THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters,60 to 64
inclusive of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts, and Rezoning of certain
properties in the City of Saint Paul, as amended, be and the
same is hereby further amended so as to rezone the following
described property from "All Residence to Commercial District,
to- wit:::
The west 100 ft. lying north of the south
87.45 ft. of Lot 40, Cottage Homes,
according to the plat thereof on file and
of record in the office of the Register of
Deeds in and for Ramsey County, Minnesota,
being located at`,the• northwest corner of
Arundel St. and Maryland Ave.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.

Dear Madam:
ibis is in the matter of the petition of Sherman Burton to rezone from
"A" Residence to commercial property located adjacent to the northwest
corner of Arundel Street. and Maryland Avenue. The property is described
as the west 100 feet lying north of the south 87.45 feet of Lot 40,Cottage
Homes. The property has been zoned "A" residence since the adoption of
the Ordinance in 1922.
On September 7, 1960 the Commissioner of Finance reported the petition
sufficient with the owners of 8 of a possible 10 (80%) tracts of land
within the required 100 foot radius having signed the petition. On
September 2, 1960, the City Council reclassified the balance of Lot 40
from residential to,commercial use, and the petitioner proposes to in-
corporate the property under consideration with the property already re-
zoned in order to develop the site with a roller rink and shopping center.
The entire site is presently vacant. The property under consideration is
an irregularly shaped tract of land with a frontage along unimproved Orange
Avenue of approximately 30 feet, and extends to a depth of approximately
510 feet. The average width of this tract is 100 feet, resulting in an
area of approximately 49,200 square feet.
West and adjoining is vacant land; farther to the west is a single - family
residence and a trailer rental lot which fronts on Maryland Avenue; east
and adjoining is the tract earlier rezoned to a commercial district, farther
to the east is undeveloped land used for truck farming purposes; north and
across unimproved Orange Avenue is vacant land, farther to the north is the
Northern Pacific Railway and trackage; south across Maryland Avenue are
single - family residences fronting on Maryland Avenue; southeasterly across
the intersection of Maryland and Arundel Streets are new single - family
residences which front on Arundel Street.
The Board of Zoning considered this matter at their meeting of September 15,
1960, and it is their recommendation that, inasmuch as the adjoining:.p:roperty
is already zoned commercial, the property under consideration also be
reclassified to commercial to permit the applicant to achieve a more de-
sirable design for the proposed development.
