On Tuesday morning, September 27, your group has before you on the .final hearing
a petition for installation of a sidewalk on Davern Avenue, from Rome to Edgcumbe
Road.
Frankly, gentlemen the portion of the sidewalk that will be doing most of the
people most of the good most of the time is the sidewalk north of Montreal which
would commence at Rome. This one block which is on the west side of the street
Is the only block that is.not covered with a sidewalk going over as far as Highland
Parkway. That is in the north direction.
Please bear in mind this sidewalk would be used by the students of Highland Park
elementary School, Highland Park Junior High School and St. Gregory's Catholic
school. When the weather is dry, the children do walk on this boulevard area,
however, being that it on an extremely tough slope when it is wet, and when there
Is snow on the ground, it necessitates these children walking in the street.
In addition to that, the Highland Park Junior High School has a pickup bus service
which comes up from Fairview Avenue east on Bohland and then turns south on Davern,
so there is a very bad situation from a safety standpoint in the winter months,
that these heavy buses and children are both in the street at the same time.
We earnestly request your consideration so that at least one block of sidewalk
on the side of Davern from Rome to Montreal is installed yet this fall. The
cal inspection of this property I believe has been made by one of the de-
I� partments of the city to substantiate our request.
Your favorable action on this request for this one block of sidewalk will be
greatly appreciated by the parents of the school children of the above listed schools.

I read with interest the article in the St. Paul
Dispatch on September 13th regarding the installation of
sidewalks on Davern St. from Edgcumbe Road to Rome Ave.
I certainly disagree with the property owners who
oppose the project. I do not feel that Davern is more
like a country lane than a busy street, nor do I feel that
the boulevards provide good walking. Nor two sons attend
St. Gregory School and have complained to me how hard it
is to keep their footing when they walk on the boulevard
on Davera in the wintertime, and more than once I have had
occasion to walls there when the many footprints of the
children walking there have frozen in the slush turned to
ice, and I was forced to walk in the street because it was
extremely difficult to walk on the boulevard.. Also, when
I walked in the street I had to check back every so often
to see if a car was coming. Traffic may not be heavy on
Davern, but I certainly do not think of it as a country
lane. We had to have sidewalks installed on our street
for the benefit of the school children passing by, and I
certainly think they are just as necessary on Davern Ste
for the same reason.

discussion, namely Davern from Edgcumbe to Rome, I should
like to voice my opinion that I feel these sidewalks
should be installed.
This past week of rainy weather has not been conducive
to "good boulevard walking ". These pathways become mud after
continued use, and when winter comes nobody will shovel his.
lawn to make it possible for small children to avoid walking
in the street. At least this has been our experienve over the
past eight years.
I hope you will proceed with your plan to install side-
walks in this area.

P E T I T I O N
TO: THE MEMBERS OF THE COUNCIL OF THE CITY OF ST. PAUL
1. Preliminary Order 197140, approved May 17, 1960, proposes to construct new side-
walks on the east side of Davern Street from Edgecumbe Road to Rome Avenue and
on the west side of Davern from Edgecumbe road to Yorkshire Avenue.
2. According to our information there is not a single property owner or resident
living on Davern Street who wants these sidewalks. Neither are there petitions
or letters from property owners or residents in the area to support the propos-
al for these sidewalks. As far as we know, the proposal for sidewalks on
Davern Street from Edgecumbe Road to Montreal is supported by one, single com-
plaint in the form of a telephone call by a person who gave a last name only
without further identification by initials, address or telephone number and as
far as the residents on Davern are concerned the name given is not known to
anyone on the street. Furthermore, a search of the telephone directory fails
to reveal the listing of any such name anywhere in the Highland Park area. It
appears, therefore, that the proposal for sidewalks on Davern Street from
Edgecumbe Road to Montreal is supported, not by evidences of interested
property owners, but by a single telephoned complaint by an unknown person.
3. In contrast to the above the nine residents and property owners on Davern
Street who are affected by this proposal are unanimously opposed to the con-
struction of sidewalks on Davern Street from Edgecumbe Road to Montreal.
4. Most of these nine residents and property owners on Davern Street have lived
there for a number of years and all have had an opportunity to observe the
unshovelled walks on some of the streets where sidewalks have been constructed.
They have also had an opportunity to observe the large number of residents in
the area who regularly transport their children to school in the family car.
They have also had an opportunity to observe that many, if not most, of the
children who walk the boulevards in the area converge on Davern Street from
streets that have no sidewalks and were not intended for sidewalks.
5. Some of these nine residents and property owners on Davern Street have had
and still have children who walk on the boulevards on their way to and from
school and all of them, without exception, are opposed to the sidewalk proposal.
For these and other reasons, not to mention the normal expense of the
walks, but especially the additional expense of the driveways and retaining walls
that will be necessary, the undersigned oppose the construction of sidewalks on
Davern Street from Edgecumbe Road to Montreal and respectfully petition the Council
to vote against the adoption of Preliminary Order 197140.

