1 WIIEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two story, wood frame duplex dwelling and its detached, two stall, wood frame
4 garage located on properiy hereinafter referred to as the "Subject Property" and commonly
5 laiown as 214 MAPLE STREET. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before April 2, 2007, the
following are the now lrnown interested or responsible parties for the Subject Property: Bjs
Inveshnents, LLC, 4838 Crown Lane, Woodbury, MN 55129; Tara Long, 214 Maple Street, St.
Paul, MN 55106; University National Bank, 200 University Ave W, St. Paul, MN 55103;
Dayton's Bluff District 4 Community.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated January 28, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order inforxned the interested or responsible parties that they must repair
ar demolish the structure located on the Subject Property by February 27, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the rime, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, Apri129, 2008 to hear tesrimony and evidence, and a8er receiving
testimony and evidence, made the recommendarion to approve the request to order the interested

or responsible parties to make the Subject Froperty safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by rehabilitating
this shucture in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolirion of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WI�REAS, a hearing was held before the Saint Paul City Council on Wednesday, May
21, 2008 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testunony and evidence presented at the above
referenced pubiic hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 214 MAPLE STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollazs ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subj ect Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
�'fees-(�5} nine 90 days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of rime Department of
Safety and Inspecrions is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and chazge the costs incuned against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two-story, wood frame, single-family dwelling with a detached two-stall garage
on a lot of 5,662 square feet.
According to our files, it has been a vacant building since March 24, 2006.
The current property owner is BJS Investments LLC, per AMANDA and Ramsey county
property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been seventeen (17) SUMMARY ABATEMENT NOTICES since 2006.
There have been twelve (12) WORK ORDERS issued for:
- Removal of snow and ice
- Removal of tall grass and weeds
- Removal of refuse and miscellaneous debris
On December 19, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on .Canuary 28, 2008 with a compliance date of
February 27, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $500.00.
Taxation has placed an estimated market value of $42,700 on the land and $80,200 on the
building.
As of October 10, 2006, a Code Compliance inspection has been completed.
As of September 27, 2007, the $5,000.00 performance bond has been posted.
Real Estate taaces for the year 2007 are delinquent in the amount of $595.02, plus penalty and
intexest.
Code Enforcement Officers estimate the cost to repair this structure is $70,000-$80,000. The
estimated cost to Demolish is $10,490 to $14,490.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

The property was re-inspected on February 27, 2008. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting influence
of this property. It is the recommendation of the Department of Safety and Inspections that the

45.02, and subject to demolition under authority of Chapter 45.11.
On December 19, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a�ve thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This buildin�(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame duplex dwelling and its detached, two stall, wood
frame garage.

Order
Repair the structure to a habitable condition. This structure is a registered vacant
building that must have a Code Compliance Certificate before the structure may
be occupied. Obtain a Code Compliance Certificate from the Department of
Safety and Inspections. You may contact Jim Seeger at D.S.I., 651-266-9016, for
a code compliance inspection, permits, and issuance of Code Compliance
Certificate. Under Chapter 33.03 of the Saint Paul Legislative Code, failure to
obtain a Code Compliance Certificate before occupying the structure may result
in issuance of criminal sununons. Details of the Code Compliance report are as
follows:
BUILDING
1. Replace front steps at street to Code.
2. Build front steps and landing at front door to Code.
3. Install flashing between siding and foundation per Code.
4. Repair the foundation under the house at the rear basement entry to Code.
5. Insure rear basement stairs head height and handrails to be to Code.

7. Replace all rotted, warped or broken siding.
8. Totally rebuild garage or remove.
9. Insure basement cellar floor is even, is cleanable, and all holes are filled.

Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
Prepare and paint interior and exterior as necessary (take the necessary precautions if lead
base paint is present).
Any framing members that do not meet code (where wall and ceiling covering is removed,
members that are over-spanned, over-spaced, not being carried properly, door and window
openings that are not headered, etc.) are to be reconstructed as per code.
Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of
floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom
windows shall meet emergency egress requirements (20" wide minimum, 24" high
minimum but not less than 5.7 sq. ft. overall).
Provide general clean-up of premise.
Provide smoke detecYors as per the Minnesota State Building Code.
Repair soffit, fascia trim, etc. as necessary.
Provide proper drainage around house to direct water away from foundation.
Install downspouts and a complete gutter system.
Replace house and garage roof covering and vent to Code.
Provide general rehabilitation of garage.

HEATING
1. Clean and Orsat both furnace burners. Check all controls for proper operation. Submit
report.
2. Check both furnace heat exchangers far leaks provide documentation.
3. Provide thirty (30) inches of clearance in front of the second floor furnace for service.
4. Install a separate chimney liner for both units.
5. Replace furnace flue venting and provide proper pitch for gas appliance venting for
second floor unit.
6. Tie furnace and water heater venting into chimney liner fox the first floor unit (the watex
heater is not bonded).
7. Provide adequate clearance from flue vent pipe on fumace/boiler to combustible
materials or provide approved shielding according to Code for both units.
8. Recommend adequate combustion air for both units.
9. Provide support for gas lines to Code. Plug, cap and/or remove all disconnected gas lines
for both units.
10. Clean all supply and retum ducts for warm air heating system for the first floor unit.
ll. Repair and/or replace heating registers as necessary.
12. Provide heat in every habitable room and bathrooms.
13. Appropriate Mechanical Permits are required for this work.

