This property is legally described as follows, 6 to wit: GRANPORT ADDTTION LOT 5 BLK 7 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Depariment of Safety and Inspections on or before Apri12, 2007, the following are the now known interested or responsible parties for the Subject Property: Ronald D Tabery, 3681 277 Ave NW, Isanti, MN 55040; Dawn Reinke, Add-Vantage Realty, 1028 Minnesota Street S, Shakopee, MN 55379; Highland District Council. WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated January 2, 2008; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WFTEREAS, this order informed the interested or responsible parties that they must repair or demolish the slructure located on the Subject Property by February 1, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WfIEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, March 25, 2008 to hear testimony and evidence, and aftez receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not dehimental to the public peace, ��S-L115 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the altemarive by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, April 16, 2008 and the tesrimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 1775 FIELD AVENUE. That the Subj ect Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollazs ($5,000.00). That there now exists and has existed multiple Housing or Building code violarions at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then la�own responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by Deparhnent of Safety and Inspections, Vacant/Nuisance Buildings. 8. According to our files, it has been a vacant building since April 26, 2007. The current property owner is Ronald D. Tabery, per AMANDA and Ramsey county property records. There have been three (3) SUMMARY ABATEMENT NOTICES since 2007. There has been one (1) WORK ORDER issued for: - Removal of improperly stored refuse On November 21, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. The exterior walls of the house and/or garage are defecrive. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. Lack of Water Service. Immediately restore water service. Failure to provide water service will result in these premises being declared Unfit for Human Habitation and ordered vacated for lack of this basic facility. 6. The windows andJor storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. 7. The window and/or door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the door(s). 9. There are unfinished walls and ceiling in the bathroom. Under permit, complete the repairs to the bathroom walls and ceilings. 10. There is a sag in the roof on the north side of the house. Have roof framing inspected and make all necessary repairs to the roof framing. 11. There is extension cord wiring in the kitchen. Upgrade the electrical wiring in the kitchen to meet cwrent NEC code requirements and eliminate a11 exfension cord wiring. 12. The kitchen floor covering is missing. The sanitary sewer is damaged. i3nder permit, repair the sanitary sewer from the house to the City sewer system. 14. The structure is a registered vacant building and must have a Code Compliance Certificate before the structure may be occupied. Immediately vacate the structure or obtain a Code Compliance Certificate from L.I.E.P. You may contact Jnn Seeger at L.I.E.P. for code compliance inspection, peimits, and issuance of Code Compliance Certificate. Under Chapter 33.03 of the Saint Paul L,egislative Code, failure to obtain a Code Compliance Certificate or to vacate the structure may result in issuance of criminal smmnonses. As owner, agent or responsible pariy, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by February i, 2008 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substanrial abatement process to demolish and remove the building(s). The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time tesrimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolufion calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. Ordering the owner to remove or repair the building(s) at 1775 Field Avenue within frfteen (15) days from adoption of resolution. The property owner of record, Ronald Tabery, did not appear. Christina Weber, attomey with Wilford & Geske, appeared and stated that the property went through foreclosure and the redemption period had expired. Cenlar FSB owned the property and since this was a torrens property, they were doing a proceeding subsequent which was required with tonens property. There was a deed that was now waiting to be transfened to Fannie Mae. Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling with a detached fwo-stail garage on a lot of 4,792 square feet and had been vacant since Apri126, 2007. A code compiiance inspection had been done on January 3, 2008 and the vacant building registration fees were current. The $5,000 performance bond had not been posted. On November 21, 2007 an inspection of the building was done and a list of deficiencies which consritute a nuisance condirion was developed. An order to abate a nuisance building was posted on January 2, 2008 with a compliance date of February l, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $53,500 and the buiiding to be $42,400. Real estate tases were current. Code Enforcement estimates the cost to repair the building to be approximately $60,000 to $70,000. The cost for demolition was estimated to be approximately $8,2�0 to $11,240. There had also been fhree summary abatements issued to this proper[y since 2007, one of which went to work arder: remove improperly stored refuse. Code Enforcement recammends the buiiding be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was a 1915 bungalow with an enclosed porch. She also noted that it appeared that there was a contiguous row of houses on this block. Ms. Weber stated that Fannie Mae planned to rehab the property and actively market it at the same time so that hopefully, someone would purchase it and complete the rehab. Her client had indicated to her that they would post the bond by Apri18. She presented a broker's scope of repair/contractor bid from KRG Renovations. Ms. Moermond stated that she would also need a letter from Fannie Mae indicating that they were willing to invest up to $60,000 dedicated towards the rehab of this property. Mr. Magner stated that in reviewing the work plan, he had concern that the actual bids for the electrical, plumbing, and hearing were not included with the plan. Ms. Moermond stated that she would need a revised work plan wkrich included the actual bids from Yhe trade contractors in addition to a letter from Fannie Mae indicating that they were willing to dedicate up to $60,000 to fund the rehab ofthis property. She would recommend granting 180 days.
