Estate file number 22-2004; and
WHEREAS, the following amendments to the legal description are: "distant 16.01 feeY' has been
replaced by "distant 17.40 feet;" "Lot 19" has been intentionally omitted in this amended legal
description, and "Lots 5, 19, 20 and 21, Block 26, Rice and Irvine's Addition, subject to the
following" has been omitted; therefore
BE IT RESOLVED, that the following legal description be correctly described and
depicted on attached E�ibit A as:
Those parts of Lots 5, 20 and 21, Block 26, Rice and Irvine's Addition to Saint
Paul, according to the recorded plat thereof, Ramsey County, Minnesota, which
lie northeasterly ofa line drawn from a point on the southeasterly line ofsaid Lot
21 distant 38.34 feet southwesterly of the most easterly corner o, f said Lot 21 to a
point on the northwesterly Zine of said Lot 5 distant 17. 40 feel soutlnvesterly of the
most northerly corner ofsaid Lot 5 and said line there terminating.
Permanent encroachment and maintenance easement retained on, over, under
and across that part of Lot S, Block 26, Rice and Irvine's addition lying
northwesterly of a line 5.00 feet southeasterly of and parallel to the northwest line
of said Lot t.
RESOLVED, that all other terms and conditions of the original resolution sha11 remain in full

28 and across that portion of the vacated azea as described in Fxhibit "A", on beh2lf of the City of
29 Saint Paul, Department of Public Works.

31 2. That, on behalf of the Board of Water Commissioners, a permanent utility easement, shall be
32 retained on, over, under and across that partian of the vacated with any existing water utzlity
33 facilities, reserving tite right of the Boazd of Water Commissioners to maintain and operate its
34 said existing water faciIities in, on or under said easement, and to eneer upon said easement or
35 any portion thereof at any time, and from time to tirne, far the purposes of future reconstruction,

3 inspecting, maintaining or repairing the same or any part rhereo£ Any development or use of the
4 property within the said ntility easement shatl be subject to the following restrictions stated in tfie
5 attached Exhibit `B".

7 3. That, at the recommendation of the City of St. Paut, Department of Planning and Econoauc
8 Development, the property being reIeased of its Ciry interest should be conveyed to the Housing
9 and Redevelopment Authoriry of St. Paul for future development.

That the petitianer, its successors or assigns, shali by this resoIution and any future conveyances
of this properry, allow said property to be included in any new re-platting pmcess being
presently worked on by the City of St. Paul.
That with any conveyance of the vacated property, the �antee, theu successors and assigns,
agree to indemnify, defend and save harmless the Ciry of Saint Paut, its officers and employees
from all suits, actians or claims o£ any chazacter brought as a result of injuries or damages
received or snsYained by any person, pezsons or property on account of this vacation or grantee's
use of this property, including but not Iimited to, a claim brought because of any act of omission,
neglect, or miscanduct of said petitioners or because of any claims or liability arising from any
violation of any law or regulation made in accordance with the law, whether by the grantee or
any of tlieir agents or employees.
24 6. That the petitioners, their successors and assigns shall, within 60 days of tfie effectiue date of this
25 resolution, file with the CiEy o€ St_ Paul, Department of Public Works an acceptance in writing
26 of the conditions of tYris resolution and shall, within the period(s) spec�ed in the terms and
27 condiuons of tYus resoluuon, comply in all respects with these Terms and condiuons.
