Resolved, That upon appeal of Vince
Hencier from the decision of the Com-
missioner of Parks and Recreation and
Public Buildings, and .upon the favor-
RESOLVED, that upon appeal of Vince Hencier from the decision
of the Commissioner of Parks and Recreation and Public Buildings,
and upon the favorable recommendation of the Board of Zoning,
the commercial use authorized on a portion of Lot 11, Block 12,
College Place West Division, at the northeast corner of Fairview
and West Minnehaha Avenues, is hereby extended to the entire
lot, and permission is hereby given to the owner of said lot to
devote the same in its entirety to commercial use, with the same
intent, purpose and effect as if said lot had been entirely
classified under thetZoning Code, as amended, in a Commercial
District.'-,

followings
Application of Vince Henelzr-, for permit to install and operate a
11-car private off-street parking lot in conjunction With proposed
11 -unit apartment at the northeast corner of W. Minnehaha and -Fairview Aves.
Appeal of Vince Hencier for extension of Cc miercial use to cover entire

Dear Sir:
This is in the matter of 1) the appeal of Vince Hensier to extend a use per-
mitted on a portion of•a lot to the entire lot, and 2) an applicantion for a
permit for an 11 car private parking lot on property located on the northeast
corner of Fairview Avenue and West Minnehaha Avenue. The property is described
as Lot 11, Block 12, College Place West Division. The south 100 feet of the
property is zoned. commercial and the balance "B" residence, and has been since
the adoption of the Ordinance in 1922.
The site was occupied by a small one -story grocery store for many years which
has now been removed fbr the proposed.development of-an-11 unit 21 story apart-
ment building with 11 off - street parking spaces accessory thereto. This is a
corner lot and fronts on both Minnebaba and Fairview Avenues, with a frontage
of 59.78 feet on Minnebaba Avenue and 176.12 feet on Fairview Avenue, resulting
in an approximate area of 10,529 square feet. It would not be possible to
construct the apartment unless the applicant_: is,granted the appeal % extend
the use to cover the entire lot as he would not have sufficient area for his
off-street parking. The applicant has circulated a consent petition among
the neighbors and bas,secured approval`of nearly all of the adjoining property
owners. The proposed development meets the recommended standards for density
and,building ground coverage.
North and adjoining is a single- family-residence fronting on Fairview Avenue;
south and across Minnehaha Avenue is a small neighborhood grocery store; east
and adjoining is a tbree -plex fronting on Minnebaba avenue; west across Fair-
view Avenue are two single- family residences, one fronting on Minnebaha Avenue
and the other on Fairview Avenue. Field investigation discloses no basic
objections as the portion of the property classified "B" residence is in it-
self unbuildable because of lack of sufficient ground area to meet the minimum
requirements. Because of the commercial zoning of past of this property, it
would be possible to develop it with a commercial use which would be less
desirable than the proposed one. The Traffic Engineer has approved the park-
ing lot plan which meets the standards for this type of facility.
In consideration of the above factors, the Board of Zoning recommends 1) the
granting of the appeal to extend the commercial use to the entire lot, and 2)
-the granting °of the permit for an 11 -car off'- street private•.parking lot -in
conjunction with the-proposed eleven unit apartment building, in accordance
with plans approved March 3, 1960.

I hereby appeal under the appropriate section of the Zoning Code for the
extension of Commercial use to cover all of Lot 11, Block 12, College
Place Nest Division. The south 100 ft. of said lot is now zoned for
Commercial use and the north 76.10 ft. is Class "B" Residence District.
The property is situated at the northeast corner of Fairview and W. Minne-
haha.
I propose to wreck the present structure on the lot and construct an
apartment building containing 11 units.
