WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before Apri12, 2007, the
following are the now known interested or responsible parties for the Subject Property: S

Vision Drive, Columbus, OH 43219; West Side Citizens Organization.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated December 28, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subjeet Pxoperty is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by January 27, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to consritute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Department of Safety
and Inspecrions requested that the City Clerk schedule public hearings before the Legisiative
Hearing Officer of the City Council and the SainY Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the fime, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, March 25, 2�08 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Sub}ect Property safe and not detrimental to the public peace,

health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicabie codes and ordinances, or in the alternarive by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WI�REAS, a hearing was held before the Saint Paul City Council on Wednesday,
Apri116, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 60 GEORGE STREET EAST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is esrimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been conected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantlNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The 5aint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and weifare and remove its
biighting influence on the community by rehabilitating this structure and conecting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s} in

accordance with ail applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
��� �� one hundred-eiEhtV (180) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Departrnent of
Safety and Inspecrions is hereby authorized to take whatever steps are necessary to
demolish and xemove this structure, fi11 the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

as defined by Legislative Code, Chapter 45. The Department of Safety and 7nspections has

The building is a two and one-half story, wood frame duplex with a detached two stall gazage on
a lot of 7,405 squaze feet.
According to our files, it has been a vacant building since January 9, 2007.
The cunent property owner is S. Michael Widzins, per AMANDA and 12amsey county property
records.
The city has had to board this huilding to secure it from trespass.
There have been three (3) SUMMARY ABATEMENT NOTICES since 2007.
There have been two (2) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
On November 20, 2007, an inspection of the building was oonducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUTSANCE BUILDING was posted on December 28, 2007 with a compliance date
of January 27, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $375.00.
Taxation has placed an estimated market value of $58,400 on the land and $111,600 on the
building.
As of Mazch 24, 2008, a Code Compliance inspection has not been completed.
As of Mazch 24, 2008, the $5,000.00 performance bond has not been posted.
Reai Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is more than $80,000. The
estimated cost to Demolish is $12,999 to $15,999.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property

On November 20, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As �rst remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, S Fourth Street East, Suite 200,
Commerce Building (651)266-909o. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be reqnired to post a�ve thousand doliar ($5,000.00) performance
bond with the Buiiding Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and sha11 not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is imperviaus to water and easily cleanable throughout the
bathroom and seal azound the edges and fixtures.
2. The chimney is defective, deteriarated or in a state of disrepair. Replace aL
missing or defective bricks, tuckpoint as needed to restore the chimney to a
professional state of maintenance and repair. Permit may be required.
3. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for all
entry doors to dwelling unit(s).
4. The eaves and soffits aze in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boazds, to a professional state of
maintenance. Permit may be required.
5. The exterior walls andlor trim of the house has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint
to effect a sound condition in a professional manner.
6. The foundation is deteriorated, defective or in a state of disrepair. Rapaix all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
7. G.F,C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Required.
8. The interior ceilings are defective. Repair a11 ceiling defects and finish in a
pxofessional manner.
4. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
10. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent harborages in
the yard azeas. Tuckpoint the foundation af necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
11. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.

12. Smoke Detector: Lack of properly installed and operable smoke detector.
Pxovide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
13. The exterior walls of the house andJor garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
14. DEFECTNE STAIRS. Stairs are broken, defective, or in disrepair. Repair in
a professional manner.
15. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the
door(s).
16. Lack of Water Service. finmediately restore water service. Failure to provide
water service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
17. The window andlor door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doars. Screens must be tight-fitting and securely fastened to the frames.
18. The windows andlor storm windows are in a state of disrepair. Replace a11
missing or broken window glass. PvIake all necessary repairs to frames,
sashes, hardwaze and associated trim in a professional manner. Permit may be
required.
19. There are open plumbing lines; improper repair to 2 floor bathroom lavatory.
Repair plumbing to meet current code requirements. Permit required.
20. The light fixtures have missing parts. Replace damaged fistures.
2 L There is rot damaged cabinet and floor under the 2 floor kitchen sink.
Eliminate water leak; repair cabinet and floor. Permit required.
22. The 2" floor kitchen is dirty and unsanitary. Clean and sanitize the kitchen.
23. The gutters are missing pieces; drzan next to thz foundation. Repair b tters;
direct drainage away from the house.
Garage
24. The exterior walls andlor trim of the garage has defective, peeled, flaked,
scaled ox chalking paint or has unpainted wood surfaces. Scrape and repaint
to effect a sound condition in a professional manner.
25. The roof is deteriorated, defective, ar in a state of d'asrepair. Repair or replace
the roof covering to a sound, taght and water impervious condifion. Pernut
may be required.

27. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hazdware and associated trim in a professional manner. Permit may be
required.
General
28. The structure is a ren stered vacant buiiding and must have a Code
Compliance Certificate before the structure may be occupied. Imsnediately
vacate the structure or obtain a Code Compliance Certificate from L.I.B.P.
You may contact Jim Seeger at L.T.E.P. for code compliance inspection,
permits, and issuance of Code Compliance Certificate. Under Chapter 33.03
of the Saint Paul Legislative Code, failure to obtain a Code Compliance
Certificate or to vacate the structure may result in issuance of criminal
summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not conected by January 27, 2008 the Department of Safety and
Inspections, Division of Code Enfarcement, wi11 begin a su6stantial abatement process to
demolish and remove the building(s). The costs of this action, including administrarive costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will idenfify specific defects, necessary repairs and legal
requirements to cozrect this nuisance condition.
As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to al1 interested parties, all present ar subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for tivs property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard sha11
not be removed without the written autbority of the Depariment of Safely and Inspections,
Divlsion of Code Enforcement. The depariment is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time speclfied in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings befare the City Council at which time testimony wi11 be

heard from interested parties. After this hearing the City Council will adopt a resolution statin�
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance wiYh the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conective action
is not taken within the specified time, the City sball abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with 1aw.

10. Ordering the owner to remove or repair the building(s) at 60 Geor�e Street East within
fifteen {15) days from adopfion of resolufion.
The property owner of record, S. Michael Widzins appeared with his real estate agents and stated
that he intended to sell the property. Ben Rust, attorney with Peterson, Fram & Bergman, appeared
on behalf of Chase Mortgage Company.
Mr. Magner stated the building was a two and one-half story, wood frame, duplex with a detached
two-stall garage on a lot of 7,405 square feet and had been vacant since January 4, 2007. A code
compliance inspection had not been done, the vacant building registration fees were delinquent in
the amount of $375 and the $5,000 performance bond had not been posted. On November 20, 2007,
an inspection of the building was done and a list of deficiencies which constitute a nuisance
condition was developed. An order to abate a nuisance building was posted on December 28, 2007
with a compliance date of January 27, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Ta;cafion estimated the
market value of the land to be approximately $58,400 and the building to be $111,600. Real estate
taxes were current. Code Enforcement estimates the cost to repair the building to be more than
$80,000. The cost for demolition was estimated to be approximately $12,999 to $15,999. There
had also been three summary abatements issued to this property since 2006, two of which went to
work order: to secure the building and the City had to boazd the building to secure it from trespass,
remove improperly stored refuse, and cut tail grass and weeds. Code Enforcement recommends the
building be repaired or removed within 15 days. Mr. Magner presented photographs of the
property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was an
1899 Queen Anne style house. There had been a loss of integrity to the exterior of the building and
there was no architectural, historical significance to the building. She said that there were a lot of
properties on George Street that were listed as eligible or significant; the Riverview Library at 1
George Street and another property at 65 George Street. The remainder of the properties listed in
the 1983 survey of historical significance were located in the 200 and 300 block of George Street.
Mr. Widzins stated that he had owned the property for approximately 15 yeazs and it was his
intention to sell the property as is. He was requesting additional time to be able to sell the property.
Ms. Moermond asked whether a code compliance inspection had been done on the property. Mr.
Widzins responded that the building had not been inspected.
Mr. Rust stated that Mr. Widzins was current with his mortgage and the mortgage company was
concerned that if the building were demolished, they would lose the remainder of their financial
interest in the property.
The following must be received by the end of business on April 11: 1) the vacant building fees must
be paid; 2) the registration form must be filled out; 3) the code compliance inspection must be
completed; 4) the performance bond must be paid. If the following conditions were met, she would
recommend continuing the Legislative Hearing to May 13 for a new owner to present the following:
1) a signed purchase agreement; 2) closing docuxnents; 3) a work plan; and 4) financial
documentation. She recommended continuing the Council Public Hearing to May 21.

