Dear Madam:
This is in the matter of the appeal of Fred A. Reiter to establish a five
foot building line set back on property located at the northwest corner
of Hazel Street and Fremont Avenue. The property is described as the south
60 feet of Lots I and 2, and the south 60 feet of the east 18.52 feet of
Lot 3, Block 6, Robert L. Ware's Eastern Heights Addition.
The property under consideration is presently vacant, and has a frontage of
150 feet on unimproved Fremont Avenue and 60 feet on improved Hazel Street.
The applicant proposes to construct a single - family residence which would
front on Hazel Street, and would have it's front yard on Hazel Street. The
applicant is appealing for the establishment of a five foot set back line
on Fremont Avenue. When originally platted, the lots in this block between
White Bear Avenue and Hazel Street ran continuously from Fremont Avenue to
Fifth Street -with a depth of 608.5 feet. Under the building code require-
ment, this would result in a building line set back of 120 feet. Because of
the present elevations of the Fremont Avenue right -of -way and the topography
of the adjoining properties, Fremont Avenue has not been improved, nor have
the adjoining properties to the west been developed. The other properties
in the block between Fremont Avenue and Fifth Street are developed fronting
on Hazel Street.
Field investigation discloses that the applicant's proposal would not create
a detrimentdl effect upon the adjoining properties to the west. However,
it would be advisable to limit the five foot set back from Fremont Avenue
to the east 70 feet of the applicant's property. If the applicant wants to
construct a garage on the west end of this lot at a later date, it would be
subject to further consideration at that "time.
In consideration of the above factors, the Board of Zoning recommends the
granting of the appeal to establish a five foot set back from Fremont Avenue
for the east 70 feet of the above described property.

following description:
Robert L. Ware's Eastern Heights Addition;
The S. 60 ft. of Lots 1 and 2, and the S.
60 eft. of the E. 18.52 ft. of Lot 3, Block 6.

This lot is located on the N4Y corner of and Fremont; the lot
size is 60 x 150.
I propose to build a single family dwelling, size 28 x 48 on this
location.
The purpose of this appeal is to request your Honorable Body to
Waive the limitations of Chapt., 64.03, Par. j of the Legislative
Zoning Code, so that I may be allowed to build the home.
