Minnesota, pursuant to,the provisions -of Chapter 64, Zoning Code of the City
of Saint Paul, - Minnesota, hereby requests your Honorable Body to rtablish
zoning and confirm that the zoning for the following described vacated streets
and alleys situated within Lot 2, Block 2, Western Area Addition, and as shown
on Exhibit No. 1 hereto attached, (is that of a commercial district:
All of those parts of Fuller Avenue, Central Avenue, --
Ravoux Street and Cathedral Place, now vacated, and all of
that part"of Old Military Road, also known as Territorial
Road, now vacated, lying within Lot 2, Block 2, Western
Area Addition;
All of the alley, now vacated, in'that part of,Lot 2,
Block 22 Western Area Addition, formerly the alley shown
in Block 4, Florence Addition to St. Paul corrected plat;
All that part of the alley, now vacated, formerly in Block 4,
Drake & Dewey Addition; and all of that part of the alleys,
now vacated, formerly in Block 1, Dewey, Drake -& Pence's

That the City Council of the City of Saint Paul by Ordinance,
Council File No. 186770, adopted on April 17, 1958, re -zoned the property
situated within the tract of land now described as Lot 2, Block 2, Western
Area Addition, from the then existing zoning classification to commercial `
district. That at the time of the passage of said Ordinance the streets and
alleys, now vacated and referred to above and shown on said attached Exhibit
No. 1, had not been vacated, and the property abutting on said vacated streets

and alleys in said re- zoning Ordinance were described by lot and block des-
criptions of the same prior to,.the change in the legal description thereof
which resulted from the filing of the plat for the Western Area Addition.
That the City Council of the City of Saint Paul, by Resolution,
Council File No. 187282, adopted May 6, 1958, vacated certain streets and

alleys situated within the Western Redevelopment Area, Project UR Minn. 1 -2,
including the streets and alleys, now vacated, described above, and situated
within said Lot 2, Block 2, Western Area Addition.
That,the Housing and Redevelopment Authority of the City of Saint
Paul, Minnesota, on March 27, 1958, entered into a contract with Sears, Roebuck
and Co. for the -sale of Parcel No. 3, Western Redevelopment Area, Project
UR Minn. 1 -2, as said parcel is identified in Parcelization Map dated February,
1957, for" said project area, and being the real property now described as
Lot 2, Block_29 Western Area Addition. That in accordance with the Redevelop-

went Plan for said project area and said contract for'theti sale by the-'Authority
of said Parcel No. 3, all of said Lot 2_,'Block 2,,Western Area2Addi.tion is to

be developed by the purchaser thereof for commercial use, including those
portions thereof, described above, and being vacated streets and alleys. That
in accordance with said contract, the Authority is required to, prior to
conveyance, re -zone all of the property being sold thereunder to "commercial ",
and it is necessary that zoning a,s to said vacated streets and alleys situated
within said Lot 2,'Block 2, Western Area Addition, be established and confirmed
to be that of a commercial district for the purpose of carrying out the.object-
ives of the Authority, the Redevelopment Plan for the Western Redevelopment
,Area, Project UR Minn. 1 -2, and the contract for the sale, conveyance and re-
development of said parcel of land.
That the Housing and Redevelopment Authority of the City of Saint
Paul is the owner of all of the real property fronting on said vacated streets
and alleys, and the undersigned signatures represent signatures on behalf.of
owners of at least two- thirds of the several descriptions of real estate sit-
uated within 100 feet of said vacated streets and alleys. That the Housing and
Redevelopment Authority of the City of Saint Paul is the owner of all of the land
embraced within the areas of'said above described vacated streets and alleys.

The Board of Zoning at its regular meeting of January 7, 1960, considered this
matter and recommends this land be classified in the commercial district. It
was their opinion that this would be the highest and most suitable classification
for this land, and that it would integrate all of the properties which adjoin it
as one unit for its highest and best possible use.

The properties which immediately adjoin said vacated streets and alleys and
lie within Lot 2, BLock 2 of the Western Area Addition have been reclassified
to a commercial district._ This was accomplished under Ordinance No. 11231
approved April 17, 1958 ( C.F. No. 186770) and Ordinance No. 11251 approved
May 27, 1958. On May 6, 1958,-said city under Council File No. 187282 vacated
the above described streets and alleys and on May 7V1958 under Council File
No. 187336 conveyed said streets and alleys by quit claim deed to the St. Paul
Housing and Redevelopment Authority.
This property is a part of the proposed Sears-Roebuck and Co. site and it is
at the request of said company that the Housing and Redevelopment Authority is
requesting the City Council to establish or confirm the zoning classification
of this land.
The City Attorney has rendered an oral opinion in that when a public street or
alley is vacated, it shall take on the same classification as the property hick
it adjoins.
That the following language contained in Section 1 of
C. F. 195703, to -wit:
"in every necessary particular, so that thereunder
the rezoning and reclassification of the following
described real property in a Commercial District
shall be effected, established and confirmed:"
be and hereby is amended to read as follows, to -wit:
"so as to zone or re -zone and to establish and
confirm the zoning of the following described
real property to that of a Commercial District *"

and respected citizens, Joseph A. Rogers, who was called from
this life by Almighty God on the 16th day of January, 1960;
a lifelong resident of this City, Joseph A. Rogers devoted himself
to the furtherance of the public interest and the promotion of
the commonwealth of the City of Saint Paul and its inhabitants,
in the fields of business, civic promotion and humanitarianism;
and
RESOLVED', FURTHER, That this Council, in behalf of the
people of said City, records high appreciation and gratitude to
said decedent, Joseph A. Rogers, and expresses its sense of
great public loss by reason of his death, and extends to his
surviving wife, Monica, to his son, Joseph A. Rogers, Jr., and
to his two daughters, Mrs._Roger L °emieux and Mrs. Richard Battis,
all of Saint Paul, a sincere expression of sympathy and condolence
in their bereavement; and
RESOLVED, FURTHER, That the City Clerk cause an
