BE IT RESOLVED that, upon the petition of the CHS, Inc., as documented in Public Works
Technicai Services, V acation File Number 06-2008, the public right-of-way hereinafter
described, on attached map E�ibit A, is hereby vacated and discontinued as public property,
and subject to the herein stated objections, the easements within said public right-of-way are
hereby released.
This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1,
1981, of the Saint Paui Legislative Code as amended, and to the following conditions:
1. That the petitioners, their successars and assigns shall pay $1200.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That an easement shall be retained on behalf of the City of Saint Paul for the flood wall
described in Ramsey County document number 531687, recorded January 8, 1969. And
an easement for flood wall over that part of the above described property lying north of a
line described in Ramsey County document nuxnber 864699, and the northwesterly
extension thereof, to wit: A line drawn from a point on the � side of Block 29, 150 feet
south of the northeast corner of said B1ock 29, to a point on the west line of Block 16, 115
north of the southwest corner of Block 16, all in Dunwell & Spencer's Addition, said line
being a portion of the line known as J.B. Irvine's 1885 Levee Line.
3. That compliant fire access needs to be maintained for the property.
4. That the petitioner, their successors and assigns agree to indemnify, defend and save
hannless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any character brought as a result of injuries or damages received or sustained by any
" person, persons or property on account of this vacation, or the petitioners' use of this
property, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accardance with the taw, whether by the
petitioners or any of their agents or employees.
5. That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolution, file with Public Works, City Real Estate, an acceptance in writing of the
conditions of this resolution and shall, within ihe period specified in the terms and
conditions of this resolution, comply in all respects with these terms and conditions.

I. CHS Inc., a Minnesota corporation, ("CHS") is the owner of the ptoperty legally described on
Exhibit A attached hereto (the "CHS Property").
CHS hereby peritions the Council of the City of Saint Paul to vacate its interest in the property
legally described on E�ibit C attached hereto (the "Subject Property") and depicted on the
drawing attached hereto as E�ibit D, as owner of the CHS Property which abuts the Subject
Property.
II. The City of Saint Paul, a Minnesota Municipal Corporation, ("City") has an interest in the
property legally described on E�ibit B attached hereto (the "City Property").
City consents to this Petirion as the owner of an interest in the City Property which abuts the
Subject Property.
III. CHS requests the vacation of the Subject Property for the following reason:
A. The Subject Property has not been used and maintained by the City of Saint Paul as a public
street for many yeazs. The Subject Property provides access to no properties other than the CHS
Properiy and is no longer necessary. For the aforementioned reasons we request that the City of
Saint Paul vacate the Subject Property.
B. CHS is the owner of a tank which encroaches upon the right of way o£the Subject Property.
CHS is requesting this vacation to resolve the title issue of the encroaching tank.
IV. The CHS Property has already been developed and no future construction is planned as of
the date hezeof.

Attached is a proposal to vacate a small portion of Wyandotte Street
(formerly E Street). The street is used only by the petitioner and has
previously been vacated north of the proposed area. No construction is
planned in the vacated area.
CINU and Reference Map are all most of you will need. Legal descriptions &
Surveyor's Map are attached for City Surveyor and Public Works.

This petitian is Yo vacate platted right-of-way between Alabama Street and the
Mississippi Itiver on a portion of Wyandotte St.
The purpose of this vacation is to give the petitioner private access to storage tanks
now encroaching in public right-of-way.
This property is located in City Council Ward 2, Planning District 3.
