was enacted to regulate the subject of
2 noise in the City of Saint Paul; and
4 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations
5 contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
6 constitute an unreasonable hazdship on the applicant, other persons or on the community; and

8 WHEREAS, St. Paul After Hours/Capito112iver Council, represented by Brian Harst, Event
9 Manager, who have been designated as the responsible person on the application, has applied for a
10 variance to present amplified concerts and movies in Meazs Park in Lowertown; and

WHEREAS, applicant is seeking a variance far the hours of 6:00 p.m. to 9:00 p.m. on May 29,
June 5, 12, 19, 26, July 10, 17, 24, 31, August 7, 14, and 21, 2008; and
WHEREAS, if applicant is not granted a variance it will not be able to present amplified concerts
and movies at Mears Park; and
WHEREAS, the Department of Safety and Inspections has reviewed the application and has made
recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to St. Paul After
Hours/CapitolRiver Council, subject to the following conditions:
1) The variance shall be for the hours of 6:00 pm. to 9:00 p.m., on May 29, June 5, 12, 19,
26, July 10, 17, 24, 31, August 7, 14, and 21, 2008; and
2) 12 dates are requested by the applicant. No recommendation is being made with respect to the
number of days for which variance may be granted; and
3) All electronically powered equipment used in conjunction with the event shall not exceed 85
dBA, as measured at 50 feet from the source; and
4) The speakers shall be directed away from neazby residences; and
5) The applicant shall provide personnel and equipment who shall provide continuous sound level
monitoring at all stages and each sound mix during the hours of the variance; and
6) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be
turned off no later than 9:00 p.m. on each event date.

FURTHER RESOLVED, that any violations of the conditions set forth above on the above dates
may result in denial of future requests for the grant of a noise variance, in addition to any criminal
citation which might issue.
