WHEREAS, the City of St. Paul, Council Resolurion 08-321, iniriated a$2 million 2008 DOWNTOWN PII.OT
FA�ADE IMPROVEMENT PROGRAM that provided a method for funding faFade improvements to historic
structures in downtown St. Paul, using a special assessment for the costs oF doing the fa�ade improvements; and
'WHEREA5, written petirions for funding from building owners are required and awazd decisions aze determined by
the City Council; and
WHEREAS, petitions are subject to a case-by-case determination and the approval of the City Council shail be
solely within the Council's discretion; and
WHEREAS, written petitions for the buildings, listed below, in downtown St. Paul ha�e been submitted and
approved by Heritage Preservation Commission staff; and requests aze being made by building owners to undertake
the work scopes in the amounts listed below and to begin the assessment processes once construction is complete;
NOW,'THEREFORE, BE TT RESOLVED, that the Councii of the City of Saint Paul does hereby authorize that
the described improvements be made and the proper City officials are hereby directed to proceed with the projects as
appmved by the Council.

Piease take notice that 7ohn Rupp - chief manager of IIi-2 LLC, owner of
the Hotel Lowry (appellant), hereby appeals to the City Council the
decision of Amy Spong Historic Preservation Specialist.
I request that my application for a building permit be accepted as
submitted.
The grounds for the appeal are that the pians are consistent with the
windows as ORIGINALLY INSTALLED, which admittediy were
different than the architects proposed suggestions - that were in fact not
built exactly as designed.
Specificaily:
• I am proposing transom windows without leaded glass — the leaded
glass was suggested but never installed;
• I am proposing exactly the same windows for secand floor as
installed except that the frames are aluminum rather than wood;
• I am proposing to replace one missing third floor window with a
wooden one to match;
• When the building opened some af the store fronts tiid not have
c�oors to ssa11 retail spaces because of tenant reauirements. I am
proposing no center bay wandow doors for exact�ly the same reason
— none of the tenarns (the first floor is full) will accept them — they
aze not needed;

• On the south side I am proposing sliding windows to accammodate
an open au bar, because the tenant refuses to rent the space unless
these windows are installed. In the 1930's many of the original
first flooz windows were removed to accommodate the Art Deco
Tenace Cafe. The history of the building includes window
changes as needed to accommodate the economic realities ofthe
tunes - my project is not a subsidized museum/Iristoric site — it
must, while respecting the building history, remain economically
viable. I sincerely believe that if a tenant had wanted operable
windows installed when the buiiding originally opened, they would
have been installed then.
Aetailed specs will be submitted for final review when the sub-
contractors have in fact been selected. I understand that finai permit
issuance must await these details.

PROPOSED CNANGES_ This proposal is being reviewed for compiiance to the Secretary oE the Interior's
Standards for Rehabiliatation as part of the Downtown Facade Improvement
Program. The building is not loca�ly designated as a Heritage Preservation Site nor
is it listed on the National Register of Historic Places. It has been determined
eligible for the National Register. Therefore, only a staff review is required through
the Program requirements. The applicant is proposing to replace first and second
story windows and to repaidreplace third story windows. Only elevation drawings
were submitted and there were only suppiemental window details for three
storefront windows that are proposed for NanaWall window system.
The work to be pertormed has been denied pursuant to the Secretary ofi the interior's Standards far
Rehabifitation. In addition, the foffowing findings have been made to support the deniai:
1. The Lowry Hotel has been determined eligible for the National Register of Historic PVaces but
is currently not listed nor is it designated as a St. Paul Heritage Preservation Site. 7he proposal
must comply with the Secretary of the Interior's Standards for Rehabititation (SOI} in order to be
considered for the Downtown Facade lmprovement Program.
2. Elevation drawings were submitted of fhe original architect's design, the existing conditions
and the current proposal. There was only window information on three storefront openings where
a NanaWall system is proposed.
3. There was not enough detailed specifications or section drawings submitted to determine full
compliance with the guidelines, however, the general intenf for the windows was evident.
4. The information available for the 2nd and 3rd floor window repair and replacement shows that
the intent is to go back to an original design based on existing windows on the 3rd floor. This
proposai compiies with the SOI that recommend "Identifying, retaining, and preserving windows -
and iheir functional and decorative features - that are important in defining the overali historic
charaeter of the buitding" The SOI also recommend "Designing and insta{ling new windows when
the historic windows (frame, sash and gtazing) are completely missing. The replacement windows
may be an accurate restoration using historical, pictorial, and physica4 documentation; or be a new
design that is compatible with the window openings and the historic character of the building"
5. The proposal for the storefront windows are not based on the architecYs original drawings.
Originally, the storefront was broken down into several individual stores where individual recessed
entries were placed in each storefront bay. 7he original divided light transoms are also not being
proposed in the new storefront. The guidelines don't require an accurate restoration but do
recommend a new design that is compatible with the window openings and character of the
buiiding.
6. For the Wabasha Street storefront openings, the proportion of the openings with a low wall,
open store windows and transoms, are of a traditionat proportion and are compatible with the
ag����
"character oP the building" Divided lights in the transoms would bring the storefront cioser to the
originai design intent.
7. For the Fourth Stseet main storefront openings, the proportion and detailing are not of a
traditionai design and do not comp(y to the Secretary of the inteior's Standards for t2ehabilitation.
The SOI do NOT recommend "In#roducing a new design that is incompatible with the hisforic
character of the building." The floor to ceiling giass area, narrow division of glass and lack of
divided light transoms make this proposal incompatible to the building's historic character.

