This property is 5 legally described as follows, to wit: WOODLAND PARK ADDITION TO ST. PAUL LOT 7 BLK 6 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before Apri12, 2007, the foliowing aze the now known interested or responsible parties for the Subject Property: Selby Dale LLC, 505 Tanglewood Dr, Shoreview, MN 55126; Commerce Bank, 765Q Edinborough Way, Suite #150, Edina, NIN 55435; Summit-University Planning Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated January 23, 2008; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structuxe located on the Subject Properiy by February 22, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Heazing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public heazings; and WHEREAS, a hearing was held before the Legislative Heazing Officer of the Saint Paul City Council on Tuesday, Apri129, 2008 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, �r: 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fdteen (15) days after the date of the Council Hearing; and WIIEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May 21, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Pau] City Council hereby adopts the following Findings and Order concerning the Subject Properiy at 544 SELBY AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. 5. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand doliars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. That an Oxder to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placazd on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, VacantlNuisance Buildings. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. �.� . The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the shucture in accordance with all applicable codes and ordinances. If the above conective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with tt�e demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since Mazch 14, 2007. The current property owner is Selby Dale LLC, per AMANDA and Ramsey county property records. The City of St. Paul has boarded this building to secure it from trespass. There have been two (2) SUMMARY ABATEMENT NOTICES since 2007. There have been two (2) WORK ORDERS issued for: - Removal of snow and ice On January 4, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on 7anuary 23, 2008 with a compliance date of February 22, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are delinquent in the amount of $375.00. Taxation has placed an estimated market value of $140,400 on the land and $127,600 on the building. As of April 28, 2008, a Code Compliance inspection has not been completed. It was determined that the exterior of the strucfure is covsred with transite asbestos siding, which is now covered up by vinyl siding. The entire exterior of the sWcture would need to be stripped down to the sheaihing and new siding applied. Ali of the exterior windows had asbestos glazing putry, which would need to be repaired or stabilized if !eft in place. Fiowever, a majority of the window frames appeared to be rotten, and therefore the replacement of the entire windows may be required. We noticed that some repairs had already been done to some of the rotten fascia boards in the past, and no attempt to match the original fascia was done at tfiat time. The roof may also need to be replaced, we fasnd water damage to some area's in the ceilings upstairs. The basement foundation of the home appeared to be in fair condition, but we are not structural engineers. The building has oniy a partial basement, with the remainder having a crawl space with asbestos mixed deixis scattered throughout ftom past mechanical systems. AI� of the original baseboard, moldings, and kitchen cabinets, were removed or replaced with a more modem style. The interior plastered ceilings in the home were water damaged and fialling down, so insiead nf repairing them conectlY, they installed a suspended ceiling grid system to cover them up. Since none of the wrater damage was repaired at the time, there is a large amount of mold growth that would need to be repaired. This home wouid need to be smpped completely down to the framewock, treated for moid issues, and than re-constructed with it�e use of new materials since there are no original items left remaining in the home to re-use. Ordering the owner to remove or repair the building(s) at 594 Selbv Avenue within fifteen (15) days from adoption of resolution. Alan Tschida, attomey and chief manager, appeared on behalf of the property owner, Selby Dale LLC. Mr. Magner stated the building was a two-story, wood frame, dweiling on a lot of 8,712 squaze feet and had been vacant since March 14, 2007. A code compliance inspecrion had not been done, the vacant building rea stration fees were delinquent in the amount of $375, and the $5,000 performance bond had not been posted. On January 4, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on January 23, 2008 with a compliance date of February 22, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County TaYation estimated the market value of the land to be approximately $140,400 and the building to be $127,600. Real estate tases were current. