WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated December 28, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subjeet Pxoperty is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by January 27, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to consritute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been conected and Department of Safety and Inspecrions requested that the City Clerk schedule public hearings before the Legisiative Hearing Officer of the City Council and the SainY Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the fime, date, place and purpose of the public hearings; and WHEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, March 25, 2�08 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Sub}ect Property safe and not detrimental to the public peace, b� -r.{-I 7 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicabie codes and ordinances, or in the alternarive by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WI�REAS, a hearing was held before the Saint Paul City Council on Wednesday, Apri116, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order conceming the Subject Property at 60 GEORGE STREET EAST. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is esrimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. � That the deficiencies causing this nuisance condition have not been conected. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, VacantlNuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The 5aint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and weifare and remove its biighting influence on the community by rehabilitating this structure and conecting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s} in � - �-11 - 1 86 87 88 89 90 91 92 93 94 95 96 97 98 99 100 101 102 103 104 accordance with ail applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. If the above corrective action is not completed within this period of time Departrnent of Safety and Inspecrions is hereby authorized to take whatever steps are necessary to demolish and xemove this structure, fi11 the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since January 9, 2007. The cunent property owner is S. Michael Widzins, per AMANDA and 12amsey county property records. The city has had to board this huilding to secure it from trespass. There have been three (3) SUMMARY ABATEMENT NOTICES since 2007. There have been two (2) WORK ORDERS issued for: - Removal of improperly stored refuse - Removal of tall grass and weeds On November 20, 2007, an inspection of the building was oonducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUTSANCE BUILDING was posted on December 28, 2007 with a compliance date of January 27, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are delinquent in the amount of $375.00. The structure is a ren stered vacant buiiding and must have a Code Compliance Certificate before the structure may be occupied. Imsnediately vacate the structure or obtain a Code Compliance Certificate from L.I.B.P. You may contact Jim Seeger at L.T.E.P. for code compliance inspection, permits, and issuance of Code Compliance Certificate. Under Chapter 33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance Certificate or to vacate the structure may result in issuance of criminal summonses. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not conected by January 27, 2008 the Department of Safety and Inspections, Division of Code Enfarcement, wi11 begin a su6stantial abatement process to demolish and remove the building(s). Michael Widzins appeared with his real estate agents and stated that he intended to sell the property. Ben Rust, attorney with Peterson, Fram & Bergman, appeared on behalf of Chase Mortgage Company. Mr. Magner stated the building was a two and one-half story, wood frame, duplex with a detached two-stall garage on a lot of 7,405 square feet and had been vacant since January 4, 2007. A code compliance inspection had not been done, the vacant building registration fees were delinquent in the amount of $375 and the $5,000 performance bond had not been posted. On November 20, 2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on December 28, 2007 with a compliance date of January 27, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Ta;cafion estimated the market value of the land to be approximately $58,400 and the building to be $111,600. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be more than $80,000. The cost for demolition was estimated to be approximately $12,999 to $15,999. There had also been three summary abatements issued to this property since 2006, two of which went to work order: to secure the building and the City had to boazd the building to secure it from trespass, remove improperly stored refuse, and cut tail grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was an 1899 Queen Anne style house. There had been a loss of integrity to the exterior of the building and there was no architectural, historical significance to the building. She said that there were a lot of properties on George Street that were listed as eligible or significant; the Riverview Library at 1 George Street and another property at 65 George Street. The remainder of the properties listed in the 1983 survey of historical significance were located in the 200 and 300 block of George Street. Mr. Widzins stated that he had owned the property for approximately 15 yeazs and it was his intention to sell the property as is. He was requesting additional time to be able to sell the property. Ms. Moermond asked whether a code compliance inspection had been done on the property. Mr. Widzins responded that the building had not been inspected. Mr. Rust stated that Mr. Widzins was current with his mortgage and the mortgage company was concerned that if the building were demolished, they would lose the remainder of their financial interest in the property. The following must be received by the end of business on April 11: 1) the vacant building fees must be paid; 2) the registration form must be filled out; 3) the code compliance inspection must be completed; 4) the performance bond must be paid. If the following conditions were met, she would recommend continuing the Legislative Hearing to May 13 for a new owner to present the following: 1) a signed purchase agreement; 2) closing docuxnents; 3) a work plan; and 4) financial documentation. Michael Widzins, properiy owner stated that the property had been up for sale; however, he did not have a signed purchase agreement to date. He had also attempted to see if he could get the funding to do the rehab himself. Jason Burke, Edina Realty, stated that the property had been put on the market on April 14 and they had 19 showings so far. The listing price was $79,900 and he had received a verbal offer that morning for $35,00Q It was his understanding that there was $40,000 outstanding on the mortgage. Mr. Rust stated that the loan was current and the bank's concern was that they would lose the money if the building is demolished. Since this was an FHA loan, he would have to negotiate with T3L7D on the purchase price if the $35,OQ0 were accepted as there would be a$5,000 gap on what was currently owed on the loan. He requested an additiona160 days in order wark out the issues. Ms. Moermond stated that the building had been vacant for over a year and the photos indicated that the building was in pretty bad shape. Mr. Magier stated that there was a follow up Legislative Hearing on June 10 and Mr. Widzins appeared with a purchase agreement which had not been executed. The hearing was continued to today so that the new buyer could attend and present the signed purchase agreement, a work plan, financial documentation, and the registered vacant building form needed to be executed. Ms. Moermond stated that in reviewing the work plan, it seemed consistent with the City's estimated cost to repair the building. Mr. Magner confirmed that it was. Mr. Moore stated that they were scheduled to close on the property that afternoon. He stated that he had an$80,000 line of credit approved with Landmark Bank which was in addition to the $40,000 for the purchase price of the home. Ms. Moermond stated that she would need a letter from the Bank indicating that there was an $80,000 line of credit or an escrow account for this project. She also requested Mr. Moore provide a letter indicating that he was dedicating the $80,000 funds from this account for the project. Mr. Magner stated that he also needed to have the registered vacant building form filled out. Mr. Moore fiiled out the form and gave it to Mr. Magner. Ms. Moermond stated that the following must be received by Friday, July 11: financial documentation from the bank showing the line of credit to complete the rehab; and a letter from Mr. Moore indicaring that he is willing to dedicate that amount of funding for this project. Mr. Manger suminarized the reports he presented at the March 25 and May 13 Legislative Hearings. Ms. Schutter stated that she was in received a Purchase Agreement in the amount of $40,000 from Kurt and Rick Price on June 9, the previous day. Mr. Widzins, however, was not available to execute the agreement. Mr. Price stated that he was aware that a work plan and financial documentation needed to be presented; however, he could not attend the hearing and did not have enough time to prepare the work plan far the hearing. She also had attempted to contact the mortgage company to see if they would approve the sale since she believed Mr. Widzins owed approximately $4Q000 on the loan and he did not have the money to pay off the loan himself nor the estimated closing costs. Ms. Moermond expressed extreme disappointment that this matter had been ongoing since the end of March and now they walked in at the eleventh hour with a Purchase Agreement that had not been properly executed. She stated that a hole in the gound was not worth much and they should have worked mare quickly on the sale of the house, Ms. Moermond stated that she would need to receive the following by June 17: 1) a signed purchase agreement; and 2) the closing must be scheduled within 10 days of signing the purchase agreement. If this was completed, she would recommend to the City Council that they continue this matter to the July 2 Council Public Hearing in order far the new buyer to provide a wark plan and to demonstrate that they have financial ability to complete the repairs which was estimated to be in excess of $80,000.
