This properiy is legally described as follows, to wit: DRAKE'S 2ND ADDITION TO ST. PAUL, MINN. LOT 11 BLK 2 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Deparhnent of Safety and Inspecrions on or before April 2, 2007, the following are the now lrnown interested or responsible parties for the Subject Property: MERS, c/o GMAC Mortgage LLC, 500 Enterprise Rd, #150, PO Box 969, Horsham, PA 19044; Wilford & Geske, 7650 Currell Blvd, Suite #300, Woodbury, MN 55125; District 6 Planning Council. WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated February 12, 2008; and WHEREAS, this order informed the then laiown interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by March 13, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Departrnent of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, April 29, 2008 to hear testunony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, 08 5�f 3 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 this shucture in accordauce with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (1� days after the date of the Couneil Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May 21, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RE50LVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 780 JACKSON STI2EET. That the Subject Property comprises a nuisance condition as defined in Saint Paul LegislatSve Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Aousing or Building code violarions at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which deciares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by Deparhnent of Safety and Inspections, VacantlNuisance Buildings. 8. That the lrnown interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. �7� � The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in ��;�3 88 89 90 91 92 93 94 95 96 97 98 99 100 101 102 103 104 and removing the structure in accordance with a11 applicable codes and ordinances. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. According to our files, it has been a vacant building since December 6, 2007. The current property owner is MERS c/o GMAC Mortgage LLC, per AMANDA and Ramsey county property records. There has been one (1) SUMMARY ABATEMENT NOTICE since 2007. On January 23, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on Febnxary 12, 2008 with a compliance date of March 13, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legisiative code. The Vacant Building registration fees are delinquent in the amount of $625.00. The window and/or door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 4. The windows andlor storm wandows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. The interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 6. There as evidence of improper plumbing (water damage to wallslceilings). Have a licensed plumbex affect repairs. 7. The interior walls are defective. Repair all wall defects and finish in a professional manner. 8. There is evidence of improper wiring. Haee a licensed electrical contractor certify system and make any necessary repairs. 9. FiIRNACE: Have a licensed heating contractox service and ciean the furnace or boiler and make any necessary repairs. Perform a GO test on the heating plant. Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a permit. 10. There is evidence of a rodent infestation. Immedaately exterminate and eliminate all rodents from the entire building. Remove rodent harborages in the yard areas. Tuckpoint the foundation if necessary to rodent-proof the building to prevent re-infestation. Immediately remove any dead rodents from the premises. This buiiding, constructed in 1886 as the Ackermann Biock, is inciuded in the statewide inventory. In the 1981 historic sites survey of St. Pa�l and Ramsey County, the buiiding was recommended as having National Register potential. We would agree. Further consultation on this review is needed. We are wil�ing to consider the building eligible to the National Register for the purposes of this �eview, although if you choose to complete a more thorough evaluation by a qualified consultant, we would be happy to review that. If we concur that the building is eligible, we will need to consult to discuss alternatives to demolition. If demolition is pursued, you will need to notify the Advisory Council on Historic Preservation (pursuant to 36CFR800) and we will need to develop appropriate mitigation measures. it would be helpful if the St. Paul Heritage Preservation Gommission could participate in fhe consultation on this property. Fischex to design this commercial build3ng in 1886. The bu3lding cost an estimated $3,200 to construct. From 1886 to 1889 the Ackermann 6rothexs operated a saloon in the building which catezed to woxkers at the nearby Jackson Sereet shops and other local industries. Between 1889 and 1892 Rudolph opexated a confectionary, gYOCery, and cigax stoxe in the building. In 1841 Rudolph opened another saloon in a di£ferent location, but continued to live in the Ackerntann Block. In 1894 he sold the building to Anna Pantke. Describe the present artd originai (if knownj physicat appearance The Ackermann Block, an Italianate style, three bay brick commerciaZ building, is Iocated at the southeast corner of Sycamore and Jackson 3treets in a primarily residential neighborfiood, opposite the historic Oakland Cemetery, in St. Paul's North End neighbor- hood. The building was designed to acco�odate a grocery store and saloon on the fzrst floor, and an apartment above. Its commercial nature was aecented by a cast iron storefront. When the building was converted to apartments in I914, the windows on the storefront were bricked in and replaced with segmental arched, smaller window openings. However, the origina2 storefront cornice and cast iron enframing parts of the storefront were retained. The second floor of the main facade has three rectangular two over two windows, each o£ which is topped by cut stane lintels which have incised floral carving and which rest on stone brackets with vertical incised bands which are linked to a stone belt course below the second story windows. The most omate feature of the design of this