Legislative Code was enacted to regulate the subject of
WHEREAS, §293.11 provides for the granting of variances from the sound level limitations
contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hazdship on the applicant, other persons or on the community; and
8 WHEREAS, Downtown Beat Classics Car Show, represented by Cavan Lasch, President,
9 who has been designated as the responsible person on the application, has applied for a variance to
10 present amplified music with a D.J.; and

12 WHEREAS, applicant is seeking a variance for the hours from S:OQ p.m. to 1 �:QO p.m. on June 7
li and 21, July 19, and August 2 and 16, 2008, on Kellogg Boulevard between Wabasha and Robert Streets;

16 WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music;
17 and

14 WHEREAS, the Department of Safety and Inspections has reviewed tl�e application and has made
20 recommendations regarding conditions for the variance; now, therefore, be it

22 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Downtown Beat
23 Classics Car Show, subject to the following conditions:

1) The variance shall be for the hours of 5:00 p.m. to 10:00 pm. on June 7 and 21, July 19, and
August 2 and 16, 2008.
2) All electronically powered equipment used in conjunction with the event shall not exceed 9Q
dBA, as measured at 50 feet from the noise source.
3) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be
turned off no later than 10:00 pm. on each of the dates.

34 FURTHER RESOLVED, that any violations of the conditions set forth above on any of the dates
35 may result in revocation of the grant of a variance for the subsequent date(s), in addition to any crimina]
36 citation which might issue.
