RESOLVED, That the Commissioner of Public Works is hereby authorized to
employ the Walter Butler Company, Consulting Engineers, as consulting engineers
for the purpose of making the surveys, performing the engineering work, and
furnishing engineering services necessary in the preparation of complete plans
and specifications for that portion of the St. Peter Street -Rondo Avenue Storm
Water Relief Sewer extending from Rice Street to Chatsworth Street designated
as Section II and Section III (Bond Issue designation - St. Anthony Hill System
Outfall), such authorization to be set forth in detail by an agreement approved
by the Corporation Counsel and to be entered into between the City of St. Paul
and the Walter Butler Company, and the proper city officials are herein authorized
and instructed to execute such agreement on behalf of the City of St. Paul, compen-
sation to be 3% of the total cost of Sections II and III of the St. Peter Street -
Rondo Avenue Storm Water Relief Sewer between Rice Street and Chatsworth Street as
determined by actual construction contract let by the City within a reasonable time
after the completion of plans and specifications, or based on an estimated cost of
$1,950,000 in case the award of contract is deferred, the total cost upon which
the percentage is based being whichever is less of the two foregoing conditions
in case a construction contract is awarded, the aforementioned fee to be paid out
of Bond Fund Ro. 210, Project 5E -17, and from such funds as are allocated by the
Minnesota Highway Department to this project, to cover the proportional cost of
providing for highway drainage as set forth in a separate agreement to be entered
into between the City of St. Paul and the Minnesota Highway Department; and be it
further

employ the Walter Butler Company, Consulting Engineers, as consulting engineers
for the purpose of making the surveys, performing the engineering work, and
furnishing engineering services necessary in the preparation of complete plans
and specifications for the relocation of city combination storm and sanitary
sewers and the sanitary sewer diversion at Rice Street and Rondo Avenue made
necessary by the proposed construction of the St. Anthony Interstate Highway,
such authorization to be set forth in detail by an agreement approved by the
Corporation Counsel and to be entered into between the City of St. Paul and the
Walter Butler Company, and the proper city officials are herein authorized and
instructed to execute such agreement on behalf of the City of St. Paul,

Dear Commissioner Winkel:
With a view to expediting the preparation of the remaining plans
and specifications and undertaking at an early date the construction of the
St. Peter Street - Rondo Avenue Storm Water Relief Sewer, which wil.1 drain
both the Interstate Highway and adjoining area as far west as Lexington
Avenue, I.am attaching hereto resolution authorizing the employment of the
Walter Butler Company to prepare the plans and specifications for Sections
II and III of the project. The Walter Butler Company were originally
employed.in 1959 for Section I because of the familiarity of their engineers
with the surface drainage problems involved, the Company also being the
designers of the Interstate Highway from Farrington to Lexington Avenue.
The resolution as drawn is similar to Resolution Council File
192403, authorizing this Company to proceed with Section I of the plans.
Plans and specifications for this section are nearing completion. The
first paragraph of the resolution covers Sections II and III of the.
St. Peter Street - Rondo Avenue Storm Water Relief Sewer, for which the
Minnesota Highway Department will share in the cost both for engineering
and, later, construction. The second paragraph covers a relatively small
job for the diversion of sanitary sewage at Rice and Rondo, the entire cost
of both engineering and construction being paid by the Minnesota Highway
Department.
This Department does not have an adequate staff for preparing the
plans of a project of this magnitude in addition to its routine work. Due
to having certain of the necessary information available from its highway
studies, it has been possible for this Company to reduce the fee for
Sections II and III from 3 1/2 to 3 percent.
