1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a three story, wood frame, six unit structure with a rivo stall, wood frame,
4 detached garage located on property hereinafter refened to as the "Subject Property" and
5 commonly lrnown as 951-953 DESOTO STREET. This property is legally described as
6 follows, to wit:

WIIEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on ar before Apri12, 2007, the
following are the now known interested or responsible parties for the Subject Property: Ib

WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Cl�apter 45 of the Saint Paul Le�slative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated December 31, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WIIEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by January 30, 2008; and
WFIEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions o£ Chapter 45 of the Saint Paul Legisla6ve Code, of the time, date, place and
purpose of the public heazings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paui
City Council on Tuesday, March 25, 2008 to hear testimony aand evidence, and after receiving

testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by rehabilitating
this siructure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with a11 applicable codes and ordinances.
The rehabilitation or demolirion of the structure to be completed within ninety (90) days after
ttie date of the Council Hearing; and
WHEREAS, a hearing was held befare the Saint Paul City Council on Wednesday,
April 16, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefare
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 451-453 DESOTO STREET.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand doliars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the 5ubject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantlNuisance Buildings.
That the irnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

biighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Ozder to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
ninety (90) days after the date of the Council Hearing.
If the above corrective action is not completed within tlus period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolirion and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Department of Safety and Inspections has declared tkus buiiding(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then l�own responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on February 2, 2008. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this
property. It is the recommendation of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a three story, wood frame, six-unit structure with a detached two stall garage on a
lot of 6,534 squaze feet.
According to our files, it has been a vacant building since August 14, 2007.
The current property owner is IB Property Holdings, LLC c/o Bayview Loan Servicing, LLC,
per AMANDA and Ramsey county property records.
The city has had to board this building to secure it from trespass.
There have been two (2) SUMMARY ABATEMENT NOTICES since 2007.
There have been three (3) WORK ORDERS issued for:
- Removal of tall grass and weeds
- Boarding
On November 14, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDIIVG was posted on December 31, 2007 with a compliance date
of January 30, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees aze delinquent in the amount of $250.00.
Taxation has placed an estimated market value of $90,000 on the land and $219,000 on the
building.
As of March 24, 2008, a Code Compliance inspection has not been completed.
As of March 24, 2008, the $5,000.00 performance bond has not been posted.

Code Enforcement Officers estimate the cost to repair this structure is $80,000 to $100,000. The
estimated cost to Demolish is $19,295 to $24,295.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (I S) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On November 14, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the de�ciencies present at this time.
As �rst remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Buiiding (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a 6ve thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate oF
Compliance or a Certificate of Occupancy has been issued.

Exterior
l. GARAGES fuv� ACCESSORY STRUCTLTRES. A11 gazages and accessory
structures must be in sound condition and secure from unauthorized entry.
Repair or replace any missing doors, windows, or hardware for same.
2. The chimney is defective, deteriorated or in a state of disrepair. Replace all
missing or defective bricks, tuckpoint as needed to restore the chimney to a
professional state of maintenance and repair. Permit may be required.
3. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
4. The exterior walls and/or trim of the house has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint
to effect a sound condition in a professional manner.

6. There are missing or defective guardrails. Provide all stairways, porches,
decks or steps which are more than 30" high with guardrails and intermediate
rails with openings in the guardrail no more than four (4) inches apart and in
accordance with the State Building Code.
7. The stairs have massing or defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails which
are b ippable and installed 34" to 38" above the nose of the stair treads.
8. The roof is deteriorated, defective, ar in a state of disrepair. Repaix or repiace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
9. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
10. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the
door(s).
1 l. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair. Repair in
a professional manner.

12. The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the ed�es and fixtures.
13. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for all
entry doors to dwelling uzut(s).
14. Lack of Electricity. Immediately restore electrical service. Failure to provide
proper elech service will result in these premises being declared Unfit for
Human Habitation and ordered vacated for lack of this basic facility. Use of
candles, fuel operated lighting or extension cord wiring is not permitted while
the power is off.
15. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
16. Lack of Natural Gas Service. Immediately restore natural gas service. Failure
to provide natural gas service will result in these premises being declared
Unfit for Human Habitation and ordered vacated for lack of this basic facility.
17. G.�.C.I.: The bathroom is lacldng an electrical G.F.C.I. outiet. Permit May
Be Required.
18. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.
19. The intezior walls are defective. Repair all wall defecTs and finish in a
professional manner.
20. There is evidence of a rodent infestation. Tmtnediately exterminate and
eliminate all rodents from the entire building. Remove xodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
21. SANITATION: Immediately remove improperly stored or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materiats, household items, building materials, rubble, tires, etc., from yard.
The Saint Paul Legislative Code requires all exterior property areas to be
maintaaned in a clean and sanitary condition. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.
22. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectars in accordance with the attached
requirement, within 24 hours.

