BE IT RESOLVED, that the Council of the City of Saint Paul, based on a review of the legislative
hearing record and testimony heazd at public hearing on April 16, 2Q08 hereby memoriaiizes its decision to
certify and approve the April 14, 2008 decision of the Legislative Hearing Officer for the following

5. Appeal of Kevin Moore to a Summary Abatement Order for property at 895 Wakefield
Avenue.
Mr. Singerhouse stated that this was a vacant building which did not have a sign off by the Building
Official. The property was inspected during the evening on April 1 and he found five or six females
and a ckuld that were living there. He issued a tag for illegal occupancy of the house and issued a
sutmnary abatement to boazd the first floor windows, the doors, and the garage doors. He also
ordered that everything on the inside of the garage needed to be removed with a compliance date of
Apri17, 2008. The property was also inspected on Mazch 12 between 730 pm. and 8:00 p.m. and
he found people drinking beer, smoking cigarettes and someone was sleeping there. He stated that
building permits had not been pulled for the windows ar siding, the electrical permit had expired,
and the only permit that was current was the permit for the plumbing. He also noted that the vacant
building registrarion fees were due and owing for 2006, 2007, and 2008.
Kevin Moore, property owner, stated that he had purchased the property on a contract for deed from
Calvin Burton. He claimed that he had been working on the house between 8:00 a.m. to 8:00 p.m.
and that no one was living in the house. He said that he had put in new windows and did not want
to board them up as it would ruin the wood. He said that he believed he would have the work
completed in the very near future as he had gotten a dumpster to clean out the garage and had
installed a new garage door. He also needed to install a new furnace. He said that Calvin Burton
had pulled the previous permits as he knew an electrician and plumber. He objected to having to
pull permits because he couldn't afford it and was living on social security disability.
Ms. Moermond asked whether a code compliance inspection had been done. Mr. Singerhouse
responded that there was a code compliance inspection that had been done•, however, Jim Seeger
needed to inspect the building before he could sign off on the items that were completed provided
permits were pulled.
Ms. Moermond recommended denying the appeal and granting an extension to Apri125 provided
the necessary permits are pulled; the vacant building fees are paid; and the registration form is
completed. If Mr. Moore did not comply, she recommended the first floor of the building be
boarded.
