Presented by
1 WHEREAS, Deparhnent of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame, single family dwelling located on property
4 hereinafter referred to as the "Subject Property" and commonly known as 521 MINNEHAHA
5 AVENLTE EAST. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before December 31, 2007,
the following are the now known interested or responsible parties for the Subject Property:
Interbank Fsb/Co Cenlar, 425 Phillips Blvd, Ewing, NJ 08618; Peterson, Fram & Bergman, 55
Bast S St, Suite #800, St. Paul, MN 55101; Michael Aljets, 6555 Maple Street, North Branch,
MN 55056; Payne-Phalen District 5 Planning Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated February 26, 2008; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by March 27, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subj ect to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WF3EREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, May 13, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,

42 health, safety and welfaze and remove its blighting influence on the community by rehabilitating
43 this structure in accordance with all applicable codes and ordinances, or in the alternative by
44 demolishing and removing the shucture in accordance with all applicable codes and ordinances.
45 The rehabilitation or demolition of the structure to be completed within fifteen (15) days after

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June
4, 2008 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 521 MINNEHAHA AVENUE EAST.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Properiy.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspecrions has posted a placard•on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in

accordance with all applicable codes and ordinances, or in the altemarive by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
£F � nine 90 days after the date of the Council Hearing.
2. If the above conective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
105 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
106 parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family dwelling on a lot of 4,792
squaze feet.
According to our files, it has been a vacant building since August 17, 2006.
The current property owners are Shirley Thompson and Michael Aljets, per AMANDA and
Ramsey county property records.
The city has had to board this building to secure it from trespass.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2006.
There have been eight (8) WORK ORDERS issued for:
- Removal of improperly stored refuse and miscellaneous debris
- Removal of tall grass and weeds
On February 19, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on February 26, 2008 with a compliance date of
March 27, 2008. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $40,000 on the land and $35,000 on the
building.
As of April 13, 2007, a Code Compliance inspection has been completed.
As of March 7, 2008, the $5,000.00 performance bond has been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $45,000 to $55,000. The
estimated cost to Demolish is $6,400 to $9,400.
NHPI, Division of Code Enforcement Resolution submitted far consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with Yhe Building Inspection and Design Office beFore any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a one and one-half story, wood frame, single family dwelling.
On April 11, 2007, a code compliance report was prepared by Jim See�er. There
have been no pemuts pulled or any reason to believe the deficits listed in the report
were remedied. Details of this report are as follows:
BUILDING
1. Remove all carpet from stairs and basement.

Insure basement cellar floor is even, is cleanable, and all holes are filled.

Strap or support top of stair stringer.
Provide thumb type dead bolts for all enhy doors. Remove any surface bolts.
Repair or replace any deteriorated window sash, broken glass, sash holders, re-
putty etc. as necessary.
Provide storms and screens complete and in good repair for all door and window
openings.
Repair walls and ceilings throughout, as necessary.
Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
Prepare and paint interiar and exterior as necessary (take the necessary
precautions if lead base paint is present).
Provide general clean-up ofpremise.
Provide smoke detectors as per the Minnesota State Building Code.
Provide proper drainage around house to direct water away from foundation.
ELECTRICAL
1. Provide a complete circuit directory at service panel.
2. Verify/install a separate 20 ampere laundry circuit and a separate 20 ampere
kitchen appliance circuit.
3. Install listed circuit breakers.
4. Verify that fuse/circuit breaker amperage matches wire size.
5. Properly strap cables and conduits in basement/service conduit on the exterior of
the house.
6. Repair or replace al] broken, missing or loose light fixtures, switches and outlets,
covers and plates.
7. Check a113-wire outlets for proper polarity and verify ground.
8. Remove any 3-wire ungrounded outlets and replace with 2-wire or ground 3-wire
to code.

