May 23, 1960 Mr. Joseph Okoneski City Clerk Building Dear Sir: This is in the matter of the appeal of the St. Paul Gospel Temple to waive the required 25 foot side yard set back on property located on the northwest corner of Grotto Street and Marshall Avenue. The property is described as Lot 10 and the east 16.4 feet of Lot 9, Block 6, Scribner and Crittenden's Addition. The zoning is "B" residence and has been since the adoption of , the Ordinance in 1922. The property under consideration is presently used as yard area for the exist- ing church structure. The applicant proposes to build an addition to the church which would permit a six foot set back running parallel to the adjoin- ing residential property line for a distance of 17 feet 4 inches, and an 8 foot four inch set back for a distance of 50 feet 8 inches. Under the pre- sent 25 foot side yard requirement, the applicant could not construct a workable addition to the present structure. The property has a frontage of 63 feet on Marshall Avenue and 132.17 feet on No. Grotto Street, resulting in a total area of approximately 8,327 square feet. North and adjoining is the existing church structure; south across Marshall Avenue is a two - family residence fronting on Marshall Avenue; east across Grotto. Street is a two - family residence fronting on Marshall; west and ad- joining is a single - family residence which fronts on Marshall Avenue. The adjoining property owner has signed a letter of acquiescence to the proposed side yard set back. The congregation of the St. Paul Gospel Temple has- experienced tremendous growth in recent years, and this addition will permit them to remain in their present location where the major portion of the con- gregation resides., The applicant has indicated that any time the adjoining property is for sale, they will endeavor to purchase it for their own use. In consideration of the above factors, the Board of Zoning recommends the granting of the appeal to relax the required 25 foot side yard set back to six feet running parallel tq the adjoining residential property line for a / distance•of 17 feet 4 inches, and an 8 foot 4 inch set back for a distance of 50 feet 8 inches from the west property line on the above described pro- perty as indicated on the applicant's plot plan which is attached. Attached is a plat of survey showing in red pencil the building dimensions and side yard which the owner needs to obtain the necessary and beneficial use of the property. The wall at six (6) foot distance has no windows. The wall at eight (8) foot four (4) inch distance has four (4) windows. The roof eaves are ten (10) foot and twelve (12) foot from grade respective along this side. The Reverend W. L. Battle and the Architect will be glad t6 appear before the Council at its convenience, in order to support this request for waiver.
