RESOLVED, by the Council of the City of Saint Paul, that Chicago,
Frock Island and Pacific Railroad Company hereby is granted permission and
- ,uthbrity to install, maintain, and operate over and across the public Levee of
the City of Saint Paul, a metal pipe not in excess of 8 inches in diameter, for
the conduct of oil, gasoline, and comparable fluid materials, the center line of
said pipe, as installed, maintained, and operated, being that described as follows;
to -wit:
Commencing at a point 164.6 ft. North and 317.3 ft. Vest of the
intersection of the west line of Taft Street and the south line
of Tennessee Street; thence south parallel to Taft Street 193.0 ft.;
thence south 35 degrees and 1+$ minutes, a. distance of 104.0 ft.
said center line being located within Government Lot 5, Section 5,
Township 28 North, Range 22 Vest, in the City of Saint Paul,
County of Ramsey and State of Minnesota, according to to the
Government Survey thereof on file and of record in the office of
the Register of Deeds in:and for said County;
that -said pipe and the installation, maintenance, and operation of same shall
be subject to reasonable regulation by said City of Saint Paul in relation
to height and depth in respect of the ground level adjacent to the same ,and so as
to provide against detriment to the public interest, particularly in respect of
a presently proposed and pending Federal Governmental Flood Control Project
in said City.
RESOLVED FURTHER, that said permittee, Chicago, Rock Island and
Pacific Railroad Company, shall be obligated to fully indemnify and hold harmless
said City of Saint Paul against :all liability on account of injury to person or
property occasioned by the exercise of the permission and authority hereby
granted.
RESOLVED FURTHER, that such permission and authority for the installa-
tion,, maintenance, and operation of said pipe upon said center line for said
purposes shall be apptarttnant thereto and for the service of real property ownz:d
by said permittee abutting the line of the public Levee the greater distance from
the Mississippi River.
