An ordinance authorizing KSTP Properties, Inc., 3415 University Avenue, a
corporation, to construct and maintain a steam pipe across Charles Avenue
approximately 90 feet west of Berry Street. This is an emergency ordinance
rendered necessary for the preservation of the public peace, health and safety.
The Council of the City of St. Paul does ordain:
SECTION 1
That permission and authority be and the same are hereby given to KSTP
Properties, Inc. to construct and maintain a steam pipe across Charles Avenue
approximately 90 feet west of Berry Street.
SECTION 2
The Commissioner of Public Wroks is hereby authorized to issue a permit
to the said licensee for the construction of said steam pipe across Charles
Avenue approximately 90 feet west of Berry Street, upon said licensee's
compliance with the following express conditions, viz:
(1) The said licensee shall construct said steam pipe entirely at its
own expense to the satisfaction and under the supervision of the Commissioner
of Public Works.
(2) The said licensee shall properly protect all excavations made in
the avenue; both by day and by night, so as to avoid all damage-or injury to
persons and property; shall properly fill and tamp said avenue to'avoid settling,
and shall restore said avenue to its original condition.
(3) The said licensee, after the inception of the work shall prosecute
same continuously, with diligence, and fully complete said work to the satis-
faction and approval of said Commissioner.
(4) The said licensee shall give a surety company bond to the City of
St. Paul in the penal sum of Five Thousand Dollars ($59000.00)9 conditioned
to comply with all the terms of this ordinance and to indemnify and save harmless
the City of St. Paul from any and all liability, judgments, suits, costs,
charges, damage or expense that may accrue to persons or property on account
of or arising from the construction, maintenance, operation, use, presence,
or removal of said steam pipe. The bond shall be in such form as may be
approved by the Corporation Counsel, shall have such surety as may be approved
by the Commissionerrof Finance, and be filed with the City Comptroller.
(5) The said licensee shall pay the cost of the publication of this
ordinance, and shall, within ten days from and after the passage of this
ordinance, file a written acceptance thereof with the City Clerk, in a form
to be approved by the Corporation Counsel. If such acceptance is not filed
within said time, the authority hereby given shall be void.
(6) Said steam pipe shall be removed by said licensee whenever the
Council shall so order.,
(7) Said permittee shall not proceed to construct said installation
unless and until said permittee shall have fully complied with the provisions
regarding insurance and indenmification contained in the City of St. Paul
Department of Public Works Specifications for Street and Sewer Construction
dated April 19 1959, Section numbered 1.44 and found on pages 1 -13 through
1 -17 of said Specifications applicable to contractors. For the purposes of

this ordinance, the aforesaid section of said Specifications numbered 1.44
shall be read as though the word "permittee" were substituted for the word
"contractor" wherever the same appears in the aforesaid Section 1.44. Said
Section 1.44 of the Specifications for Street and Sewer Construction in the
City of St. Paul is hereby incorporated herein by reference as fully and as
completely as if set forth herein verbatim. Proof of compliance with the
provisions of the aforesaid Section numbered 1.44 shall be in such form as the
Corporation Counsel of the City of St. Paul may direct, and the documents
required by the aforesaid Section 1.44 shall, after submission .
to the Corporation Counsel, be filed in the office of the Comptroller of the
City of St. Paul
SECTION
This ordinance is hereby declared to be an emergency ordinance rendered
necessary for the preservation of the public peace, health, and safety.
SECTION 4
This ordinance shall take effect and be in force from and after its
passage and publication.

provisions of Ordinance No. 11833 of the Council of
the City of St. Paul, approved October 7, 1960s and
agrees to be bound by all of the terms and conditions
thereof.
