RESOLVED, upon and pursuant to the appeal of Bethany Lutheran Church, owner of the subject premises, that the building set -back for street wall line of the north 26 feet?of Lot 2, Stevens rearrangement of Lots Numbered Thirteen (13), Fourteen (14), Fifteen (15), Sixteen (16), Seventeen (17) and i Eighteen (18) of Block Numbered Four '(4) of Forestdale Addition to St. Paul, according to the recorded plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, shall be a line parallel thereto and 12 feet east of the east line of Forest Street upon which said premises abut, and the side yard space requirement therefor -shall represent a depth of 8 feet and that part of said premises lying between the south line of the same and a line parallel thereto and eight feet north of said south line of the same; and that the general provisions of thw Zoning Code are accordingly varied. The property is described as the north 26 feet of Lot 2, and Lot 1, Steven's rearr. of Lots 13 -18 inclusive, Block 4, Forest Dale Addition. .The zoning is "B" residence and has been since the enactment of the Ordinance in 1922. It has been determined that the building line requested is actually the established building line in the block, so the only matter before the Council for consideration is the relaxation of the side yard requirement. The original church structure situated on Lot 1 was built in 1899. It was - remodeled in 1953 by adding an addition to the front of the original church which established a 12 foot building line for that lot. The pro- perty under consideration is presently used as a lbwn for the church, and the applicant proposes to construct a one - story, flat -roof type of addi- tion to be used for Sunday School rooms. The side and requirement for such a` structure is 25 feet, and the proposed addition woVIZ come within feet o , e stance be wee and t e nearest residence would be 29 feet, and the owner of the residence affected has given his written consent to the proposal of the applicant. The property under consideration has a frontage of 64.16 feet along Forest Street and 100 feet along Jenks Avenue, resulting in an area of 6,416 square feet. The entire surrounding area is developed with single - family residences. Field investigation discloses no basic objections because of the type of addition proposed, and the acquiescence of the adjoining owner who is the only one directly affected by tbe. addition. The granting of this appeal would not deviate from the purpose and intent of the Zoning Code, and a denial would create a hardship on the applicant as the present church facilities are not adequate and this is tbe�only recourse possible. In consideration of thecabove factors, the Board of Zoning recommends the granting of the appeal to relax the side yard requirement to 8 feet from the south property line in accordance with applicant's plan approved January 21, 1960. : - Sincerely, ' H. Jan. 11, 1960 s J The Council of the City of St. Paul, Court House, St. Paul, - Minn„ Gentlemen; The Bethany Lutheran Church now located on lot 1 and north 26 feet of lot 2, Stevens Rearrangement of lots 13 to 18 inch, Block 41 Forestdale Addition, south east corner of Forest and Jenks Streets desire to build a twenty foot addition on the south side of building as shown on the attached plot plan. The present building is used as church and Sunday School and will continue to be used solely for this purpose. Permission is-necessary to break the property line on 26 feet of lot 2 to conform with previously approved dis- tance of 12 f x inches on lot 1. It is also necessary to have Counc 1 approval or we t addition to building as land area is less than ordinance requirement. The addition to church building is necessary to accomkdate the increase in Sunday School attendance, This appeal is made under following section of ordinance: Legislative Zoning Code Chapter 64.03 paragraph i and J.
