O Connell City Clerk Building Dear Madam: This is in the matter of the appeal of L. A. Forrest�to change the required 33 foot building line set back to 161 feet, and to relax the 8 foot parking lot side yard set back to 4 feet on the east side and 2 feet on the north side of the lot on property located on the north side of Burns Avenue between Clermont and Earl Street. The property is described as the south one -half of the west 75 feet _of Lot 23, Block 30,, Suburban Hills Addition. This property was rezoned from "B" residence to "C" residence by the City Council on September 10, 1960. The site is presently vacant, and the applicant proposes to develop it with a 21 story apartment building with off- street park- ing accessory thereto as required. A review of this proposal discloses that it would not be possible to develop this property as proposed under the required building line set back, and the off-street parking lbt requirements. Therefore, the applicant is appealing for the variances as indicated above. The property under consideration has a frontage of 75 feet along Burns Avenue and extends to a depth of 151.5 feet, resulting in a total area of approximately 11,363 square feet. East and adjoining are single - family residences which front on Burns Avenue; north and adjoining is vacant land which fronts on unimproved Suburban Street; south and across Burns Avenue are single - family residences fronting on Burns Avenue; west and adjoining are single - family residences which also front on Burns Avenue. The Board of Zoning considered the matter at their regular meeting on October 10, 1960 and recommend the granting of the appeal as outlined above. Sincerely, H. C. Forrest and Gertrude Forrest are the owners of: � (�L All of Lot twenty -four (24) except the West five (W. 5) feet of the South one -half (S.2) thereof, Block thirty (30), Suburban Hills, according to the recorded plat thereof on file and of re- cord in the office of the Register of Deeds in and for Ramsey County, which property is located on Burns Avenue between Mound Street and Earl Street in St. Paul. VV The property is presently vacant and unoccupied. Mr. and Mrs. Forrest desire to construct upon said property an 11 unit apartment building. This appeal is being made with regard to the various building set back lines. The building set back line on the front of the property is 33 feet, and a 16.5 foot set back line is prayed for in this appeal. The building set back line on the East side of the property, for at least the North 60 feet of said -lot, is 8 feet, and a 4 foot set back line is prayed for in this appeal. The building set back line on the rear of the property is 8_ feet, and a 2 foot building set back line is prayed for in this appeal. This appeal is being made under Section 62.09 of the ordinances of the City of St. Paul, in that this lot is not a regularly shaped lot in comparison with other lots in the block and in Suburban Hills Addition, and the typography of the land is such that this lot is lower than the surrounding property.
