THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

certain properties in the City of Saint Paul, be and the same
is hereby further amended so as to rezone the,,4following described

,I.should like also to bring to your attention oi, recall to your minds athat not too long
ago, I believe'it was on- Lincoln Avenue that's proposed'boarding home for girls was con
templated. The people in that block petitioned to' preserve the character of the new'
area as a residential zone and the petition.was•aparoved in spite of the fact that the
owner of said building claimed that the sum of- around S30-or 35 Thousand dollars had

I should like to mention.' A recent one was.the case, City of St. Paul vs Kegis wherein'
the Council rezoned after the foundations of the structure had been poured. This de --
cision of the Council was challenged in court ana the Supreme Court of Minnesota ruled
that the - Council had the right to rezone so long as no putt of the structure -had been
-built above the ground.- In, -the present case, not even the foundations have been poured.
Th-e.only work accomplished to date has been'the partial clearing of the lot and digging
trenches for the footing.- But the footings - themselves have -not been placed,,nor are the
trenches deep enough according to the Building Inspector.
I might also add'that we home owners on the South. ;ide of James Avenue which is a
residential -zone are in this case innocent bystanders and we have much to dose by,the
block on Randolph being zoned Commercial resulting in a depreciation of our property.
In view of the facts submitted, we wanV,to`,go,.on :record apposing: dfiy,'cobmercielV1venture

In regard to the move entitled tm.atter, 1 represent Main Realty,
inc., a .Minnesota corporation, who sold "ihe Last 25 feet of Lot .:2, Block
7, Hankees Cleveland View" to Peter M. Isaac ou august 23, 196U, for the
sum of $2,000.00. The contract for said sale was contiugent upon fir. Isaacs
obtaining a building permit. which permit was obtained Septernber 27, 1960.
Upon obtaining said building permit, the deal wus consummated lfter Mr.,
Isaac ordered special trteei which was cut to ur<ter• an' aA'ter +'.r, l,�aac dug
the footings for a building, which was to conform, with tt'e DUA t,tan. line of
adjacent houses, a petition to rezone was filed by the neighbors. which was
not consented to by Mrs, Isaac.
Upon filing said petition. work was ordered ttoppedby the City of
St. Paul. This matter was brought to the attention of the Council at which
meeting, it is may understanding, Commissioner Loss stated my client, Main
Realty, Inc., was willing to refund to Mr. Isaac monies pia d for said lot.
My client, Main Realty, Inc., feels it has a mora; duty to inform the Council
that it does not intend to refund the monies; that the contract was entered
into "bona fidely "; and that the conditions of the contract were complied with.
My client, Main Realty,•Inc., also feels a moral obligation to
inform the Council of the history of said property and the fhct that the
neighbors have had knowledge for a long time that this lot is zoned Commercial,
and that a building would be erected on it.
In 1958 the neighbors attempted to rezone this lot, but were
unsuccessful due to mechanics of the petition. Instead u: azain attempting a
rezoning by correcting their procedure, the matter 'was left dormant. At this
time the neighbors knew of the commercial aspect of said lots.
In July, 1959, I drafted an Earnest Money Contract whereby Herbert
J. Wigley agreed to purchase the Fast 25 feet of Lot 22 for 32,300.00. At
said time I was to register this lot under the Minnesota torrensi system. At
the request of Mr. Wigley's attorney, Bernard Litman, 1 named the .adjoining
property owners as defendants. These adjoining property owner&, namelyy
Ethel works, John B. Kettleson, and Dorothy Susan Kettleson were served with
Land Title Summons in 'said registration. At said time, Mr.. Litman talked to
the adjoining neighbors above named regarding the fact that a building was
to be erected on this lot. I also talked with the adjoining land owner, hthe.l
Works as late as this past summer. The transaction with Mr. Wigley was never
completed due to sickness in Mr. Wigley's family.
My, client offerred to sell this lot to the neighbors over a year
ago, but was refused. It would appear that the neighbors have waited an
unreasonable length of time before proceeding with this petition. 'The legal
theory of "laches" applies and is defined an:
"Omission to assert a right for an unreasonable
and unexplained length of time, under circumstances
prejudicial to adverse party."