Please take notice that 7ohn Rupp - chief manager of TH-2 LLC, owner of
the Hotel Lowry (appellant), hereby appeals to the City Council the
decision of Amy Spong H'istoric Preservation Specialist.
I request that my application for a building permit be accepted as
submitted.
The grounds for the appeal are that the plans aze consistent with the
windows as ORIGIlVALLY INSTALLED, which admittedly were
differeirt than the architects proposed suggestions - that were in fact not
built exactiy as designed.
Specifically:
� I am proposing transom windows without leaded glass — the leaded
giass was suggested but never installed;
• I am proposing exactly the same windows for second floor as
installed except that the frames are aluminum rather than wood;
• T am proposing to replace one missing third floor window with a
wooden one to match;
• When the building opened some of the store frouts did not have
doors to small retail spaces because oftenant requirements. I am
proposing no center bay window doors for e�ctly the same reason
— none of the tenants (the first floor is full) will accept them — they
are not needed;

On the south side I am proposing sliding windows to accommodate
an open air baz, because the tenant refuses to rent the space unless
these windows aze installed. In the 1930's many of the original
first floor windows were removed to accommodate the Art Deco
Terrace Cafe. The history of the building inclndes wiudow
changes as needed to accommodate the economic realities of the
times - my project is not a subsidized museum/historic site — it
must, wiule respecring the building lristory, remain economically
viable. I sincerely believe that if a tenant had wanted operable
windows installed when the building originally opened, they would
haue been installed then.
Detailed specs will be submitted for final reviaw when the su6-
contractors haue in fact been selected. T understand that finai permit
issuance must await these details.

4 WHEREAS, the Council of the Ciry of Saint Paul, in Council File No. 08-188, has
5 commenced to amend Administrative Code Chapter 65 to provide that certain improvements to designated
6 heritage preservation structures and non-designated structures located in the B4 and BS Zoning Districts
7 have a public purpose and that it is in the City's interest to levy and collect an assessment to pay all or part
8 of the costs of those improvements having such a public pucpose as these improvements can benefit the
9 general public primarily by preserving the City's cultural, social, economic and azchitectural history as
10 well as maintain and enhance the vibrancy of the City's downtown azea; and

WHEREAS, upon the enactment of Council File No. 08-188, the City Council desires that
applications for improvements consistent with the intent of Admin. Code Chap. 65 should be processed for
approval as expeditiousiy as possible; and
WHEREAS, the City Council, in order to facilitate the expeditious processing of such
applications, finds as a matter of policy that presently designated historic structures, as well those
structures which have been certified or considered eligibie for the National Historic Register by the State
Historic Preservation Office, or have been studied and recommended for historical designation in the St.
Paul Historic Context Studies: Downtown St. Paul, I849-1975 but have yet to be so officially designated
shouid, given the limited availability of funds, receive priority consideraGon in keeping with the City's
stated policies of safeguazding and enhancing the City's historical assets; and
WHEREAS, for the purpose of guiding City staff and petitioners through the requirements
and review of such applications, the City Council, upon the advice and recommendation of the Departrnent
of Planning and Economic Development and the Department of Safety and Inspections — Heritage
Preservation Commission staff, hereby establishes the following requirements which shall be applicable to
applications for certain improvements to designated heritage preservation structures, as well structures
which have been certified or considered eligible for the National Historic Register by the State Historic
Preservation Office, or have been studied and recommended for historical designation in the St. Paul
Historic Context Studies: Downtown St. Paul, 1849-1975 but not yet designated, for the assessment of the
costs of such improvements.
NOW, THEREFORE, BE IT RESOLVED, that applications presented to the City for
certain improvements to designated heritage preservation structures, as well as those shuctures which have
been certified or considered eligible for the National Hisioric Register by the 5tate Historic Preservation
Off'ice, or have been studied and recommended for historical designation in the St. Paul Historic Context
Studies: Downeown St. Paul, 1849-I975 but not yet desia ated as historical, as authorized by
Administrative Code Chapter 65, must for approval purposes compiy with the following requirements and
criteria:

