This property is legally described as follows, to wit: WARREN & RICE'S ADDITION TO SAINT PAUL S 24 FT OF N 104 FT OF LOTS 5 AND LOT 6 BLK 22 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before Apri12, 2007, the following are the now known interested or responsible parties far the Subject Property: MERS, c/o GMAC Mortgage LLC, 500 Enterprise Rd, #150, PO Box 969, Harsham, PA 19044; Wilford & Geske, 7650 Currell Blvd, Suite #300, Woodbury, MN 55125; B Carter Looney, Westring 13, Schaafheim 64850, Germany; Thomas-Dale District 7 Planning Council. WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated February 12, 2008; and WHEREAS, this arder informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by March 13, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Councii; and WHEREAS, the interested and responsible parties haue been served norice in accordance with the provisions of Chapter 45 of the Saint Paul Legislarive Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, Apri129, 2008 to hear testimony and evidence, and after receiving testunony and evidence, made the recommendation to approve the request to order the interested 08 - ��f2- 41 42 43 44 45 46 47 48 44 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 or responsible parties to make the Subject Properiy safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the shucture to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May 21, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 518 FARRINGTON STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. � E:� That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accardance with Chapter 45 of the Saint Paul Legislative Code. According to oux files, it has been a vacant building since January 9, 2008. The current property owner is MERS c/o GMAC Mortgage LLC, per AMANDA and Ramsey county property rewrds. There have been three (3) SUMMARY ABATEMENT NOTICES since 2008. There has been one (1) WORK ORDER issued for: - Boarding On January 31, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on February 12, 2008 with a compliance date of March 13, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are delinquent in the amount of $250.00. Taxation has placed an estimated market value of $23,200 on the land and $104,600 on the building. As of Apri128, 2008, a Code Compliance inspection has not been completed. This is a two story, wood frame duplex. 1. The exterior walls and/or trim of the house and/or garage has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. The window and/or door screens are missing, defective ar in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 3. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. 4. The exterior walls of the garage are defective. Repair all holes, breaks, loose or rotting siding to a professional state of maintenance. 5. The interior walls are defective. Repair all wall defects and finish in a professional manner. 6. The interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 7. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is impervious to water and easily cleanable throughout the bathroom and seal around the edges and fixtures. 8. Smoke Detector: Lack of properly installed and operable smoke detector. 9. There are numerous damaged/missing doors and associated hardware. 10. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May Be Required. 11. The basement could not be inspected due to blocked entrance (piles of rubbish, debris, and garbage bags). 12. There is material endangerment violations (fire hazard, dilapidation). Remove rodent harborages in the yard areas. Tuckpoint the foundation if necessary to rodent-proof the building to prevent re-infestation. Immediately remove any dead rodents from the premises. 14. PURNACE: Have a licensed heating contractor service and clean the furnace or boiler and make any necessary repairs. Perform a C/O test on the heating plant. 15. There is evidence of improper wiring. Have a]icensed elech contractor certify system and make any necessary repairs. Provide documentation to this office. 16. There are numerous damaged electrical fixtures/outlets. Repair/replace. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by March 13, 2008 the Depariment of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building, (651)266-9090. This inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. As an owner or responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enfarcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Deparhnent of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. ff corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Aearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. The costs of this action, including administrative costs will be assessed against the property as a special assessment in accordance with law. Ordering the owner to remove or repair the building(s) at 518 Farrin¢ton Street within fifteen (15) days from adoption ofresolurion. Christina Weber, attorney for Wilford & Geske, appeazed on behalf of the property owner, MERS c/o GMAC Mortgage LLC. Mr. Magner stated the building was a rivo-story, wood frame, duplex on a lot of 2,613 square feet and had been vacant since January 9, 2008. A code compliance inspection had not been done, the vacant building registration fees were delinquent in the amount of $250, and the $5,000 performance bond had not been posted. On January 31, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on February 12, 2008 with a compliance date of March 13, 2008. To date, the property remained in a condirion which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated the mazket value of the land to be approxunately $23,200 and the building to be $ iQ4,6�0. Real estate tases were current. Code Enforcement estimates the cost to repair the building to be approximately $40,000 to $50,000. The cost for demolirion was estimated to be approximately $10,276 to $14,276. There had also been three suumiary abatements issued to this property since 2008, one of which went to work order wYrich was to board the building. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that the building is an early 1880's Victorian era property that had retained a lot of its original chazacter including the windows. The block is contiguous and the property is located across the street from an historic church. It had retained good integrity despite deterioration in the recent past. It was surveyed in 1983 and identified as part of the potential Frogtown District. Ms. Weber questioned the vacancy date of January 8, 2008. Mr. Magner was unsure if there was legal occupancy and it was clear that the property had not been maintained prior to it being considered vacant. Ms. Weber stated the foreclosure sale was in December, with the redemption period expiring in June. She was in discussion with the client regarding the risks of making repairs prior to the expiration of the redemption period. Ideally, they would request not making any repairs until the redemption period expired on June 6 but would maintain and secure the property. Ms. Moermond questioned the nature of the suunnary abatements. Mr. Magner stated that they were to clean the yard and secure the building. The most recent occurred on March 20 with a compliance date of March 28. Ms. Weber stated that she has recommended local brokers to aid her client with maintenance of the property. She said that the process to reduce the redemption period is not a quick or easy process. She requested that the repairs be held off until GMAC becomes the owner of the property on June 6. Ms. Moermond stated that the owner's address is in Germany according to records received from Ramsey County. Ms. Weber stated they did not have that address. Apri129, 2008 Legislative Hearing Minutes Page 9 ���� Ms. Moermond stated that it looks like a case of abandonment; swrunary abatements have been issued, vacant building fees have not been paid, there has been no code compliance inspection, nor the posting of a performance bond. Ms. Moermond stated that she would grant the tune to complete the repairs on the condition the following is provided by May 21: 1) the vacant building fees must be paid; 2) the vacant building registration form must be completed; 3) a code compliance inspection must be done; 4) the bond must be posted; 5) a work plan done in accordance with the code compliance must be done; and 6) provide financial documentation.