The commissioner of Public Works, having had under consideration the
preliminary order of the Council, known as Council File No. 197144 ,
approved May 17th. , lg 60 , relative to constructing
new sidewalk on the east side of Davern St. from Edgeumbe Road to Rome Ave. and
on the west side of Davern S+. from Edgeumbe Road to Yorkshire Ave. and from
Montreal Ave. to Saunders Ave.
and having investigated the matters and things referred to therein, hereby
reports!
1. The estimated cost thereof is $0.52 per sq. ft. for mpno. cone. walk 4"
thick. Extra work(excay., fill cone. rem'd, root cutting, drive crossinus.etc.)
at extra cost.
2. A plan, profile or sketch of said improvement is hereto attached and
made a part hereof.

Dear Milt:
I understand the rehearing on the final order for sidewalks on Davern
Street includes walks from Edgcumbe to Montreal even though the notice of
October 28, -1960 may be defective in that regard because it specifies walks on
Davern from Montreal north only.
As you know, I am obliged to be in Detroit on Tuesday, November 15th
and hence will not be able to attend the hearing. Mrs. Farrell will be present,
however, and I am sure all or most of the other affected property owners will
also be present just as they were at the hearings on September 13th and Septem-
ber 27th.
A petition unanimously opposing sidewalks on Davern between Edgcumbe
and Montreal signed by the nine affected property owners is on file with the
City Clerk. Not a single property owner or resident on Davern wanted the side-
walks then and they do not want them now. They remain unanimously opposed.
At the time of the first hearing on September 13th we were able to
truthfully say:
1. There was only one complaint requesting walks on Davern between Edgcumbe and
Montreal and that was an anonymous telephoned complaint. At the conclusion
of the first hearing Mayor Vavoulis called for those favoring the walks be-
tween Edgcumbe and Montreal to appear but none did. He specifically asked
if there was anybody representing any PTA group but there was none. The only
other name that has occurred in various conversations since then is "Freeman."
Who he is or where he lives I do not know and neither do I know if he favors
walks between Edgcumbe and Montreal or north of Montreal or if he favors them
at all anywhere. There are three Freemans in the area - Ben and Earl on
Upper St. Dennis Road and Morris on Bohland. The latter would not be con-
cerned with our part of the street and those on Upper St. Dennis couldn't
reasonably ask us to put in walks unless they are prepared to put them in on
their own property on Upper St. Dennis Road. If there are others who favor
sidewalks between Edgcumbe and Montreal their names have not "come to light."
2. We emphasized that we are not concerned with the proposal to construct side-
walks on Davern from Montreal north to Rome and Saunders. Those of us living
on Davern south of Montreal are not affected by what is done north of Montreal
and for this reason we would consider it presumptuous on our part to interfere
or attempt to interfere.
3. Most of the streets in this area have no sidewalks including Fairview,
Edgcumbe Road and Upper and Lower St. Dennis Roads. Edgcumbe has much more

traffic than Davern and the traffic on Fairview is 10 times heavier than it is
on Davern according to the official count. It is hard for us to understand
why Davern should be singled out to have sidewalks when most of the other
streets in the area do not.
4. Davern is known as a light traffic street. The traffic surveys, both
pedestrian and vehicular, show that Davern has much less than normal traffic
for a residential street.
5. If there were no boulevards on Davern between Edgcumbe and Montreal and
pedestrians were obliged to walk in the street there might be reason for
complaint. But, the fact is that there are boulevards on both sides of
Davern between Edgcumbe and Montreal and they are used by pedestrians, es-
pecially the children. Thus they are not obliged to walk in the street,
summer or winter. They can. and do use the boulevards, as the well worn paths
show and without complaint from the residents.
6. Of the nine residents and property owners on Davern who oppose sidewalks be-
tween Montreal and Edgcumbe five have had or still have children who walk the
boulevards on their way to and from school and all of them, without exception,
are unanimously opposed to the sidewalk. If they thought their children were
in danger they would be the first to ask for them. Surely, they would not
oppose them.
I know you have taken the time and trouble to personally look at that
part of Davern affected by the order and I believe you will recognize that what
I have said is true concerning our area. If you lived on Davern as we do and
had an opportunity to observe the situation between Edgcumbe and Montreal day in
and day out, summer and winter, I am sure you would feel just as strongly about
this matter as we do.
I dislike exceedingly to burden you with such a long letter but the
above is the essence of what was said at the first hearing on September 13th
when you were obliged to be away and since I am going to be away on November 15th
I thought I should contribute my thoughts to those that will undoubtedly be ex-
pressed by my friends and neighbors if necessary.
