WHEREAS, in the Matter of Comptroller s lYo- act L -6159
for the Resurfacing of FORD PARKWAY from 'Cleveland Ave.
to the West City Limits, Ashbach Construction Company,
Contractor, the specified date of completion was November
15, 1959, and
WHEREAS, the Contractor has prosecuted the work diligently,
but due to adverse weather conditions, it was deemed ad-
visable to postpone operations until the Spring of 1960,
when favorable conditions prevailed, thereby preventing
completion of the work within the specified time, now
ther e f ore , be it
RESOLVED, that the proper city officers be and they are
hereby authorized and directed to execute an Amendment
to said Contract extending the time of completion to MAY
2, 1960, provided, howeveri that this Resolution shall
have no force or effect, unless the Sureties on the Con -
tralitor+ s Bond consent thereto in writing and file such
consent with the City Comptroller, and be it
FURTHER RESOLVED, that the City of Jt. Paul hereby waives
k all claim for liquidated damages and that no engineering
1' and inspections costs on this Project will be charged by
-the City on account of such extended period.
