OFFICE OF THE CITY of Saint Paul, in the spatter of opening and extending of wheeler Street to a width of OB feet from Thomas Avenue - COUN OLUTION —GE to the southwesterly line of Lot "E" Dickerman's�Rearran ement, mac,_,— p -ublic ' � • -'..t �.-r- _.mow -. - ....,�r -�•. — ftgli�nr PRESENTED BY COMMISSIONER— DATE RESOLVED, by the Council of the City of Saint Paul, in the matter of opening and extending of Wheeler Street to a width of 66 feet from Thomas Avenue to'the southwesterly line of Lot "E" Dickerman's Rearrangement, a public improvement proceeding of said City which involved said City's condemnation-and taking of real property therefor by power of eminent domain, under its Charter and pursuant to the Resolutions of its Council designated Preliminary Order 186+82, approved March 11, 1958, Intermediary Order 189890, approved November 12, 1958, Final Order 190+77, approved January 6, 1959, Amended Final Order•192593, approved, June 3, 1959, and Council File No.- 192594, approved June 3, 1959, such last mentioned resolution ratifying and confirming each such condemnation and taking and the award of damages as made therefor; that said Council, under its said last mentioned Resolution, having therein and thereby ratified and confirmed such condemnation and taking -and the award of damages therefor affecting those certain parcels of land situate within said City's corporate limits de- scribed as Lots 11 to 20, inclusive, Block 1, Dickerman Park, said award of damages as made, ratified, and confirmed having been in the amount -of $12,980, and an appeal having been-taken from said award of damages in the said amount of $12,980, by the purported owner of said Lots 11 to 20, inclusive, Block 1, __.Dickerman Park, North Central Properties, Inc., to the-District Court in and for Ramsey County, Minnesota, and said appeal now pending therein, and it is necessary in the public interest that despite said'appeal, said City obtain the immediate-right of entry upon and possession of'said last described real property, or so much thereof as was affected by said condemnation and taking, the amount of said award pursuant to the Statutes of the State of Minnesota-in such case made and provided, to -wits the sum of $12,980 hereby is appropriated from the funds of said City available for the payment of said award and set apart in the treasury of said City in a fund therein to be.known as the Condemnation Award Fund and there to be retained during the pendency of said appeal available at all times for the payment of the same upon demand, to whomsoever may be shown to have clear _ right to the_ same; arid. the full faith and credit of said City hereby is pledged for the payment of any increase of-said award allowed upon said appeal. 4QM COUNCILMEN ' Yeas Nays DeCourey Holland Martinson Petersen --- Rosen Winkel Mr. President, Dillon k 5M 7 -59 c 8 - - Adopted by the Co > AY - 19 MAX 5196th Approved 19 In Favor "— Mayor Against DUPLICATE TO PRINTER V COUNCIL '014 CITY OF ST.
