WHEREAS, in the Matter of the Comptrollerts Contract L -6098,
for the Grading and Improving of KASOTA AVENUE from Raymond
Avenue to the Junction with the permanent roadway-at Station
15 plus 431 J. R. Walker & Sons, Inc., Contractor., the spec-
ified date of completion was JULY 11 19591 and
WHEREAS, the Contractor has prosecuted the work diligently, but
due to delay in order that the work could be co- ordinated with
associated work done by the Northern Pacific Railway Company
and Fence Relocation by the Gateway Transportation Company, it
was not' possible to complete the Contract by said date of com-
pletion, therefore, be it
RESOLVED, that the proper City Officers be and they-are hereby - '
authorized and directed to execute En amendment to'said Contract,
extending the time of completion to AUGUST 24; 1959., provided
however, that this Resolution shall ave r
no oce or effect,,
unless the Sureties on the Contractor's Bond consent thereto
and file such consent in writing with the City Comptroller, and
be it -
FURTHER RESOLVED, that the City of St. Paul hereby waives all
claim for liquidated damages and that __no Engineering and
Inspection costs on thi "s Project will be charged by the City
on account of such extended period.
