vacation action, lying parallel with, abutting to and southwesterly of the southwesterly right-of-way line of Concord Street between Robert Street and Congress Street; and over, under and across the triangular portion of right-of-way on the corner of Congress Street and Concord/Cesar Chavez Street subject to this vacation action. The petitioner or its successor shall provide new easements if required and the petitioner or its successor shall assume all costs of relocating facilities to the new easements. That an easement is retained on behalf of Xcel Energy--Gas Division for existing facilities within the triangular porkion of right-of-way on the corner of Congress Street and ConcardiCesar Chavez Street subject to this vacation action; and within the proposed easement release along Concoxd St. Xcel Energy—Gas Division has facilities and retains its easements rights. REDA is requesting the City vacate its public right of way on this parcel. Because the parcel is small and odd-shaped, REDA, who owns the parcels next to this one, feels the best way to utilize this area is to maYimize contiguous land for building. This site has been vacant and deteriorating for a number of years. REDA would pay a$1200 fee for this transaction. Otherwise, there are no financial implications. This will require a public hearing because the City is disposing of a public right of way. It will be on the agenda June 18�'. This proposal seems reasonable, I recommend signing. Our intention is to redevelop the site so that it is a productive asset for the District Del Sol commercial comdor. We intend to demolish the existing building on the site, which has been vacant and deteriorating for two decades. Our concept for site redevelopment is construction of a new 10-13,000 square foot commercial retail space, occupied by a g store and restaurant. In order to redevelop the site, we are working to acquire the mazimum amount of buildable land along Cesar Chavez between Robert Street and Congress 5t. To accomplish this goal, we are requesting that the St. Paul City Council grant a vacation of the right o£ way and release of easements on a portion of Congress Street (Congress Parcel), as outlined on the attached boundary certificate. The redevelopment site is a challenging one; there are bluffs along its south side that significantly reduce options for building shape and location. Acquisition of the Cangress Parcel would increase the amount of buildable land on the site and enable us to pursue a building with strong presence on the comer of Cesar Chavez and Congress Streets. REDA has also negotiated with surrounding property owners and secured options to purchase portions of Lots 5 and 6 and the entire Lot 7, which are reflected in the attached boundary certificate. Our intention is to combine Parcels SA, 6A, and 6B; Lot 7; and the vacated right of way with the site we currently own: Lots 10, 11, and 12. The assembled site would be re-zoned to either a B2 ar TN2 zoning and assigned a new pin from Ramsey County. REDA is excited and hopeful about our concept for this site.