a) The pedtion must be by written application on a form provided by the City and shall
comply with all of the applicable requirements of Administrative Code Chapter 65,
including the submission of plans, specifications, and a cost estimate. The City shall
reject any appiication not on a form of the City and any application that does not include
all information required by the City.
b) Structures eligible to participate in this special assessment program must be in a B4 or
BS Zoning District and listed either on the National Register of Historic Places, locally
designated as a Saint Paul Heritage Preservation Site, or have been certified or
considered eligible for the National Historic Register by the State Historic Preservation
Office, or have been studied and recommended for historical designation in the Sz Paul
Historic Context Studies: Downtown St. Paul, 1849-1975 but has not yet been
designated as historical.
c) Improvements eligible through this special assessment program must be visible from the
public realm, and include but may not be limited to: historical awnings; replacement of
missing decorafive features; restoration or replacement of doors and windows; removal
of non-historic materials or additions; approved exterior lighting; design and
engineering fees related to the proposed improvements; historic preservation-related
maintenance which requires specialized care or expertise, including tuck-pointing and
cleaning. All improvements are subject to City's approval.
d) Improvements not eligible through this special assessment program include but may not
be limited to: any interior work; work done to a building's roof; major landscape
improvements; plants; building improvements not visible from the public realm;
building additions and new construction; improvements completed or in progress at the
time of application; building acquisition; exterior gainting, except for painfing relaked to
other eligible improvements; routine maintenance.
e) All proposed fa�ade improvements will be reviewed by staff of the Heritage
Preservation Commission, and must meet the Secretazy of Interior Standazds for
Rehabilitation of Historic Buiidings.
fl The petition shall be prepazed and signed by a11 owners of the subject property, and
proof of record ownership thereof shail also be submitted with the petidon.
g) The pe6tion shall contain a statement that the owner(s) shall be responsible for
contracting for the actual construction of the fa�ade improvements using contractors and
installers licensed or registered with the City of Saint Paul or the State of Minnesota.
h) The petition shall contain a signed statement by the owner(s) waiving all rights which
they may have to a public hearing on the proposed improvement and assessment and

further specifically waiving any and all rights which the owner(s) may have to appeal
the adopted assessments to the Dishict Court.
i) The amount to be specialiy assessed for the improvements shall not exceed the amount
of the approved construction estimates, plus any admi�istrative costs incurred by the
City and interest charges. Administrative chazges may include the costs of providing a
disbursing agent, engineering inspection services and other costs associated in the
review and implementation of the improvements. No property may receive more than
$500,000 for fa�ade improvements under this program.
j) The petition shall contain a statement that the owner(s) shall be responsible for the
difference between the approved construction esdmate and the actual construction costs,
in the event the actual costs exceed the approved estimate.
k) No payment shall be authorized until the assessment is ratified and the completed work
is reviewed and approved by the Department of Safety and Inspection for compliance
with all applicable building codes and consistency with the proposed improvements.
Any approval by a Ciry division or department shall be only as to compliance with
existing codes and is not a warranty of quality of materials or workmanship.
1) Special assessments shall be for a period not to exceed I S years for projects receiving
$250,000 or less, and for a period not to exceed 20 yeazs for projects receiving in excess
of $250,000.
m) Assessments shall bear interest at the highest rate appiicable for any other special
assessment levied by the City in that yeaz.
n) The petifion shall contain a statement that in the event the petitioners request the
abandonment of the special assessment project, all costs incurred by the City shall be
reimbursed by the petitioners and in the discretion of the Council may be collected in
the same manner as assessments.
o) Unless specifically waived by the City Council, all petitions must be received and
approved by the City Council before consauction or instaliation of the proposed fa�ade
improvements.
p) Consideration of all petitions shall be subject to a case-by-case deternunation and
approval of the City Council and shall be solely within the Council's discretion.
q) The owner(s) of any non-designated saucture that has been certified or considered
eligible for the National Historic Register by the State Historic Preservation Office, or
has been studied and recommended for historical designation in the Sz Paul Historic
Context Studies: Downtown St. Paul, 1849-1975, and any mortgage holders for said
property, must grant the Ciry an easement in the facades upon which improvements are
made under this program.
