WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, wood frame duplex with a detached, two stall, wood frame garage
located on property hereinafter referred to as the "Subject Properiy" and commonly lrnown as
690 SIMS AVENLTE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before Apri12, 2007, the
following aze the now lrnown interested or responsible parties for the Subject Property:
Metropolitan Capital Ventures, 2230 W County Rd C, Roseville, MN 55113; Wilford & Geske,
7650 Currell Blvd, Site #300, Woodbury, MN 55125; Kerry Clark, 12771 Falcon Drive, Apple
Valley, MN 55124; MERS, c/o Countrywide Home L,oans, 7105 Corparate Drive, Plano TX
75024; Payne Phalen District 5 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated January 3, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by February 4, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WIIEREAS, this nuisance condition has not been conected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the 5aint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, April 8, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detdmental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The demolifion of the strucrixre to be completed within fifteen (15) days after the date of the
Council Hearing; and
WHEI2EAS, a hearing was held before the Saint Paul City Council on Wednesday, May
7, 2008 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 690 SIMS AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then l�own
responsible parties to conect the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been conected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subj ect to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.

That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective acrion is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove tlus structure, fill the site and chazge the costs incurred against the
Subject Properiy pursuant to the provisions of Chapter 45 of the Saint Paul Legislarive
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolirion and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personai property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
103 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested

The Deparhnent of Safety and Inspections has declared this building(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies ar by razing and removing this building(s).
The property was re-inspected on February 7, 2008. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this
property. It is the recommendation of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a two story, wood frame, duplex with a detached two stall gazage, on a lot of
4,792 square feet.
According to our files, it has been a vacant building since October 8, 2007.
The current properry owner is Countrywide Home Loans, Inc., per AMANDA and Ramsey
counTy property records.
The city has had to board this building to secure it from trespass.
There have been four (4) SUMMARY ABATEMENT NOTICES since 2007.
There have been two (2) WORK ORDERS issued for:
- Boarding
- Removal of debris and improperly stored refuse
On November 21, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on January 3, 2008 with a compliance date of
February 4, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $34,300 on the land and $138,600 on the
building.
As of March 24, 2008, a Code Compliance inspection has been completed.
As of April 4, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $70,000 to $80,000. The
estimated cost to Demolish is $9,849 to $12,849.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

45.02, and subject to demolition under authority of Chapter 45.11.
On November 21, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-4090. That inspection will identify specific defects,
necessary repairs and legai requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Of£ice before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame duplex with a detached, two stall, wood frame
garage.
Interior
The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal azound the edges and fixtures.
2. Lack of Electricity. Immediately restore electrical service. Failure to provide
proper electrical service wi11 result in these premises being dectared Unfit for
Human Habitation and ordered vacated for lack of this basic facility. Use of
candles, fuel operated lighting or extension cord wiring is not permitted while
the power is off.
3. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tighT, water-tight and
rodent-proof condition. Permit may be required.
4. FURNACE: Have a licensed heating contractor service and clean the fumace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
Lack of Natural Gas Service. Immediately restore natural gas service. Failure
to provide natural gas service will result in these premises being declared
Unfit for Human Habitation and ordered vacated for lack of this basic facility.
6. There are missing or defective guardrails. Provide all stairways, porches,
decks or steps which aze more than 30" high with guardrails and intermediate
rails with openings in the guardrail no more than four (4) inches apart and in
accordance with the State Building Code.
7. The interior ceilings are defective. Repair a11 ceiling defects and finish in a
professional manner.
8. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
9. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the

building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
10. SELNITATION: Immediately remove improperly stored or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materials, household items, building materials, rubble, tires etc., from yard.
The Saint Paul Legislative Code requires all exterior property areas to be
maintained in a clean and sanitary condition. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.
11. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
12. Lack of Water Service. Immediately restore water service. Failure to provide
water service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
13. The water meter is missing.
14. The copper pipes are missing.
15. There is missing electrical wiring.
16. There is missing sinks and plumbing.

As owner, agent ar responsible party, you aze hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by February 4, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, wi11 begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you seli, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Deparhnent o£ Safety and Inspections,
Division of Code Enforcement. The depariment is fiuther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either arder the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate Yhis nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance wath law.

BUILDING
21. Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) are to be reconstructed as per
code.
22. Provide general clean-up of premise.

24. Repair soffit, fascia trim, etc. as necessary.

11. Ordering the owner to remove or repair the building(s) at 690 Suns Avenue within fifteen
(15} days from adoption ofresolution.
The property owner of record, Countrywide Home I,oans, Inc. did not appear. No other parties of
interest appeared.
Mr. Magner stated the building was a two-story, wood frame duplex with a detached two-stall
garage on a lot of 4,792 squaze feet and had been vacant since dctober 8, 2007. A code compiiance
inspection had been done on March 24, 2008, the vacant building regislration fees were current, and
the $5,000 performance bond had not been posted. On November 21, 2007, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on January 3, 2008 with a compliance date of
February 4, 2008. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land
to be approximately $34,300 and the building to be $138,600. Real estate tases were current. Code
Enforcement estimates the cost to repair the building to be approximately $70,000 to $80,000. The
cost for demolition was estimated to be approximately $9,849 to $12,849. There had also been four
sucnmary abatements issued to this property since 2007, two o£which went to work order: to secure
the building and Yhe City had to board the building to secure it from trespass, remove improperly
stared refuse and debris, and an emergency boarding. Code Enforcement recommends the building
be repaired or removed within 15 days. Mr. Magner stated that this property was located in an area
that had experienced extensive vandalism and anything of intrinsic value had been stolen from the
buildings. He presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was located
on a block where they were conducting a historic resource review as there was a high level of
architectural integrity to the buildings. She noted that fhis property was located one block off of
Payne Avenue which was a national registered district. This property did not have a lot of
architectural detail and had not been inventoried; however, it did contribute to the 1880's era. She
recommended that the building be rehabilifafed as this block was very intact. She stated fhaf staff
had gone out to this neighborhood and counted 11 to 13 houses out of 23 properties on the block
that were currently vacant.
Ms. Moermond stated that since no one had come forward with any plans for rehabilitarion and the
bond had not been posted, she recommended the building be removed within 15 days with no opYion
for repair.
