"An ordinance amending the Zoning Code, Chapters
60 to 64 inclusive, of the Saint Paul Legislative
Code, as amended, pertaining to Use Districts,
Heights Districts and Rezoning of certain properties
in the City of Saint Paul. -This._i_s an -emergency
ordinance rendered necessary for the preservation of
the public health, peace and safety."

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Section 1. That Ordinance No. 11641+, approved December 23, 1959,
be and the same hereby is amended in the following particulars, to -wit:
(a) That paragraph 1 of Section 2 of said ordinance shall be and
hereby is, amended to read as follows:
"That the petitioner, Ralph Traficante, or his successor
or successors in interest, in respect of,the hereinabove described
g real estate, shall, within 120 days next'after the enactment of

" permit or permits for the grading and surfacing with blacktop

' material, of the public all in said West Side Land and Cottage
Co.'s Subdivision of Block 36, Brown and Jackson's Addition;to";�- �-�'-
West St. Paul, by said petitioner or his said successor or suc-
`> cessors in interest, et the expense of said petitioner or that
of his said successor or successors in interest, and for an
; additional permit or permits-for-the construction of a continuous
line of fencing upon and along the north and south lines of said
public alley .,by said petitioner or his-.-said successor or successors
in interest, -and at said petitioner's own cost and expense or that
i of his said successor or successors in interest."
" (b) That paragraph 2 of said Section 2 of said ordinance shall
be and hereby is amended to read as follows:
"That said petitioner, or his said successor or successors
in interest, shall, within 120 days next succeeding the enactment
of this ordinance, file with the City Clerk the written covenant
of said petitioner, or that of his said successor or successors in
interest, binding said petitioner or his said successor or suc-
cessors in interest unto the City of Saint Paul to grade and surface
with blacktop material said public alley and to construct said
fencing at said petitioner's own cost and expense or that of his
said successor or successors in interest, under the supervision and
subject to the inspection and approval of said City,'s Commissioner of
Public Works, and to install such speed limit signs in respect to

said City's Commissioner of Public Safety, at said petitioner's
own cost or that of his said successor or successors in interest."
(c) That paragraph 3 of said Section 2 of said ordinance shall
be and hereby is -amended to read as follows:
"That the requisite City of Saint Paul permits for
the aforesaid work on the part of said petitioner or his said
successor or successors in interest, be duly issued pursuant
to proper applications therefor, in each instance, within the
period of 180 days next succeeding the enactment of this
ordinance and that said work shall be commenced by said petitioner
or his successor or successors in interest not later than
September 1, 1960, and completed not later than January 1, 1961.11
(d) That paragraph /+ of said Section 2 of said ordinance shall
be and hereby is amended to read as follows:
"That said written covenant by said petitioner or his
said successor or successors in interest hereby, required to be
filed. with the City Clerk shall be secured by an accompanying
surety bond executed by said petitioner or his said successor
or successors'in interest, and a corporate surety authorized to
do business in the State of Minnesota, in favor of said City of
Saint Paul, in the penal sum of at least 410,000, conditioned
for the performance of said written covenant by said petitioner
his aid successor or successors in interest." Nevertheless the Council may,
good cause shown, by resolution extend the time for the performance by the
Section 2. This ordinance is here y ec are be an emergen

Section 3. This ordinance shall take effect and be in force
upon its passage, approval, and publication.
