RESOLVED, that upon appeal of Schirmer Transportation Company
from the decision of the Commissioner of Parks and Recreation and
Public Buildings, and upon the favorable recommendation of the
Board of Zoning, a 31 foot building line is hereby established
on Lots 1 through 6 inclusive, Block 2, Warren and Thauwald's
Subdivision, situated on the west side of Homer Street between
West Seventh Street and Stewart Avenue.

The City Council requested that you prepare a resolution granting the
attached appeal of Schirmer Transportation Co. for permit to establish
a 31 -ft'. building line on property on the west side of Hamer St. between
W. Seventh St. and Stewart Ave., also described as Lots 1 through 6 inclusive, Block 2,
Warren and Thauwald's Subdivision.

This is in the matter of the appeal of the Schirmer Transportation Company
to establish a building line on property located on the west side of Homer
Street between W. Seventh Street and Stewart Avenue. The property is
described as Lots 1 through 6 inclusive, Block 2, Warren and Thauwaid's
Subdivision. The zoning is Light Industry and has been since August 20,
1949, when it was reclassified from "B" residence.
The property is presently vacant, and the applicant proposes to develop
this site, together with the property adjoining to the west, with a one-
story building for office and shop purposes. The site will also provide
space for parking and storing the applicant's trucks. Tbe•property affected
by the required building line has a frontage of 284.64 feet along Homer
Street and extends to an average depth of 109 feet; however the applicant's
entire property extends approximately 465 feet farther west; resulting in
an overall area of approximately 160,582 square feet, or 3.7 acres.
The property to the north is zoned "B" residence which would make it
necessary under the ordinance for the property under consideration to
* have a building line set back of 99 feet. This is not a reasonable set
back and would not serve the purpose and intent of the Ordinance. The
applicant is requesting a set back of 31 feet. North and adjoining is
vacant property,, farther north are single - family residences fronting on
West Seventh Street; south and adjoining is the right-of-way for the Chicago
Milwaukee, St. Paul and Pacific Railroad; east across Homer Street is the
Orfie and Mariani & Sons Inc. Construction Company storage and equipment
yard, also the new plant site for the Becbik Products Company,�both front-
ing on Homer Street; west and adjoining is the•new Pearson Candy Company
plant.
Field investigation discloses that this area is best suited for industrial
purposes and that the property to the north presently zoned "B" residence
should properly be rezoned to light industry district. The present required
set back of 99 feet creates a hardshop in the applicant and the proposed 31
foot set back would not be detrimental to the adjoining property on the north.
The Board of Zoning'considered the matter at their regular meeting on
March 3, 1960, and based on the above factors, recommend the-granting of
the appeal to establish a 31 foot set back on the above described property.