23. Lack of Water Service. Iznmediately restore water service. Failure to provide
water service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
24. The window andJor doar screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for ali openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
25. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
26. The structure is a registered vacant building and must have a Certificate of
Occupancy before the structure may be occupied. Immediately vacate the
structure or obtain a Certificate of Occupancy from the Pire Deparhnent,
Fire Prevention. You may contact Pat Fish for team inspection and issuance of
Certificate of Occupancy.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by January 30, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the buildina(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Repozt must be obtained from the
Building Inspection and Desigi Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection witl identify specific defects, necessazy repairs and legal
requirements to conect this nuisance condition.
As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all iiiterested parties, all present or subsequent renters and
any subsequent ownexs. If you sell, transfer, or convey in any mannex, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with tt�e names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removai by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If correcrive action is not taken within ti�e Yime specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Cotmcil at which time testimony will be

heazd from interested parties. Aftex this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul I,egislative Code and provide that if corrective action
is not taken witYiin the specified time, the City sha11 abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Ordering the owner to remove or repair the building(s) at 951-953 Desoto Street within
fifteen (15) days from adoption of resolution.
Kelly Hadac, attomey with Mumane Brandt, appeared on behalf of the mortgage company,
Bayview L,oan Servicing. Mazk Huisey, Remaac Results, stated that he was the realtor hired to
market the property for sale.
Mr. Ma�er stated the building was a three-story, wood frame, six-unit structure with a detached
two-stall gazage on a lot of 6,534 square feet and had been vacant since August 14, 2007. A code
compliance inspection had not been done, the vacant building registration fees were delinquent in
the amount of $250 and the $5,000 performance bond had not been posted. On November 14, 2007,
an inspection of the building was done and a list of deficiencies which constitute a nuisance
condition was developed. An order to abate a nuisance building was posted on December 31, 2007
with a compliance date of January 30, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County TaYation estimated the
market value of the land to be approximately $90,000 and the building to be $219,000. Real estate
talces were current. Code Enforcement estimates the cost to repair the building to be approximately
$80,000 to $100,000. The cost for demolition was estimated to be approximately $19,295 to
$24,295. There had also been two summary abatements issued to this property since 2007, three of
which went to work order: to secure the building and the City had to board the building to secure it
from trespass, an emergency boarding, and cut tall grass and weeds. Code Enforcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1882 and was a"srick" style building located in the Payne-Phalen neighborhood. From the
photographs, there was a major loss of integrity as the windows had been altered and the porch had
been removed. This also was a substantial struchue and had a lot of presence on this block;
however, the buildings on this block were not uniform in design. She stated that this property was
located two blocks from the Olaf Lee house which was considered to be a major site For potential,
eligible historic designation.
Mr. Halsey stated that this property had been on the market for approximately 60 days and he had
shown the property approximately six times. To date, there had been interest in the property;
however, he did not ha�e any signed purchase agreements. The listing price was currently
$199,900 and he had indicated to the Bank that they may want to consider lowering that price to
dispose of the property. He stated that he spoke to Pat Fish and she indicated to him that he would
need a certificate of occupancy team inspection since the building had six units. She told him that
the first team inspection date that was available was Apri124. He said that he had paid the vacant
building fee and filled out the vacant building registration form the previous day. His plan was to
get contractars into the building to obtain bids on the work that needs to be done so that he could
present those figures to the Bank.
Mr. Magner pointed out that this property had been a problem in the neighborhood for a long period
of time, particularly with behavioral issues. Ae would request that anyone purchasing the property
would need to bring forwazd a plan on how they were going to manage the property since this was a
high-density building. He noted that there was also a lot of concern from the neighborhood
regarding the problems with this property.

Ms. Moermond asked Mr. Halsey whether Remaac had any intention of doing the rehabilitataon
work to this property. Mr. Halsey responded that it was not and he was merely hired to sell the
property to someone who will rehab the building.
Ms. Moexmond asked Mr. Magner when the summary abatements had been issued. Mr. Magner
responded that they were issued begiiuung in August through October and since that time, no orders
had been issued so the property was being maintained.
Ms. Moermond asked how long they had been in possession of the property. Mr. Hadac responded
that the redemption period ended at the end of September, 2007 and they had been marketing the
property since that time. Ms. Moermond stated that perhaps staff could call DSI to have the team
inspection done prior to Apri124 since this property was scheduled for public hearing on April 16.
Ms. Moermond stated that the following must be received by the close of business on April 11: 1)
the bond must be posted; and 2) the property must be maintained. She would request the new buyer
to submit the following at the Apri129 Legislative Hearing: 1) a work plan to be done in accordance
with the code compliance inspection report; 2) financial documentarion demonstrating the ability to
complete the rehab; and 3) a management plan for how the property will to be managed.
Ms. Moermond stated that she will recommend to the City Council at the April 16 Public Hearing
that this matter be laid over to the Apri129 Legislative Hearing and May 7 Council Public Hearing.

Jeff Preimesberger appeared and stated that he recently purchased the property.
Ms. Moermond asked whether the bond had been posted. Mr. Preimesberger responded that the
bond had been posted.
Ms. Moermoend asked Mr. Magner whether he had reviewed the documentation. Mr. Magner
responded that he had reviewed the work plan which included time]ines far completing the work,
financial documentation, and he believed the financial documentation was in order.
Ms. Moermond asked Mr. Preimesberger if he had filled out the Registered Vacant Building form.
Mr. Preimesberger responded that he had not filled out the form. Ms. Sheffer provided him with the
form to fill out before he left the hearing.
Mr. Magner stated that his only concem was how the property was going to be managed and
suggested that he work with Ruth Ann Eide, FORCE, who could provide him with lease provisions
which he could incorporate into his lease agreement with his tenants.
Mr. Preimesberger stated that he had rehabbed several properties including one on Rice and Ivy,
two on Arcade, and had worked with the FORCE Unit concerning the two properties on Arcade.
He also pointed out that he was a member of SPARL. He had added provisions in his lease
agreements concerning crime free-multi housing. Concerning this properiy, he was going to work
with Section 8.
Ms. Moermond stated that she will recommend gxanting 90 days on the condition he provide a
management plan on how he was going to manage the property including a lease agreement with
provisions for crime free multi-housing.
