THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 of
the Saint Paul Legislative Code, pertaining to Use Districts, '
Height Districts, and the Rezoning of certain properties in the
City of Saint Paul, as amended, be and the same is hereby further
amended so as to rezone the following described property from
"A" Residence District to Commercial District:

Dear Sir:
This is in the matter of the application of Clayton G. Rein to rezone
from "A" residence to "Commercial" certain property located on the
north side of Magnolia between Clarence and Barclay. The legal des-
cription is attached to this letter. The property was originally zoned
at the time of the adoption of the Zoning Ordinance in 1922 as "Heavy
Industry. I" On December 20, 1947, the property was rezoned to "A"
residence and has remained as such to date.
On December 11, 1959, the Commissioner of Finance reported the
petition sufficient with 27 out of a possible 38 (7116) of owners of tracts .
within 100 feet having signed the petition. The, applicant is the owner
of all of the land involved in the request for rezoning. The applicant
proposes to develop the property under consideration for shopping center
use in conjunction with the property located immediately to the west
which is now being developed as the Phalen Shopping Center.
The property under consideration consists of two separate tracts of land.
They are separated by Birmingham Street as platted, being 30 feet wide
and running north and south. The smaller of the two tracts is rectangular
in hhape having' a frontage of 70 ft. along Magnolia Ave. , and a depth of
893. 6 feet, resulting in 62, 552 sq. ft. The other tract is irregular in
shape and has a frontage along Magnolia Ave. of 470 ft. and a depth from
Magnolia which varies, resulting in an area of 490, 920 sq. ft. The two com-
bined tracts result in an area of 553,47Z sq. ft.. These two tracts com-
bined with the tract adjoining on the west will produce a shopping center
area of 1,063,500 sq.- ft. , or 24.4. acres.
The City intends to open, widen,, and extend Rose Ave from approximately
200 ft. west of Barclay Street to Prosperity Avenue which will provide '
street frontage for this center along said street. The petitioner's plan,
dated October 20, 1959, indicates there will be approximately 1,000 off -
street parking spaces, in addition to the truck - loading and unloading
centers when the Center is completely developed. The plan also indicates
there will ultimately be Z64,700 sq. ft. of .retail building space when the
Center is completed. ;

The adjacent land uses are: East and adjoining is vacant undeveloped
land; west and adjoining is the portion of the Phalen Center already
zoned "commercial." South and across Magnolia Ave.`is vacant and
undeveloped land; farther south is a new single - family residential area;
north and adjoining is vacant undeveloped land; farther north are single -
family residences fronting on Maryland Avenue.
Ebeildvimov,es.tigb.tion discloses no basi objection to the proposal and plans.
However, it should be noted that the following recommendation is made
relative to the plan. Because of the proposed extension of Rose Avenue,
the Valuation Engineer has recommended that that part of this tract
laying north of the south line of Rose Avenue extended, be excluded from
this rezoning so that this portion of the property under consideration will
retain its present classification of "A" residence.
In consideration of the above factors, the Board of Zoning recommends
that the petition to rezone the above - described property from "A" resi-
dence to "Commercial" be granted with the stipulation that that part of
the tract which .lies north of the south line of the proposed Rose Avenue
extension be excluded from this rezoning.
