That the Zoning Code, Chapters 60 to 64 inclu- sive of the Saint Paul Legislative Code, as amended, pertaining to Use Districts, Height Districts and Rezoning of certain properties in the City of Saint Paul, be and the same is hereby further amended so as to rezone the following described property from "B" Residence District to Commercial District: Except Maryland Avenue and except the west 100 feet lying north of the south 87.45 feet and except the east 60 feet for Arundel Street, Lot 40, Cottage Homes, according to the recorded plat thereof filed of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, being located at the northwest corner of Arundel Street'and Maryland Avenue. - Section 2. The pro- perty is described as follows: except Maryland Avenue and except the west 100 feet lying north of the south 87.45 feet and except the east 0 feet for Arundel Street, Lot 40, Cottage Homes. Since 1922 this property has been zoned "BII residence. On June 16, 1960, the Commissioner of Finance reported the petition sufficient with the owners of eight of ten (80 %) tracts of land situated within 100 feet of the property under consideration having signed the petition. The south portion of this property fronts on Maryland Avenue and lies approximately 8 feet below the grade of said street. The most norther- ly portion of this tract is at a higher elevation. The applicant pro- poses to develop the northerly portion of the tract with a one -story concrete -block structure which will be used as a roller- skating rink. The remaining portion of this tract, having frontage on Maryland Avenue and Arundel Street will be developed later as a retail shopping center. The applicant has not submitted a plan for the proposed shopping center. The tract is 'ILII shaped having a frontage of 270 feet along Maryland Avenue, 6W -f-eet along unirupwoved Arundel Street, and 170 feet along unimproved Orange Avenue with a total area of approximately 111, 000 sq. ft. The adjacent land uses are: west, and adjoining is vacant land, farther to the west is single- family residence and a trailer rental lot which front,; on Maryland Avenue; east and across unimproved Arundel Street is undeveloped land used for truck farming purposes; north and across unimproved Orange Avenue is vacant land, and farther to the north is the Northern Pacific Railway trackage; south across Maryland Avenue are single - family residences fronting on Maryland Avenue; southeasterly across the intersection of Maryland and Arundel Streets are new single - family residences which front on Arundel Street. m City Clerk - Re: Sherman Burton Field investigation discloses that the area immediately to the south is predominantly of a single - family residence character. Numerous new homes have recently been constructed. At the Board's meeting of July Z1, 1960, the petitioner stated that the people who signed the petition were aware that a portion of the property would be the site of a roller rink if the rezoning were approved. He also stated that it is not feasible to develop this land with single- family homes. The Board is of the opinion that this land is well suited as a site for a roller rink. In consideration of the above factors, the Board of Zoning recommends that the petition to rezone the property under consideration from residence to "commercial" be approved.
