Whereas, The State of Minnesota has
condemned certain property under Dis-
trict Court File No. 311123, described
therein as Parcel 3A, said land border-
ing on Etna Street, said street having
been partially improved by the City
of Saint Paul; and
Whereas, The taking of the

WHEREAS, THE State of Minnesota has condemned certain property
under District Court File No. 311123, described therein as Parcel 3A, said
land bordering.on Etna Street, said street having been partially improved
by the City of Saint Paul; and
WHEREAS, the taking of.the aforesaid land by the State of Minnesota
would deprive the City of Saint Paul of a potential assessment against the
aforesaid land in the amount of $6,196.65; and
WHEREAS, the Commissioners appointed by the District Court of
Ramsey County have appraised the land taken in the aforesaid condemnation
proceedings in the amount of $30,508; and
WHEREAS, the fee owner of said land, Chester Park Apartments., Inc.,
has been issued a draft in the amount of SL9,000 as partial payment for said
land in which the City is also named as a payee and which draft said Chester
Park Apartments, Inc., is desirous of cashing; and
WHEREAS, Chester Park Apartments, Inc., has agreed to pay the City
the full amount of its potential assessment, $6,196.65; be it
RESOLVED, that the proper City officers are hereby authorized and
directed to endorse the aforesaid draft from the State of Minnesota, dated
August 16, 1960, bearing No. 915$95, payable to the City of Saint Paul and
others, in the amount of $19,000; and be it
RESOLVED FU=R, that said endorsement be made upon the aforesaid
draft after approval by the Corporation Counsel of a properly executed agree-
ment between Chester Park Apartments, Inc., and%• he City of Saint Paul, gia.r+-
anteeing payment by said Chester Park Apartments, Inc., to the City of Saint
Paul of the full potential assessment representing the expense incurred by the
City of Saint Paul properly apportioned to the land described as Parcel 3A
in Ramsey County District Court File No. 311123.