9. Througtxout building, install outlets and light fixtures as specified in Bulletin 80-1.
10. Install hared-wired, battery backup smoke detector as specified in Bulletin 90-1
and other smoke detectors as required by the LRC.
11. Install exterior lights at front and back entry doors.
12. Remove and/or rewire all illegal improper or hazardous wirina in
basemenUgarage.
13. Insure electric heat sufficient for building by doing a heat loss calculation.
All electrical work must be done by a licensed electrical contractor under an electrical
permit.
Any open walls or wa11s that are opened as part of this project must be wired to the
standards of the 20Q5 NEC.
PLUMBING
All plumbing work requires permit(s) and must be done by a plumbing contractor
licensed in Saint Paul.
1. Temperature and Pressure relief valve discharge piping incorrect on water heater.
2. There is no water meter.
3. Remove and cap all unused gas piping.
4. No front sere cleanout; no soil stack base cleanout for soil and waste piping.
5. Improper pipe supports for soil and waste piping.
6. Improper connections, transitions, fitting or pipe usage for soil and waste piping.
7. Provide vent than roof.
8. Laundry tub and stand pipe unvented.
9. Laundry tub and stand pipe incorrectly vented.
10. Waste inconect for laundry tub and stand pipe.
11. Kitchen sink inconectly vented on first floar.
12. Lavatory, water closet and bathtub unvented.
13. Lavatory, water closet and bathtub incorrectly vented.
14. Waste incorrect in lavatory, water closet and bathtub.
HEATING
Provide support fox gas lines to code (meter outside). Plug, cap andlor remove
all disconnected gas line.(gas inside?)
Install approved lever handle manual building shutoff gas valve in an accessible
location ahead of the firs branch tee. Gas?
3. Repair and/or replace heating registers as necessary.
4. Provide heat in every habitable room and bathrooms.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resultin� nuisance condition is not corrected by March 27, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first zemedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Buildin�,
(651)266-9090. This inspection will identify specific defects, necessazy repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this arder, the En£orcement Officer
wi11 notify the City Council that abatemenY action is necessary. The City Clerk wili then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls far abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

9. Ordering the owner to remove or repair the building(s) at 521 Minnehaha Avenue East
within fifteen (15) days from adoption of resolution.
The property owners of record, Shirley Thompson and Michael Aljets, appeazed and stated that they
already began the rehabilitation of the property and were almost near completion.
Mr. Magner stated the building was a rivo-story, wood frame, single-family dwelling on a lot of
4,792 squaze feet and had been vacant since August 17, 2006. A code compliance inspection had
been done on Aprii 13. The vacant building registration fees were current, and the $5,000
performance bond was posted on March 7, 2008. On February 19, 2008, an inspection of the
building was done and a list of deficiencies which constihxte a nuisance condition was developed.
An order to abate a nuisance building was posted on February 26, 2008 with a compliance date of
March 27, 2008. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Taxarion estimated the mazket value of the land
to be approximately $40,000 and the building to be $35,000. Real estate taaces were current. Code
Enforcement esrimates the cost to repair the building to be approximately $45,000 to $55,000. The
cost for demolition was estimated to be approximately $6,400 to $9,400. There had also been six
sununary abatements issued to this property since 2006, eight of which went to work order: to
secure the building and the City had to board the building to secure it from trespass, remove
improperly stored refuse and miscelianeous debris, and cut tall grass and weeds. Mr. Magner stated
that Mr. Aljets had contacted him and indicated that they had purchased the property which was
next to Ms. Thompson's property. Mr. Magner presented photographs of the property.
Ms. Moermond asked when they had purchased flie property. Mr. Aljets responded that they closed
on the property on Mazch 7, 2008 and they were approximately 75 percent finished with the rehab.
Ms. Moermond stated that she would recommend granting the time to complete the repairs on the
condition the following is provided by Friday, May 30: 1) a work plan; and 2) a financial plan and
if personal funds were being used to fund the rehab, she would also like a letter indicating the funds
were dedicated to this project.