building is its ga].vanized iron cornice which has a projecting central section which is segmental arched, and is topped by a sunrise motif, and has the words "Ackermann Block, 1886." This cornice has paired brackets, typical of the Italianate style, and has anthemion-like projections at the edges. It also has rectangular raised panels below the date. The northern side wa17, of the bui].ding faces Sycamore Street. It has segmental arched four over four window sashes, aad a rectangular, galvani2ed iron oriel window. Ttze galvanized iron corniee also extends around this side of the building, but nat around the south side wall or the east rear walJ., which are not vfsible from the street. Tue building has a limestone foundation. Other than the alterations which were made in Z914 to convert the building to a four unit apartment, the buildzng is basically iatact and has beea preserned wel1. In 1941 the street address of the building was changed from 950 N. Jackson Street to 780 N. It was built to house a grocery store and saloon on the first floor, and living quarters above. Through an i�ense European p•ropaganda campaign, James J. Hill`s Great Northern Railroad lured immigrant settlers to St. Paul and the hinterlands beyond. As a result, by 1890 nearly 40% of the population of Ramsey County was foreign born. In order to service and construct train engines and cars, huge railroad shops were built. One such complex of Great Northern Shops was built off Jackson Street in the North End in the 1880`s. The employees who worked in the shops, many,of them newly arrived European immigrants, began building homes, and thus creating their own neighborhoods near the shops. The Ackermann Brothers Grocery Store and Saloon is one of a number of commercial buildings which were built in the area during this time which catered to the railroad workers. The Ackermann Brothers building is probably one of the few buildings in the area which was designed by professional architects, Bergmann and Fischer. John Fischer came to St. Paul in 1874 and was listed as an architect in the City Directory beginning in 1875. In succeeding years up to Z900 he was Zisted as an architect or carpenter with Gerth and Bartels Construction Company with the exception o£ 1895 when he was listed as an architect with no affiliation. In 1905 he was in partnership witfi Earl Douglas (Douglas and Fischer, architects), but the partnership dissolved, and he practiced alone until his death in 1914. Fisher designed the Otto W. Rahland Block on West Seventh Street (Fort Road), but few other St. Pav3 buildings have been attributed to him. Lzttle is known of Bergmann, either, though in the mid-1880's it is knowa that Bergmann and Fischer designed the wonderfully ornate Ayd Hall on West Seventh Street (Eort Road). Rudolph and Edward Ackermann were both bom in Minnesota in 1863, according to the 1900 Federal census. There were few native-born Minnesotans in the North End where, between 1885 and 1895, the predominant nationalities were German, Irish, Norwe- gian, and Swedish. The Ackermann Brothers commissioned architects Bergmann and Fischer to design their building which was completed in 1886 at a cost of $3,200. From 1886 to 1889 the Ackermann brothers operated a saloon in the building and resided on the upper floor. Between 1889 and 1892 Rudolph Ackermann operated a confectionary, grocery, and cigar store in the building. In 1891 Rudolph Ackermann opeaed another saloon in a differ- ent location but maintained his residence in the Ackermann Brothers building until 1894. That same year he sold the to Anaa Pantke for $3,000. The buil'siing was used for apartments and for a number o£ co�ercial purposes until 1914 when it was converted to four apartments, two on each floor. Mr. Magner stated the building was a two-story, masonry, four-unit dwelling on a lot of 3,920 square feet and had been vacant since December 6, 2007. A code compliance inspection had not been done, the vacant building registration fees were delinquent in the amount of $625 and the $5,000 perforxnance bond had not been posted. On January 23, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on February 12, 2008 with a compiiance date of Mazch 13, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $60,000 and the building to be $245,000. Real estate tases for 2006-2007 were delinquent in the amount of $10,704.00, plus penalty and interest. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $20,384 to $25,384. There had also been one summary abatement order issued to this properiy since 2007. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magier presented photographs of the property. Mr. Magner stated that the building has had a long history of involvement with the City as a nuisance property. Since it is located in an Invest Saint Paul neighborhood, he would recommend that a long-term strategic plan be laid out for management along with quality rehabilitation. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was determined eligible for designation in 1983. It was built in 1886 and its integrity is good. The shucture consists of ornate cornices and is historically significant as an example of the working- class North end neighborhood of the City. It is located across from Oakland Cemetery, which is a designated cultural landscape. Ms. Spong received a letter from SHIPO stating they would be willing to consider eligibility but would need further review. If after review they concur, altexnatives to demoiition would need to be sought. Ms. Weber stated that her client wi11 become the owner on May 8 and she has suggested to her client to retain a broker to maintain, market and sell the property for repair. The client is looking for as much time as possible. Ms. Moermond stated that she would grant the time to complete the repairs on the condition the following is provided by May 21: 1) vacant building fees must be paid; 2) vacant building registration form must completed; 3) a code compliance inspection must be done; 4) the bond must be posted; 5) work plan must be done in accordance with the code compliance; 6) financial documentation; and 7) the taYes must be paid.
