PAUL RAMSEY COUNTY, MINN. LOT 13 BLK 1 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before April 2, 2007, the following are the now known interested ar responsible parties for the Subject Property: Epstein Enterprises LLC, 161 Marie Ave E, West St. Paul, MN SS ll 8; Eric Heard & Associates, 1119 McKnight Rd S, St. Paul, MN 55119; 21 Century Bank, 699 North Medina Street, Loretto, MN 55357; District 6 Planning Council. WHEREAS, Department of Safety and Inspections has served in accardance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an°Order to Abate Nuisance Building(s)" dated February 26, 2008; and WHEREAS, this order informed the then lrnown interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and W HEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by March 27, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paui City Council on Tuesday, May 13, 2008 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested ��-��� 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 or responsible parties to make the Subject Property safe and not detsimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the altemative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the struchne to be completed within iifteen (1� days after the date of the Council Hearing; and WAEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June 4, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 285 TOPPING STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolitaon and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible parties to conect the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been conected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by Deparhnent of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. •'� � The Saint Paul City Council hereby makes the following order: 1. If the above corrective action is not completed within this period of time Department of Safety and Inspecrions is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the 5ubject Properiy pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. According to our files, it has been a vacant building since July 16, 2003. The current property owners aze Epstein Enterprises, LLC and Eric Heazd & Associates, Inc., per AMANDA and Ramsey county property records. The city has had to board this building to secure it from trespass. There have been eighteen (18) SUMMARY ABATEMENT NOTICES since 2003. There have been ten (10) WORK ORDERS issued for: - Removal of improperly stored refuse and debris - Removal of snow and ice - Cutting of tall grass and weeds On February 12, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDTNG was posted on Februazy 26, 2008 with a compliance date of March 27, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Taxation has placed an estimated market value of $30,700 on the land and $23,100 on the building. As of December 6, 2005, a Code Compliance inspection has been completed. As of May 12, 2008, the $5,000.00 performance bond has not been posted. Real Estate taxes are current. Code Enforcement Officers estimate the cost to repair this structure is $50,000 to $60,000. The window and/or door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 6. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be required. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof covering to a sound, tight and water impervious condition. Permit may be required. Interior 8. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler and make any necessary repairs. Perforxn a GO test on the heating plant. Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a permit. 9. The interior walls are defective. Repair all wa11 defects and finish in a professional manner. 10. The interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 11. There is evidence of improper gas connection of �as fired appliance. Repair/replace or remove. 13. The stairs have missing or defective handrails. Provide ali interior and extenor stairways and steps of more that three (3) risers with handraiis which are grippable and installed 34" to 38" above the nose of the stair treads. 14. The bathroom floor covering is deteriorated or inadequate. Provide floor covenng which is impervious to water and easily cleanable throughout the bathroom and seal around the edges and fixtures. 15. There is a lack of basic facilities. Electric and/or gas service shut off. 16. There is a lack of water service. 17. Smoke Detector: Lack of properly installed and operable smoke detector. Provide functioning smoke detectors in accordance with the attached requirement, within 24 hours. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by March 27, 2008 the Department of Safety and Inspections, Division of Code Enfarcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property tases as a special assessment in accordance with law. Habitable rooms with new usage, replaced windows shall have glass azea equal to 8% of floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom windows shall meet emergency egress requirements (20" wide minimum, 24" high minimum but not less than 5.7 sq. ft. overall). 25. Ordering the owner to remove or repair the building(s) at 285 Toppin¢ Street within fifteen (15) days from adoption of resolution. The properiy owners of record, David Epstein of Epstein Enterprises LLC, and Eric Heard of Eric Heard & Associates, appeared. Greg Klohn was also presented representing 21st Century Bank. Mr. Magner stated the building was a two-story, wood frame, duplex on a lot of 3,920 square feet and had been vacant since July 16, 2003. A code compliance inspection had been done on December 6, 2005 and the vacant building registration fees were current. The $5,000 performance bond had not been posted. On Febivary 12, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An arder to abate a nuisance building was posted on February 26, 2008 with a compliance date of March 27, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land to be approximately $30,700 and the building to be $23,100. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $54,000 to $60,000. The cost for demolition was estimated to be approximately $12,200 to $16,200. There had also been 18 suminary abatements issued to this property since 2003, 10 of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove nnproperly stored refuse and debris, cut tall grass and weeds, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked how they became aware this was a vacant building and the history on the suminary abatement orders. Mr. Magner responded that the building was condemned on July 14, 2003. The last surnmary abatement was issued in October, 2007 which was done by the owner. Prior summary abatements had gone to work order. Ms. Moermond asked what the plans were for the property. Mr. Epstein responded that they purchased the properiy in August, 2007; he was the fee owner and Eric had the contract for deed far the property and was responsible for making the repairs. This past February, the building was reclassified as a Category III. The bank does not want to see the building demolished and Mr. Klohn was attending this hearing to make sure they would be granted the time to make the repairs. The building, however, was in worse shape than what they initialiy believed and they had to hire a shuctural engineer to determine how they would need to level the foundation. NIr. Heard stated that Mr. Epstein did the work "behind the scenes" and he did all of the construction work. The plan was to completely rehab the building and then they planned to either sell the building or rent it out. He claimed that they did have the funding available to complete the work. Ms. Moermond asked how much time they would need to complete the repairs. Mr. Heard responded that he believed they would need approximately three to four months. Ms. Moermond stated that she would recommend granting 180 days to complete the rehabilitation on the condition the following is provided by Friday, May 30: 1) post the $5,000 performance bond; 2) a wark plan done in accordance with the code compliance inspecrion report; 3) financial documentation demonstrating the available fixnding or a letter from the bank guaranteeing funding; and 4) the property must be maintained.
