WHEREAS, Saint Paul's United Church of Cluist, the properry owner of 880 Sutnmit Avenue and
900 Suinmit Avenue in Saint Paul, desires driveway access over and across an azea of city-owned park
land lrnown as Summit Avenue, shown on the attached map (Attachment "A"), a copy of which is on file in
the Department of Public Works, Technical Services-Real Estate Office, in the file number Ol-PKLDVRS-
2008; and

WfIEREAS, the City of Saint Paul, Aivision of Pazks and Recreation ("Parks") has given
permission to the said property owner to construct and maintain sidewalk and driveway access over and
across said city-owned park land, as stated in the Saint Paul Pazks and Recreation Commission's
Resolution Numbered 08-Q8, adopted March 12, 2008, a copy of which is attached hereto; and
WHEREAS, said property owner must enter into an agreement with the City of Saint Paul for the
construction and continued use of and access to Summit Avenue, and pay just compensation to Parks as
determined by an independent appraisal pursuant to Section 13.011 of the Saint Paul City Charter; now,
therefore be it
RESOLVED, that the proper City officials are hereby authorized and directed to enter into an
agreement with the property owner of 800 Siunmit Avenue and 900 Suinniit Avenue for access to Stuuinit
Avenue; and be it further
RESOLVED, that just compensation for said access be paid by ttie property owner and deposited
into the Parkland Replacement Fund and held in reserve far future purchase of park properky as required in
Chapter 13.01.1 of the City Charter, and that any other costs incurred by the City of Saint Paul to complete
any agreement, shall be fully compensated by the property owner.

Saint Paul's United Church of Christ is in the process of separating its church property from its adjacent former pazsonage. The
parsonage would then be sold as a residenrial property to a private parry. Curzent access to the garage belrind the house is from the
church pazking lot, which will no longer be available after the property is.subdivided. Therefore, new driveway access from Snmmit
Avenue is needed. '
Advantages If Approved:
The foi'mer parsonage will have driveway access. The City's Parkland Replacement Fund will receive compensation for the diversion
of ciry pazk land.

Snmmit Avenue will have a driveway across it that does not presentiy exist.

RESOLtiTION 08-08
WfIEREAS, the Saint Paul Parks and Recreation Commission is an appointed body
established to advise the Mayor and City Counci] on lon� range and city-wide matters related to
Pazks and Recreation; and
WHEREAS, Secrion 13.01.1 of the City Charter requires that the Commission review
any diversion or disposal of park property and present a recommendation to the Saint Paul City
Council; and
WHEREAS, the City of Saint Paul, Division of Parks and Recreation, owns city parkway
property, known as Summit Avenue, between the Mississippi River and Cathedral Hill; and
WAEREAS, Saint Paul's LSnited Church of Christ owns land adjacent to the pazkway at
8S0 Suimnit Avenue and 900 Summit Avenue and has requested the diversion of a 10-foat by
20-foot section of tlie abutttng pazkway for driveway access to 880 Sununit Avenue {as shown
on Attachment A); and
WHEREAS, the Division of Pazks and Recreation has determined tl�at the pazkway
property may be diverted for this purpose and recommends Commissian support for the request;
now, therefore
BE IT RESOLVED, that tl�e Saint Paul Pazks and Recreation Commission concurs with
the request to divert city park land alon� Summit Avenue throu�h a license to the property owner
at 880 Summit Avenue and 900 Summit Avenue, and in accordance with City Charter Section
13.01.1 recommends approval by the Saint Paul City Council.

I recommend that a Public Hearing before the City Council be held on April 16, 2008.
The purpose of this hearing is to consider the petition of Saint Paul's United Church of Christ to
divert city park land abutting 880 and 900 Summit Avenue for a private driveway access across
Summit Avenue, and to authorize city officials to enter into an agreement with the property
owner for conshuction and use of the driveway.
This property is located in City Council District 2, Planning District 16.
