That the Commissioner of public�Works hereby is authorized to issue a permit to'said Phalen Center, Inc., a Minnesda corporation, , for `the 'construction of said public sewer, upon and subject to the- following provisions, terms and conditions: 1. That said permittee shall construct said sewer, entirely at :its own expense, under the supervision and to the satisfaction of the Commissioner of Public Works, and in accordance with the plans and specifications pre- pared by him. , _.f. 9 1 99049. Page 3 . fl & 2. That said permittee shall pay the cost of engineering and inspection of said work, and for the publication of this ordinance. 3. That the said permittee shall properly pro- tect all excavations made in the streets both day and night so as to avoid all damage or injury to persons or property; shall properly fill and tamp said streets to avoid settling, and shall restore said streets to their original condition. 4. That said permittee, after the inception of said work, shall prosecute same continuously with diligence, and fully complete said work to the satis- faction and approval of said Commissioner on or before August 15, 1961. 5. That paidipermitt °ee expressly agrees and undertakes to fully indemnify and hold harmless the City of Saint Paul, its agents, officers, and employees from any and all damages, claims, losses, judgments, suits, or expenses arising out of or occasioned by the performance of the work contem- plated by this permission and authority. 6. That said permittee shall not proceed to construct said sewer unless and until said permittee shall have fully complied; with the''provisions regard- ing insurance and indemnif-.cation contained in the City of Saint Paul Department of Public Works Specifi- cations for Str.eet and Sewer Construction dated April 1, 1959, Section numbered 1.44 and found on pages 1 -13 through 1 -17 of said Specifications applicable to con- tractors. For the purposes of this ordinance, the aforesaid section of said Specifications numbered 1.44 shall be read as though the word "permittee" were sub- stituted for the word "contractor" wherever the same appears in the aforesaid Section 1.,44. Said Section 1.44 of the Specifications for Street and Sewer Con- struction in the City of Saint Paul is hereby incor- porated herein by reference as fully and as completely as if set forth herein verbatim. Proof of compliance with the provisions of the aforesaid Section numbered 1.44 shall be in such form as the Corporation Counsel of the City of Saint Paul may direct, and the documents required by the aforesaid Section 1.44 shall, after submission to the Corporation Counsel, be filed in the office of the Comptroller of the City of Saint Paul. 7. That said permittee shall furnish a bond to the City of Saint Paul in the sum of Ten Thousand Dollars ($10,000) conditioned to comply with all the terms of this ordinance and to indemnify and save harmless said City from all liability, loss, judgments, suits, costs, charges, and expense, that may accrue to persons or property occasioned by the making of the improvement or arising out of same. B. That the said permittee shall, within ten days ,after the passage of this ordinance, file a written acceptance thereof with the City Clerk. 9.' SEWER SYSTEM I � The permanent easement that should be deeded to the Pity for pur- poses of maintaining the public sewer to be'built by ordinancd is a strip of land 30 feet in width that is adjacent and parallel to the north line of Magnolia Avenue beginning at a point that is 350 feet east ofithe east line of Prosperity Avenue and extends to 275 feet west of the west line of Barclay Street as measured along the north line of Magnolia Avenue. Please prepare the required ordinance as quickly as convenient as the Phalen Center Company agents have indicated a desire to construct said sewer as soon as the ordinance is passed. O'Connell City Clerk 386 City Hall and Court House St. Paul 2, Minnesota Dear Mrs. O'Connell: On October 11, 1960 an ordinance was passed giving permission to Phalen Center, Inc. to construct a public sewer at its own expense. According to the ordinance (No. 11842 C.F., 199049) Phalen Center, Inc. is required to file a bond, file a written acceptance of the ordinance, and deed an easement to the City of St. Paul. The original letter sent to the Department of Public Works requesting this permission was sent by Phalen Center Company, a -co- partnership. Somewhere between the sending of our letter and the passing of the ordinance an error was made in City Hall changing Phalen Center Company* to Phalen Center, Inc. Phalen Center Company accepts the terms of the ordinance and will furnish the necessary bond and deed the necessary easement, however, your attention is, called to these discrepancies.