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $10,400 to $14,900. There had also been two summary abatements issued to this property since 2007, two of which went to work arder: to secure the building and the City had to board the building to secure it from trespass, and remove snow and ice. Code Enforcement recommends the building be repaired ar removed within 15 days. Mr. Magner presented photographs of the property. Mr. Tschida stated that the property was purchased with the intent to demolish the building for redevelopment. He had bids from a local contractor for removal of the building and was currently at the stage of obtaining a permit. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building had not been inventoried, but is located within the National Registry and local Hill District. Upon receipt of the demolition pernut applicarion, she informed the contractor that the regular process needed to be pursued. She had given him a list of requirements to include: an HPC application, structural survey, and estimates for rehab. She had also received a phone call from an architect who had been retained far the application process who later went out of town preventing any further contact. She also received another phone call from an architect who had inquired about moving the building out of state. Ms. Spong stated that she had received a letter from the State Preservation Office dated March 6, noting that the property is part of the larger district; however, they were more concerned with new construction. She noted that the letter stated that the HPC had the ability to ask for a more in-depth evaluation. She had met with the City Attorney's Office and had a draft letter asldng for postponement of demolition of the building in arder for the applicant to submit the required application for a demolition permit and allow the HPC to do their review Mr. Tschida stated that the building is infested with mold and asbestos and the contractor had provided him with an extensive report on the condition of the building. The report states that architectural integrity was lost during an earlier remodel; the building would need to be stripped to the framework and treated for mold issues; there are no original items to reuse; and the exterior vinyl siding cover is asbestos. He said feels that it could not be reconstructed under any circumstances. Apri129, 2008 Legislative Hearing Minutes Page 16 0�5"�f 7 Ms. Moermond requested a copy of the report from Mr. Tschida's contractor. Mr. Tschida stated that he is concerned that the process will take too much time and money with a similar end result of demolition. Ms. Moermond questioned that amount of time it would take an architect to complete the required assessments. Mr. Tschida stated they were not interested in adding additional process as the building is not worth restoration. Ms. Spong stated they have four findings they need to make when doing a review to include: the impact on the neighbors and surrounding properties, significance and integrity of site, and future proposed development. Ali aze required to be looked at when granting a permit for demolition. Mr. Tschida stated that it seems unnecessary to require what will be proposed in future development. They realize that the lot is located in a historic preservation district and as such would require multiple hearings before new construction could begin. What they propose at this point would be a vacant lot and redevelopment will be determined at a later date. Mr. Magner stated that the property is severely deteriorated and damaged. If the end result were demolition he would prefer to not babysit the structure along with the mass quantity of other vacant buildings in the City. The owner is willing to hire a contractor, the City does not need to pay the assessment, the situation needs to be resolved, and demolition would allow the owner to maintain a vacant lot as opposed to a deteriorated building. Ms. Moermond questioned the HPC's role in removal. She stated that she believed it is standard practice to review all demolition permits in all historic preservation districts. Ms. Spong stated that it is required under ordinance, with the exception of an administrative order by the City Council ordering removal. According to the City Attorneys Office, an order to abate does not take the HPC's role away in the application process for demolition. Ms. Moermond stated that it seemed to indicate that the property is a non-conh element according to 5HIP0 and removal in and of itself is not problematic. Ms. Spong responded that they are only looking at the national register, not the local historic preservation district. Ms. Moermond stated that if the HPC deems demolition as inconsequential, she would recommend demolition following the public hearing. If the HPC did not recommend demolition, the issue would not be rehabilitation of the structure but surveying and proper documentation before demolition could occur. She asked what the dollar amount for survey work. Ms. Spong responded that si�ificance has already been established so they would not be surveying, but establishing the needed criteria far review. She said that the required documentation would help determine whether or not demolirion would have a negative impact and if so, they would deny the permit. The decision could then be appealed to the City Council. The HPC would develop criteria based on the significance of the property to include photo documentation and architectural description, drawings and floor plans. Ms. Moermond stated that she would recommend that the Council order the building removed within 30 days subject provided Mr. Tschida contracts with a photographer to present archival photographs of the building to the HPC.
