That the Zoning Code, Chapters 60 to 64 inclu- sive of -the Saint"Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "A" Residence District to "C" Residence District: Lot 9, Block 33, Suburban Hills Addition, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County,"Minnesota, situated at the northeast corner of Johnson Parkway, McLean Avenue and Point Douglas Road in the City of Saint Paul. Section 2. This ordinance is hereby declared to be an emer- gency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. January•28, 1960 Mr. Joseph Okoneski, City Clerk t Building Dear Sir: This is in the matter of the petition of Phillip F.Cormican to rezone from "A" to "C" residence property located on the northeast corner of Johnson Parkway, McLean Avenue and Point Douglas Road. The property is described as Lot 9, Block 33, Suburban Hills Addition. The zoning is "A" residence and has been since,the adoption- of the Ordinance in 1922. The commissioner of Finance on December 18, 1959, reported the petition sufficient with the owners of four of a possible five (80%) tracts of r land within. the prescribed 100 foot radius siWng the,petition. i The site is presently occupied by a single - family residence which the applicant proposes to remove in order to construct four eleven -unit apart- ment buildings. The petitioner did not have anything in the way of plans to present at the Board of Zoning meeting. The property under consideration is an irregularly shaped tract of land having a frontage of 135 feet along Johnson Parkway, 112 feet along Point Douglas Road, and 22 feet on McLean Avenue, resulting in a total area of approximately 26,717 square feet. The site is approximately 12 to 14,feet above the existing street grades. North and adjoining is vacant land, farther north is a filling station and one -story office building which front on Highway No. 12; south and west across Point Douglas Road are new, substantial single - family residences; east and adjoining is vacant land, southeasterly across McLean Avenue are new single - family residences. , Field investigation discloses that this property and the adjoining vacant land should remain "A" residential and be so developed. To rezone this land would create a "spot zone" and would not be in accordance with the proposed land use guide plan. It is the opinion of the Board of Zoning that the highest and best use of this land would be for single and two - family use and to reclassify it would deviate substantially from the purpose and intent of the Ordinance and would be detrimental to the new residential development to the south. The denial of this petition would not create a hardship on the petitioner as this land lends itself to single and two - family use. In consideration of the above factors, the Board of Zoning recommends the denial of the petition to rezone from "A "* to "C" residence the above described property. HCW :FGI Encl. We have here an attempt by downward spot rezoning to- invade a very beautiful neighborhood, of practically all new, homes, each running into the high brackets in value, and taxed accordingly, homes which were built by our neighbors through the purchase of the land and construction of beautiful homes; homes that are well kept up and with yards that are beautified and well.maintained, and homes that we have put our life savings into. We have done this in the belief that being on and near a Parkway no rezoning would take place, and we bought in an A -Class neighborhood and not in one classed otherwise when we came here. It is not a question of we building in a spot -zoned neighborhood, but in an A -Class one. I respectfully submit it is almost inconceivable to think any downward spot rezoning would be attempted in such a neighborhood, especially on a Parkway, constructed to beautify our city, which in itself would feel the impact. We feel the erection of these apartment buildings, and the spot rezoning would greatly depreciate our - neighborhood and our investments. To show the feeling of the people in this vicinity you have a petition signed by 73 home, owners, strenuously opposing this spot rezoning, and from that petition opposing the rezoning it is very evident that the whole neighborhood are very much concerned about this attempt to spot rezone this residential area. Many of these petitioners are here today. Your Honor, and members of the Council: Nay name is Harry C. Burningham, and I live at 303 Johnson Parkway, directly across the Parkway from this proposed downward spot zoning of our Class A neighborhood.