Dear Madam:
This is in the matter of the petition of the Grandview Corporation to
rezone from "A" to "C" 'residence property located on the east side of
Edgcumbe Road between Morgan and St. Paul Avenues. The property is
described as Lots 11, 12, 13, Block 3, Granport Addition.
On October 18, 1960, the Commissioner of Finance reported the petition
sufficient with the owners of 4 of a possible 5 (80,%) tracts of land
within the required 100 foot radius having signed the petition. The
site is presently vacant and the petitioner proposes to develop it
for multi - family residential use although he has not presented any
definite plans as to the particular number of units. The applicant
has indicated that this proposed use will meet the recommended stand-
ards for.tbis type use. The property has a frontage of approximately
131 feet along Edgcumbe Road, and a frontage along both St. Paul and
Morgan Avenues of 130 feet, resulting in a total area of approximately
17,630 square feet.
Directly east and adjoining is vacant land having frontages on both
Morgan and St. Paul Avenues. This property was recently reclassified
to "C" residence; north and across Morgan Avenue are single - family
residences; west and across Edgcumbe Road are single - family residences
which front on Edgcumbe Road; south and across St. Paul Avenue is the
fire station; southwesterly across the intersection of St. Paul Avenue
and Edgcumbe Road are single - family residences which front on St. Paul
Avenue. All of the residences in the immediate area are of recent
construction.
The Board of Zoning considered this matter at their regular meeting on
November 3, 1960, and recommend approval of the petition to rezone the
above described property to "C" residence as requested by the applicant.

This is in the matter of the petition to Bernard Mulligan to rezone from ecmmercial to
"B" residence property located on the north side of Randolph Avenue between Kenneth
Street and Cleveland Avenue. The property is described as Lots 17 through 30, Block
7, Hankee's Cleveland View Addition.' The property has been zoned commercial since the
adoption of the Zoning Ordinance in 1922.
On October 10, 1960, the Commissioner of Finance reported the petition- sufficienVwwith
the owners of 14 of a possible 18 (77 %) tracts of land within the required 100 foot
radius having signed the petition.
In September of 1958, and attempt was made to rezone the remaining vacant lot in the
block from commercial to "A" residence. However, the petition was reported insuffi-
cient.
The properties under consideration are entirely developed with single - family resi-
dences which front on Randolph Avenue except for one remaining vacant lot which is
proposed to be developed commercially and for which use excavation has taken place.
The sole purpose of the petition to rezone this property is to restrict the one
remaining lot to residential use. The property under consideration has a frontage of
560 feet along Randolph Avenue and a depth of 122.5 feet, resulting in an area of
approximately 689600 square feet.
South and across Randolph Avenue is St. Catherine's College; directly west and ad-
joining are commercial uses consisting of a drug store and a launderette; north and
across a public alley are single-family residences which fronton James .Avenue; east
and across Kenneth Street are single- family residences which fronton Randolph Avenue.
Field investigation discloses that the area is predominantly single - family residen-
tial in character.
The Board of Zoning considered this matter at their regular meeting on October 20,
1960 and wish to point out that the petitioners had knowledge of the commercial
zoning of their property as long asotwo years ago and that the vacant property
could be put to a commercial use. The Board is of the opinion that the opponents
should have acted earlier to change the zoning status of this vacant lot, and not
have waited until construction was actually under way to develop the site with a
commercial use. They wish to further state that it has long been the policy of the
Board to deny any and all,requests for rezoning which would permit the rezoning of a
man's property without his consent. In consideration of these factors, the Boar d
of Zoning recommends the denial of the petition to rezone the above described
p operty from commer ial to "B" residence.
