THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclu-
sive of the Saint Paul Legislative Code, pertaining to Use Districts,
Height Districts and Rezoning of certain properties in the City of
Saint Paul, as amended, be and the same is hereby further amended
so as to rezone the following described property from "B" Residence
District to Commercial District:
Lots 23 and 24, Block 17, Mackubin & Marshall's
Addition, according to the plat thereof on file
and of record in the office of the Register of
Deeds in and for Ramsey County, Minnesota,
located on the north side of Carroll Avenue
between Mackubin and Arundel Streets.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.

Dear Sir:
This is in the matter of the petition of Hayward E. Toussaint to reclassify
from "B" residence to commercial district property located on the north side
of Carroll Avenue between Mackubin and Arundel Streets. The property is
described as Lots 23 and 24, Block 17, Mackubin & Marshall's Addition. The
property has been zoned "B" residence since the adoption of the Ordinance
in 1922.
On April 1, 1960, the Commissioner of Finance reported this petition sufficient
with the owners of 15 of the 20 parcels (75 %) of land located within the pre-
scribed 100'foot radius having signed the petition. It should be pointed out,
however, that 11 of these signatures are by either the State Highway Department,
or the Board of Education solely for the purpose of permitting said petitioner
to.be heard by the City Council. Actually only 4 of the 9 property owners, or
44 %, having residences within the 100 foot radius have acquiesced in this
petition.
The property is presently used as a two - family residence and the applicant pro-
poses to establish a vocational training school in the existing structure. Mr.
Toussaint does not make a definite commitment of his intentions if successful
in the reclassification of this property. His petition states the purpose of
his request for rezoning is to install and operate a "Youth Work Shop ", "Shoe
Repair Shop" or "Other Retail Business." He was advised by the City Architect
that his property could be used for vocational school purposes without reclassi-
fying it.
The property under consideration has a frontage of 79 feet on Carroll Avenue and
extends to a depth of 133 3/4 feet, resulting in a total area of about 10,566
square feet. North and adjoining is the Intercity Freeway right -of -way; south
across Carroll Avenue are single - family residences; east and adjoining are
residences fronting on Carroll Avenue; west and adjoining is McKinlgy school.
Field investigation discloses this area to be predominately a residential area
consisting of single - family dwellings, duplexes and apartment houses. The pro-
posed reclassification to commercial district world not be consistant with the
existing land uses of the area and would constitute "spot zoning ". The proposed
land use plan indicates that the highest and best land use for this area is for
multi - residential use. The denial of this petition would not create a hardship
on the petitioner as this property is now and has been utilized for two - family
use for many years .
In consideration of the above factors, the Board of Zoning recommends the denial
of the petition to rezone the above described property from "B" residence to
commercial.
