BE IT RESOLVED t e petition of Riverside Economic Development Association as
documented in Public Works Technical Services, Vacation File Number 13-2007, the public
right-of-way hereinafter described, on attached map Exhibit A, is hereby vacated and
discontinued as public property, and subject to the herein stated objections, the easements within
said public right-of-way are hereby released.
This vacation sha11 be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioners, their successors and assigns sha11 pay $1200.00 as an administrative
fee for this vacafion which is due and payable within 60 days of the effective date of this
resolution.
2. That an easement be retained on behalf of the Board of Water Commissioners with
conditions as follows:
That a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the Board of Water Commissioners of the City of Saint Paul to reserve the right of the Board
to maintain and operate any water facility in or upon said easement and to enter upon said easement, or
any portion thereof, at any time and from time to time, for the purposes of fuhxre construction,
reconshuction, inspection, maintenance or repair of the same, or any part thereof. Said utility
easement shall be subject to the following requirements:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects which may prohibit normal access to water facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the Board from
exercising its reserved rights may be allowed by obtaining written permission from Saint
Paul Regional Water Services with the understanding that the restoration and costs of such
improvements shall be the sole responsibility of the petitioner, its successors and assigns in
the event the Boazd exercises its reserved easement rights.

a Should it be necessary that the petitioner's works or improvements be removed or damaged
as a result of Saint Pau1 Regional Watez Services operarions, all removal, replacement or
modification costs shall be borne solely by the petitioner.
d. No change from the existing grade within the easement area shall be pernritted without
written pernussion from Saint Paul Regional Water Services.
e. No change in surfacing withisi the easement area shall be permitted without written
pernvssion from Saint Paul Regional Water Services.
f. The petitioner, its successors and assigns sha11 fully indemnify, defend, and save hannless
the Boazd of Water Commissioners of the City of Saint Paul, its officers, agents,
employees, and servants from all suits, actions or claims which shall arise from any injuries
or damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action or
negligence of the petitioner, its employees, agents or business invitees.
3. That an easement shall be retained on behalf of Qwest Communications, a Delawaze
Corporation, far existing facilities. The petitioner or its successor shall provide new
easements if required and the petitioner or its successor shall assume all costs of
relocating facalities to the new easements.
4. That an easement is retained on behalf of Xcel Energy—Electric Division over, under and
across that part of the drainage and utility easement subject to this vacation action, lying
parallel with, abutting to and southwesterly of the southwesterly right-of-way line of
Concord Street between Robert Street and Congress Street; and over, under and across the
triangular portion of right-of-way on the corner of Congress Street and Concord/Cesar
Chavez Street subject to this vacation action. The petitioner or its successor shall provide
new easements if required and the petitioner or its successor shall assume all costs of
relocating facilities to the new easements.
That an easement is retained on behalf of Xcel Energy--Gas Division for existing
facilities within the triangular porkion of right-of-way on the corner of Congress Street and
ConcardiCesar Chavez Street subject to this vacation action; and within the proposed
easement release along Concoxd St. Xcel Energy—Gas Division has facilities and retains
its easements rights. The petitioner or its successor sha11 provide new easements if
required and the petitioner or its successor shall assume all costs of relocating facilities to
the new easements.
6. That the petitioner, their successors and assigns agree to indemnify, defend and save
hanniess the City of Saint Paul, its officers and employees from all suits, actions or claims
of any chuacter brought as a result of injuries or damages received ar sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
property, including but not limited tq a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law ar regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.

7. That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolution, file with Public Works, City Reai Estate, an acceptance in writing of the
conditions of this resolu$on and shall, within the period specified in the terms and

This Riverside Economic Development Association (REDA) wishes to develop property at the corner of
Robert and Congress streets. REDA is requesting the City vacate its public right of way on this parcel.
Because the parcel is small and odd-shaped, REDA, who owns the parcels next to this one, feels the best
way to utilize this area is to maYimize contiguous land for building. This site has been vacant and
deteriorating for a number of years. REDA would pay a$1200 fee for this transaction. Otherwise, there
are no financial implications.
This will require a public hearing because the City is disposing of a public right of way. It will be on the
agenda June 18�'.
This proposal seems reasonable, I recommend signing.

Dear Ms. Borgen and Council of the City of St. Paul,
In 2006, the Riverview Economic Development Association (REDA) decided to purchase the
property at 72 Cesar Chavez Street, where the Riverview Commercial Club building has sat
vacant far over 25 years. Our intention is to redevelop the site so that it is a productive asset for
the District Del Sol commercial comdor. We intend to demolish the existing building on the site,
which has been vacant and deteriorating for two decades. Our concept for site redevelopment is
construction of a new 10-13,000 square foot commercial retail space, occupied by a g store
and restaurant.
In order to redevelop the site, we are working to acquire the mazimum amount of buildable land
along Cesar Chavez between Robert Street and Congress 5t. To accomplish this goal, we are
requesting that the St. Paul City Council grant a vacation of the right o£ way and release of
easements on a portion of Congress Street (Congress Parcel), as outlined on the attached
boundary certificate. The redevelopment site is a challenging one; there are bluffs along its south
side that significantly reduce options for building shape and location. Acquisition of the
Cangress Parcel would increase the amount of buildable land on the site and enable us to pursue
a building with strong presence on the comer of Cesar Chavez and Congress Streets.
REDA has also negotiated with surrounding property owners and secured options to purchase
portions of Lots 5 and 6 and the entire Lot 7, which are reflected in the attached boundary
certificate. Our intention is to combine Parcels SA, 6A, and 6B; Lot 7; and the vacated right of
way with the site we currently own: Lots 10, 11, and 12. The assembled site would be re-zoned
to either a B2 ar TN2 zoning and assigned a new pin from Ramsey County.
REDA is excited and hopeful about our concept for this site. We hope you will share in our
enthusiasm by ganting our request. Please let me know if you require additional information or

Petition to Vacate City Interest �� lji ��
The Riverview Economic Development Association (REDA), the undersigned, constituting a
majority of the owners of the abutting properties, does hereby petifion the Council of the City of
Saint Paul to vacate its interests in the triangular piece of unimproved land within the Congress
St. right of way, to be legaliy described by the City of St. Paul ("Congress Parcel"). A boundary
certificate outlining the requested vacation borders of the Congress Parcel is attached.
REDA requests tbe vacation for the purpose of maximizing contiguous buiidable land along
Cesar Chavez between Robert and Con�ess Streets. REDA currently owns 72 Cesar Chavez
(Lots 10, 11, and 12) and has secured oprions to purchase Lot 7 and parcels SA, bA, and bB from
adjacent property owners. REDA has submitted for a lot split of pazcels 5A, 6A, and 6B and
intends to rezone the enrire parcel to a B2 or TN2 zoning.
The building on the site and surrounding land has been vacant, underutilized, and deteriorating
for over 25 years. REDA intends to retum the site to productive use by demolishing the existing
vacant building on the site and building 10-73,000 sq ft. of commercial retail space and parking
lot on the site. REDA is cunently negotiating with a restaurant and grocer to be the anchar tenant
ofthe newly constructed space.
REDA has attached six copies of the boundary certificate outlining the intended site.

proposed vacation at the corner of Congress and Cesar Chavez streets that serves as a
feed into a]arge system easY of Robert St. Xcel Gas wiIl approve the vacation request,
but will not release our easemenY rights unless the petitioner agrees to reimburse Xcel for
all costs associated with relocating our facilities to a new iocation able to maintain tlus
feed.
