in the City of Saint Paul, County of Ramsey, State of Minnesota,
to -wit:
The North 400 feet of the South 960 feet of the
East 280 feet of the Northwest 1/4 of Section 26,
Township 29, Range 22 (subject to Ruth Street);
heretofore allocated to said Board and remaining under its control
has not been nor shall be needed for any public purpose. -and in the
best interests of said'Board and said City should be sold pursuant
to Ordinance No. 6576,'as amended; hereby are made the subject of
approval and concurrence by this Council;
RESOLVED *FURTHER, that the requisite proceedings shall be
instituted, conducted and completed under and pursuant to said
Ordinance No. 6576, approved November 5, 1925, as amended, for
the sale and conveyance of said hereinabove described tract or
parcel of undeveloped and unimproved land by said City with the
approval of the Committee on Lands composed of the Mayor, the
Purchasing Agent and the President of said Board; that pursuant
to said Ordinance,' as amended, the same shall be first offered
for sale to the following named persons who were the owners of the
same at the time of such acquisition of the same by said City; that
asishown by the accompanying report thereon by said City's Valuation
Engineer, dated November 7, 1960, the hereinabove described tract or
parcel of undeveloped and unimproved land represents a fractional part of
a larger undeveloped and unimproved tract taken and condemned by the

presents 43 per cent; that the award of damages paid by said City
in said eminent domain proceeding on account of such acquisition
on the whole or larger tract was $40,000.00 and thus the proportionate
amount of said award allocable to said City's acquisition therein of
said fractional part is $17,200.00; that the reasonable market value
of said hereinabove described tract or parcel of land proposed to be
sold and conveyed by the City is $20,000.00,which is the minimum sale
price of the same hereunder payable to said City for such hereby author-
ized sale and conveyance of the same;
RESOLVED FURTHER, that the proper City officers hereby are
authorized, with the approval of said Committee on Lands endorsed
hereon in behalf of said City, to sell and convey the hereinabove
described tract or parcel of real property to the following named
persons in the following proportions, such persons'having been the
owners of the same in such proportions at the time of said City's
acquisition of.the same in and by said eminent domain proceeding:

To the Honorable Mayor and
Members of the Council
Gentlemen and Madam:
In accordance with your instructions I
have negotiated with the prior owners of a tract of land lo-
cated at the northwest corner of Case Avenue and Ruth Street,
which was condemned and taken by the City of St. Paul in July,
1957, as a site for the Lincoln Park Elementary School. The
tract as purchased was rectangular and described as follows:
Subject to Ruth Street and Case Avenue, the south
960 feet of the east 280 feet of the Northwest
of Section 26, Township 29, Range 22.
This tract, after excluding the portions used for streets
measures 930 feet along Ruth and 250 feet along Case Avenue
and contains 232,500 square feet, or 5.36 acres, for which
an award was made by the city in the amount of $40,000.
The attached resolution, Board File No.
3397, adopted by the Board of Education on September 20, 1960,
declares that the portion of the school site described as fol-
lows:
The north 400 feet of the south 960 feet of the east
280 feet of the Northwest J of Section 26, Township
29, Range 22 (subject to Ruth Street),
which constitutes the north 400 feet, or 43% of the land con-
demned and taken by the city in 1957, is not needed for any
public purpose and should be offered for sale and sold in ac-
cordance with the applicable provisions of Ordinance No. 6576 f
as amended.
Since this land was acquired by eminent
domain proceedings, the ordinance provides that it must first
be offered fdr- -"S:le to the prior owner from which the same was
taken by the city. The ordinance provides further that the
sale price shall not be a less proportion of the amount paid
for the whole tract than a proportion of the part to be sold
shall bear to the area of the whole tract originally acquired,
and further, no such land shall be sold or reconveyed for a

less amount than the fair market value as.appraised and reported by
the city's Valuation Engineer, or other competent appraiser appointed
in the premises.
The area to be sold contains 100,000 square
feet or 2.3 acres. Based on the formula in the ordinance the mini-
mum price for which the land could be reconveyed is 43% of $40,000,
the acquisition cost, or $17,200. However, in my opinion the fair
market value of the land to be sold is $20,000, which amount the
former owners are willing to pay. In addition, your attention is
directed to two conditions of the sale contained in Dr. Conners
letter dated September 21 and attached to this file.
I, therefore, recommend that the matter be
forwarded to the Committee on Lands and that the land be sold to
the following persons:

Audrey A. McNeely
William E. Frenzel
Peter W. Frenzel

We transmit herewith a certified copy of a resolution
adopted by the Board of Education at its regular meet-
ing on Tuesday, September 20, recommending that certain
properties now held in the name of the City and under
control of the Board of Education be sold through the
procedures provided.
Also included as a condition of the sale are the follow-
ing provisions recommended by the Board of Education
to be carried out by the new owner:
1 - Adequate embankment and /or retainer walls at the
adjoining boundaries of the school site shall be
provided for as is proper and necessary for safety
and land retention.
2 - All excess earth that shall result from new owner's
excavations shall be deposited and distributed in
the low areas of the school property.
