Okoneski City Clerk ' Building , Dear Sir: ti This is in the matter of the appeal of Jos. A. Gubasta to establish new build - ing line set backs on property located on the- southwest.corner of Barclay Street and Old Hudson Road. The property is described as Lot 1, except the west 174 feet thereof, and Lot -4, except:the west 174 feet thereof, Block 14, Auditor's Sub. no. 62. The zoning is "A" residence and has been since the adoption of the Ordinance in 1922. The site is presently vacant and the applicant proposes to+ develop it with a single - family residence. However, due to the way_the lots -are platted, they require a 46 foot set back from Barclay Street and 8 feet from Old Hudson Road: The applicant is desireous of facing the,residence on Old Hudson Road to _conform with the other lots in the block, and is requesting a set back of 30 feet from Old Hudson Road and 4 feet from Barclay Street. -Old Hudson Road is'the only street adjoining this block which is improved. This is mainly due to the existing topography and the existing U. S. Highway No. 12 right -of -way to the south. Because of these factors, the most logical way to develop this ` property is to change the building line requirements as requested by the appli- cant. Mr. Shepard's office had issued a stop order on this property because of the proposed highway changes in this area; however, after further study, the property was released subject to certain requirements. Mr. Gubasta's letter acquiescing to these requirements is attached. The property under consideration has the shape of a trapezoid, and has a frontage along three streets; 129.6 feet fronting on unimproved Barclay Street; 57.75 feet along Wakefield Avenue and approximately 60 feet on Old Hudson Road, resulting in a total area of approximately 8,193 square feet. Wakefield Avenue is now a part of U. S. Highway No. 12 right -of -way. North across Old Hudson Road are single- family residences fronting along Old HudsonRoad; south and adjoining is the U. S. Highway No. 12 right-of-way; east across Barclay Street is vacant property; west and adjoining is a vacant lot which will soon be developed with a single - family residence; farther west are single - family residences fronting along Old Hudson Road. Field investigation discloses no basic objections to the proposed building line. This change will not deviate from the purpose and intent of the Ordinance, nor will it be detrimental to the adjoining properties. Based on the above factors, the Board of Zoning recommends the granting of the appeal to establish a 3ofoot building line set back on Old Hudson Road and a four_foot set back from Barclay Street on the above described property. In the matter of the construction of a home on this property, I agree that the basement floor grade of such home will not be higher than one (1) foot above present Old Hudson Road Center Line grade.