Mr. Magner stated that at the March 25 hearing, the property owner stated that he intended to sell
the property "as is" and that the matter was continued for the new owner to provide the purchase
agreement, closing documents, and to attend the hearing to present a work plan and financial
documentation.
Michael Widzins, properiy owner stated that the property had been up for sale; however, he did not
have a signed purchase agreement to date. He had also attempted to see if he could get the funding
to do the rehab himself.
Jason Burke, Edina Realty, stated that the property had been put on the market on April 14 and they
had 19 showings so far. The listing price was $79,900 and he had received a verbal offer that
morning for $35,00Q It was his understanding that there was $40,000 outstanding on the mortgage.
Mr. Rust stated that the loan was current and the bank's concern was that they would lose the money
if the building is demolished. Since this was an FHA loan, he would have to negotiate with T3L7D
on the purchase price if the $35,OQ0 were accepted as there would be a$5,000 gap on what was
currently owed on the loan. He requested an additiona160 days in order wark out the issues.
Ms. Moermond stated that the building had been vacant for over a year and the photos indicated that
the building was in pretty bad shape. She was not willing to grant a 60 day lay over and stated that
she would continue this matter to the June 10 Legislative Hearing.

Rafic Moore, purchaser of the property, appeazed.
Mr. Magier stated that there was a follow up Legislative Hearing on June 10 and Mr. Widzins
appeared with a purchase agreement which had not been executed. The hearing was continued to
today so that the new buyer could attend and present the signed purchase agreement, a work plan,
financial documentation, and the registered vacant building form needed to be executed.
Ms. Moermond stated that in reviewing the work plan, it seemed consistent with the City's
estimated cost to repair the building. Mr. Magner confirmed that it was.
Mr. Moore stated that they were scheduled to close on the property that afternoon. He stated that he
had an$80,000 line of credit approved with Landmark Bank which was in addition to the $40,000
for the purchase price of the home.
Ms. Moermond stated that she would need a letter from the Bank indicating that there was an
$80,000 line of credit or an escrow account for this project. She also requested Mr. Moore provide
a letter indicating that he was dedicating the $80,000 funds from this account for the project.
Mr. Magner stated that he also needed to have the registered vacant building form filled out. Mr.
Moore fiiled out the form and gave it to Mr. Magner.
Ms. Moermond stated that the following must be received by Friday, July 11: financial
documentation from the bank showing the line of credit to complete the rehab; and a letter from Mr.
Moore indicaring that he is willing to dedicate that amount of funding for this project. If this is
received, she will recommend to the City Council that they grant 180 days to complete the rehab.

Mike Widzins, property owner, appeared with Susan Schutter, Edina Realty.
Mr. Manger suminarized the reports he presented at the March 25 and May 13 Legislative Hearings.
Ms. Schutter stated that she was in received a Purchase Agreement in the amount of $40,000 from
Kurt and Rick Price on June 9, the previous day. Mr. Widzins, however, was not available to
execute the agreement. Mr. Price stated that he was aware that a work plan and financial
documentation needed to be presented; however, he could not attend the hearing and did not have
enough time to prepare the work plan far the hearing. She also had attempted to contact the
mortgage company to see if they would approve the sale since she believed Mr. Widzins owed
approximately $4Q000 on the loan and he did not have the money to pay off the loan himself nor
the estimated closing costs.
Ms. Moermond expressed extreme disappointment that this matter had been ongoing since the end
of March and now they walked in at the eleventh hour with a Purchase Agreement that had not been
properly executed. She stated that a hole in the gound was not worth much and they should have
worked mare quickly on the sale of the house, Ms. Moermond stated that she would need to receive
the following by June 17: 1) a signed purchase agreement; and 2) the closing must be scheduled
within 10 days of signing the purchase agreement. If this was completed, she would recommend to
the City Council that they continue this matter to the July 2 Council Public Hearing in order far the
new buyer to provide a wark plan and to demonstrate that they have financial ability to complete the
repairs which was estimated to be in excess of $80,000.
