WHEREAS, Department of Safety and Inspecrions has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story plus, wood frame duplex located on property hereinafter referred to
as the "Subject Property" and commonly lrnown as 970 EDGERTON STREET. This property
is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before December 7, 2006,
the following are the now known interested or responsible parties for the Subject Property:
Chase Home Rinance LLC, 10790 Rancho Bernardo Rd, San Diego, CA 92127; Peterson, Fram
& Bergman, P.A., 50 East 56h St., suite #300, St. Paul, MN 55101; Payne Phalen District 5
Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated January 18, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
ar demolish the shucture located on the Subject Property by February 18, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subj ect to demolirion; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public heanings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served norice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, April 8, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

this structure in accordance with all applicable codes and ordinances, or in the altemative by

The rebabilitation or demolition of the structure to be completed withiu fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May
7, 2008 and the testimony and evidence including the action taken by the Legislarive Hearing
Officer was considered by the Council; now therefore
BB IT RESOLVED, that based upon the testnnony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 970 EDGERTON STREET.
That the Subject Property comprises a nuisance condirion as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is esrimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed mulfiple Housing or Building code
violations at the Subj ect Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely momtored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
ninety (90) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Department of Safety and Inspections has declared this building(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Depariment of Safety and Inspections has
issued an order to the then lmown responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on February 19, 2008. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting influence

The building is a two story, wood frame duplex, on a lot of 4,356 squaze feet.
According to our files, it has been a vacant building since October 11, 2006.
The current property owner is Bob Knotz, per AMANDA and Ramsey county property records.
The city has had to boazd this building to secure it from trespass.
There have been eight (8) SUMMARY ABATEMENT NOTICES since 2006.
There have been four (4) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of snow and ice
- Removal of graffiti
On December 31, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on January 18, 2008 with a compliance date of
Februazy 18, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $40,000 on the land and $110,000 on the
building.
As of February 23, 2007, a Code Compliance inspection has been completed.
As of Apri14, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $60,000 to $70,000. The
estimated cost to Demolish is $10,400 to $13,400.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Buiiding (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

This is a two story, plus, wood frame duplex.
Interior
1. The bathroom floor covering is deteriarated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throue,J�out the
bathroom and seal around the edges and fixtures.
2. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
3. FURNACE: Have a licensed heating contractor service and clean the furnace
ar boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a pernut.
4. The stairs have missing ar defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) iisers with handrails which
are grippable and installed 34" to 38" above the nose of the stair treads.
5. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.
6. The interior wa11s are defective. Repair all wall defects and finish in a
professional manner.
7. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
8. SANITATION: immediately remove improperly stored or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materials, household items, building materials, rubble, tires, etc., from yard.
The Saint Paul Legislative Code requires all exterior property areas to be
maintained in a clean and sanitary condition. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.
9. Smoke Detectar: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
10. Lack of Water Service. Immediately restore water service. Failure to provide
water service will xesult in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.

Exterior
11. The eaves and soffits aze in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
12. The exterior walls and/or trim of the house and/or garage has defective,
peeled, flaked, scaled or chatking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
13. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
14. Lack of Water Service. Immediately restore water seroice. Failure to provide
water service will result in these premises being declared Unfit far Human
Habitation and ordered vacated for lack of this basic facility.
15. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
16. The windows and/or storm windows are in a state of disrepair. Replace a11
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
17. The stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handxails which
are grippable and installed 34" to 38" above the nose of the stair treads.
18. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair. Repair in
a professional manner.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by February 18, 2��8 the Deparhnent of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you seil, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The deparknent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will noCify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
ff the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accardance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

submitted:
BUILDING
1. Move the second floor electrical panel to a common area and keep second floor unit out
of the basement, lockable.
2. Replace rear first floor entry stairs and landing to code.
3. Replace front porch skirting as needed.
4. Install/Provide hand and guardrails on all stairways and steps, including attic and
basement as per attachment.
5. Install plinth blocks under posts in basement.
6. Tuck Point interior/exterior foundation.
'7. Install twenty minute fire-rated doors, with a self closing device, between common areas
and individual areas.
8. Install tempered glass and window on stair landings per code.
9. Provide thumb type dead bolts for a11 entry doors. Remove any surface bolts.
10. Repair or replace any window sash, broken glass, sash holders, re-putty etc. as necessary.
11. Provide storms and screens complete and in good repair for all door and window
openings.
12. Repair wa11s and ceilings throughout, as necessary.
13. Provide fire block construction as necessary.
14. Prepare and paint interior and exterior as necessary (take the necessary precautions if lead
based paintis present).
15. Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of
floar area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom

Ordering the owner to remove or repair the building(s) at 970 Edgerton Street within fifteen
(15) days from adoption of resolution.
The properry owner of record, Chase Home Financial, did not appeaz. Bob Knotz appeazed and
stated that he had recently purchased the property and the closing had occurred on January 28,
2008.
Mr. Magner stated the building was a rivo-story, wood &ame, duplex on a lot of 4,356 square feet
and had been vacant since October 11, 2006. A code compliance inspecrion had been done on
February 23, 2007, the vacant building registration fees were current and the $5,000 performance
bond had not been posted. On December 31, 2007, an inspection of the building was done and a list
of deficiencies which constitute a nuisance condirion was developed. An order to abate a nuisance
building was posted on January 18, 2008 with a compliance date of February 18, 2008. To date, the
property remained in a condition which comprised a nuisance as defined by the Legislative Code.
Ramsey County Tasation estimated the market value of the land to be approximately $40,000 and
the building to be $110,000. Real estate tases were current. Code Enforcement estimates the cost
to repair the building to be approximately $60,000 to $70,000. The cost for demolition was
estimated to be approximately $10,400 to $13,400. There had also been eight siimmary abatements
issued to this property since 2006, four of which went to work order: to secure the building and the
City had to board the building to secure it from trespass, remove improperly stored refuse, remove
snow and ice, and remove graffiti. Mr. Magner noted that the building should have been converted
to a Category III building; however, it was never done and the property remained as a Category II
building. Code Enfarcement recommends the building be repaired or removed within 15 days. He
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this was a Queen Anne
style home built in 1911 and oriD nally, the pazcel contained two houses on this single lot. She
stated that the photographs showed that the siding had been covered up, the front porch was open
and intact; however, the building did not have any architectural detailing left. She noted that it was
a block off of Payne Avenue which was eligible for historic desia ation. It was also at the end of a
contiguous row of houses and had not been surveyed. She recommended the building be
rehabilitated.
Mr. Magner stated that accarding to STAMP, four mechanical permits had been issued as well as
two building permits, a plumbing pemut, and a warm air permit. He did not see that an electrical
permit had been pulled. He had inspected the building and Mr. Knotz was weil along in the
rehabilitation of the structure.
Ms. Moermond asked how they became awaze this was a vacant building. Mr. Magner responded
that the property was condemned on October 10, 2006 and there were issues with illegal occupancy
of the property and on more than one occasion, people had to be physically removed from the
property.
Mr. Knotz stated that he had a code compliance inspection done on the building after he purchased
the property. He talked to Mr. Magner and Jim Seeger and they inshucted him to go ahead and
commence the rehabilitation. He presented and explained the current photographs of the building to
Ms. Moermond. He stated that company that winterized the building did not winterize the second
floar which caused substantial damage and the project had become more substantial than he initially

believed it would be. Someone also broke into the building and stole the copper piping.

Ms. Moermond asked Mr. Knotz whether a Truth-in-Sale-of-Housing Inspection (TISH) had been
done on the property prior to him purchasing it. Mr. Knotz responded that he did not and he had
inspected the property himself. He believed that they were approximately 85 to 90 percent done
with the project and believed that he could have the work completed by May 1. He said that the
electrician still had some work to complete and that he had indicated to him that he would pull the
pernut once the work was completed.
Mr. Magner stated that State law dictates that the permit needs to be pulled before wark is started
and if the inspector finds that there wasn't an active permit that had been issued, he could "red tag"
the project and then the permit fee would double. He stated that according to STAMP, neither a
TISH nor a code compliance inspection had been done prior to his purchase as the last time a TISH
had been done was in 1995. He asked Mr. Knotz if he had purchased the property from Mark
Wiebush. Mr. Knotz confirmed that he purchased the property from Mr. Wiebusch and that he had
inspected the property himseif since he was also a reaitor.
Ms. Moermond asked Mr. Magner whether any suuunary abatements had been issued since Mr.
Knotz purchased the property. Mr. Magner responded that no orders had been issued since Mr.
Knotz purchased the property.
Ms. Moermond stated that she would recommend granting 90 days to repair the building on the
condition that the following is done by May 2: 1) the $5,000 performance bond must be posted; and
2) the remainder of the permits must be pulied. She also indicated to Mr. Knotz that he should send
her his closing documents. Since he was close to completing the rehabilitation, she would waive
the requirement of a work plan and financial documentation to complete the rehabilitation.