1. This property was inspected as being a duplex.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by February 27, 2008 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the buildin�(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property tases as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Desin Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and compiete
disclosure of this "Order to Abate° to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, ar convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is Tequired by law to post a placard on this property which dec]ares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective actiou is not taken within the time specified in this order, the Enfarcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then

Where wall and ceiling covering is removed, attic, replace doors and windows, (insulation,
glass, weather stripping, etc.) shall meet new energy code standards.
Prepare and paint interior and exterior as necessary (take the necessary precautions if lead
base paint is present).
Any framing members that do not meet code (where wall and ceiling covering is removed,

I am writing to recommend and request a Councii Resolution ordering immediate demolition and removal
of the buildings (house an@ garagej located at 214 Maple Street. This properry is a nuisance aml has a

Although in a historic disixict, the property's history, and more importantly, its future aze dubious. I was
in this house severat times tucder the previous ownership and, unless substantial rehab work has already
been done unbelaiownst to me, every element of this house must be repaired or replaced: foundation,
pfumbiug, elechieat, heatittg, ffoors, doors, wa}Is, windows, siding, steps, sidewalk, retainiag wal�, et al.
Tlvs properiy has reached (and su�assed) the pourt of dimivislung retums. The roof was recently
replaced but appears to be a clear case of "too little, too late." In arl&ition fihe garage is beyond salvaging
and must be demolished. The kullside and retaining wall in the rear of the lot aze collapsing. (pictures

A further complication involves a.ccess to the properry. It is situated on a narrow corner lot and there is
na direct aceess to the garage from the street. t3ccess is via an easement through the neigkboring

Given its current condition and the overall situation, the cost to rehabilitate this property would be

I am iirterested in the fate of this properry as I own two houses on the same block, 196 and 198 Maple

9. Ordering the owner to remove or repair the building(s) at 214 Ma�le Street within fifteen
(15) days from adoption of resolution.
Greg O'Brien, appeared on behalf of BJS Investments, the property owner.
Mr. Magner stated the building was a two-story, wood frame, single-family dwelling with a
detached two-stali garage on a lot of 5,662 square feet and had been vacant since March 24, 2006.
A code compliance inspection had been done on October 10, 2006. The vacant building
rea strarion fees were delinquent in the amount of $500 and the $5,000 performance bond had been
posted September 27, 2007. On December 19, 2007, an inspection of the building was done and a
list of deficiencies which constitute a nuisance condition was developed. An order to abate a
nuisance building was posted on 3anuary 28, 2008 with a compliance date of February 27, 2008. Tc
date, the property remained in a condition which comprised a nuisance as defined by the Legislative
Code. Ramsey County Tasation estimated the mazket value of the land to be approximately
$42,700 and tl�e building to be $80,200. Real estate tases for 2007 were delinquent in the amount
of $595.02, plus penalty and interest. Code Enforcement estimates the cost to repair the building to
be approximately $70,000 to $80,000. The cost for demolition was estimated to be approximately
$10,490 to $14,490. There had also been 17 sumuiary abatements issued to this property since
2006, 12 of which went to wark order: to secure the building and the City had to board the building
to secure it from trespass, remove refuse and debris, cut tall grass and weeds, and remove snow and
ice. Mr. Magner read into the record a letter received from D.A. "Clyde" Boysen, a nei�bor to this
property, requesting that the building be demolished. A copy of said letter is attached and made a
part of these minutes. Mr: Magner stated that Code Enforcement recommends the building be
repaired or removed within 15 days. He presented photographs of the property.
Ms. Moermond questioned whether permits had been pulled. Mr. O'Brien stated that they had. Ms.
Moermond questioned if they were at the 50 percent mark of completion of the rehabilitation. Mr.
O'Brien responded that they were not, but they planned on selling the property to the neighbor at
212 Maple on contract for deed when the proj ect was completed. Due to health problems, the bond
had been extended by Mr. Seeger.
Mr. Magner stated the vacant buildings fees were paid for 2007, a building permit was issued in
January, 2008 and the bond was extended from Apri12 2008 to June 2, 2008 due to said health
problems.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building is and 1884
cottage style with Italiante details with good integrity despite the loss of the front porch and is
located on a prominent site. She would encourage rehabilitation of the property and recommend
that if demolition is pursued that it be subject to the HPC process.
Mr. O'Brien stated that the owner had told him the property had been under contract for deed for
one year and had told him he was unable to complete the rehab. As a result, they (BJ5 Inveshnents)
had decided to work on completion.
Mr. O'Brien stated that he would be meeting with an attomey that afternoon to discuss the
possibility of changing to a warranty deed or canceling the contract for deed to obtain the title. The
neighbor who was under contract for deed had planned to refinance both properties, rehab the
property and sell them as one.

Ms. Moermond questioned University National Bank's involvement. Mr. O'Brien stated that they
were the lender and have the first mortgage.
Ms. Moermond questioned the time period of the suulinary abatement orders. Mr. Magner stated
that they began in 2006 and the last was on October 9, 2007. Mr. Magner asked who BJS
Inveshnents was comprised of Mr. O'Brien responded that he works for Brad Schmitt who owns
the title company.
Ms. Moermond stated that the vacant building registration form needed to be filled out and she
would like to see their company listed as an alternative contact. All fees and taaces need to be paid,
the property needed to be maintained, BJS Investments needs clear title despite the outcome with
the contract for deed. She also required an in depth work plan that would demonstrate the scope of
the endeavor and a financial plan. If all conditions are met, she will then recommend 90 days for
rehab, and if they are not at the 50 percent completion by June 2, she will recommend farfeiture of
the bond.
Ms. Moermond quesrioned what they will do with the property if they take the title back. Mr.
O'Brien stated they will rehab the property and put it back on the mazket.
Ms. Moermond stated that she would grant the time to complete the repairs on the condition the
following is provided by May 21: 1) vacant building fees must be paid; 2) the vacant building
registration form must completed; 3) a work plan done in accordance with the code compliance
inspection must be received; 4) financial docuxnentation; 5) the tases must be paid; and 6) the
property must be maintained.
