1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two, two story, wood frame, single family dwellings with a detached guage
4 located on property hereinafter referred to as the "Subject Property" and commonly known as
5 667 & 669 WELLS STREET. This properiy is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recarder's Office and
information obtained by Department of Safety and Tnspections on or before Apri12, 2007, the
following are the now known interested or responsible parties for the Subject Property:
Citifinancial Services Inc, Associates Financial Services, 111 Northpoint Drive, #100, Coppell,
TX 75019; Peterson, Fram, and Bergman, PA, SQ E. 5�' Street, Suite #30Q, St. Paul, MN 55101,
Mark Wiebusch, 2100 Ford Pkwy, #201, St. Paul, MN 55116; District 5 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated December 13, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by January 12, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subj ect Property
declaring this building(s) to consdtute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings befare the Legislarive
Hearing Officer of the City Council and the Saint Paul Caty Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislarive Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, March 11 and March 25, 2008 to hear testimony and evidence, and
after receiving testimony and evidence, made the recommendation to approve the request to

order the interested or responsible parties to make the Subject Property safe and not detrimental
to the public peace, health, safety and welfaze and remove its blighting influence on the
community by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The demolition of the shucture to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
April 2, 2008 and the testimony and evidence including the acrion taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subj ect Property at 667 & 669 WELLS STREET.
1. That the Subject Property comprises a nuisance condirion as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Deparhnent of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structures in
accordance with all applicable codes and ordinances. The demolition and removal of the
shuctures must be completed within fifteen (15) days a8er the date of the Council
Hearing.
If the above corrective action is not completed within this period of tune Deparhnent of
Safety and Inspecrions is hereby authorized to take whatever steps are necessary to
demolish and remove this shucture, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the buildings aze to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

There were two side-by-side buildings on this parcel. Each was a rivo-story, wood frame, single-family
dwelling on a lot of 4,792 square feet.
According to our files, they have been vacant buildings since August 10, 2007.
The current property owner is Citifinancial Services, Inc., per AMANDA and Ramsey county property
records.
The city has had to board this building to secure it from trespass.
There have been four (4) Si.7MMARY ABATEMENT NOTICES since 2007.
There have been eight (8) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of snow and ice
- Emergency boarding of property
On November 7, 2007, an inspection of the building was conducted, a list of deficiencies which constitute
a nuisance condirion was developed and photographs were taken. An ORDER TO ABATE A
NUISANCE BiTILDING was posted on December 13, 2007 with a compliance date of January 12, 2008.
As of this date this property remains in a condition which comprises a nuisance as defined by the
legislative code.
The Vacant Building registration fees are delinquent in the amount of $250.00.
Ta;cation has placed an estimated market value of $40,000 on the land and $210,000 on the building.
As of October 23, 2007, a Code Compliance inspection has been completed.
As of March 10, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes for the year 2007 are delinquent in the amount of $1,36734 plus penalty and interest.
Code Enforcement Officers estimates the cost to repair these siructure to be $40,000 to $50,000 for each
building.. The estimated cost to Demolish is $12,200 to $16,200.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property owner
to repair ar remove this structure within fifteen (15) days, if not the resolution authorizes the Division of
Code Enforcement to demolish and assess the costs to the property.

The VacantJNuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
667 & 669 WELLS ST
and legally described as follows, to wit:

ADDITION TO ST. PAUL LOT 23 BLK 34
to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolirion under authority of Chapter 45.11.
On November 7, 2007, a Building Deficiency Inspecrion Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shail not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

This is two, two story, wood frame, single family dwellings with a detached garage.
1. The exterior walls and/or him of the house and/or garage has defecrive,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
2. The exterior walls of the house and/or garage are defecrive. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
3. The windows and/or storm windows aze in a state of disrepair. Replace al]
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
4. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
5. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
6. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-right and
rodent-proof condirion. Permit may be required.
7. Fi7RNACE: Have a licensed heating contractor service and clean the fiuxiace
or boiler and make any necessary repairs. Perform a C10 test on'the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
8. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, right and water impervious condition. Permit
may be required.
9. The structure is a registered vacant building and must have a Code
Compliance Certificate before the structure may be occupied. Note: Code
Compliance inspection completed on October 23, 2007 (under 667 Wells).
BUILAING
1. Tnsure basement cellar floor is level, is cieanable, and all holes are filled.
2. Tnstall hand and guardrails on all stairways and steps as per attachment.
3. Tuck Point interiorlexterior foundarion.
4. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.

etc. as necessary.
Provide complete storms and screens, and repair all door and window openings.
Repair walls and ceilings throughout, as necessary.
Re-level porch as much as is practical.
Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulafion, glass, weather shipping, etc.) shall meet new energy code standazds.
Prepaze and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).
Any framing members that do not meet code (where wall and ceiling covering is
removed, members that aze over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) are to be reconstructed as per
code.
Habitable rooms with new usage, replaced windows shall have glass area equal to
8% of floor area, ar a minimuxn of 8 sq. ft., one-half of which shall operate and a11
bedroom windows shall meet emergency egress requirements (20" wide minimum,
24" high minnnum but not less than 5.7 sq. ft. overall).
Provide general clean-up of premise.
Provide smoke detectors as per the Minnesota State Building Code.
Repair soffit, fascia trim, etc. as necessary.
Provide proper drainage around house to direct water away from foundation.
Install downspouts and a complete gutter system.
Provide general rehabilitation of gazage.
Repair front retaining wall.
Replace porch floor joist, flooring, and insure foundation to code.
Replace porch roof and framing as needed.
Replace all damaged siding and trim.
Replace overhead gazage door.
Reframe garage roof to code.
Install vapor barrier in crawl space.
BUILDING

3. Strap or support top of stair stringers.
4. Tuck Point interlor/exterior foundation.
5. Install tempered glass in window on stair landing to Code.

etc. as necessary.
8. Provide complete storms and screens, and repair a11 door and window openings.

water service.
2. Bond around water meter with a copper wire sized far the electrical service per Article
250 of the NEC.
3. Provide a complete circuit directory at service panel.
4. Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen appliance
circuit.
5. Verify that fuse or circuit breaker amperage matches wire size.
6. Close open knockouts in service panel or junction boxes with knockout seals.
7. Properiy strap cables and conduits in basement or service conduit on the exterior of the house.
8. Remove and/or rewire all illegal, improper or hazardous wiring in basemenUgarage.
9. Remove or rewire electric baseboard heater in second floor kitchen in 667 Wells.
All electrical work must be done by a licensed electrical contractor under an electrical pernut.
Any open walls, or walls that are opened as part of this project, must be wired to the standards of the
2005 NEC.
PLUMBING
All plumbing work requires permit(s) and must be done by a plumbing contractor licensed in
Saint Paul.

If the resolurion calls for abatement action the Council may either order the City to talce the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislafive Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this

15. Ordering the owner to remove or repair the building(s) at 667 & 669 Wells Street within
fifteen (15) days from adoption of resolution.
The property owner of record, Cirifinancial Services, Inc. did not appear. No other parties of
interest appeazed.
Mr. Magner stated there were two side-by-side buildings on this pazcel. Each was a two-story,
wood frame, single-family dwelling on a lot of 4,792 squaze feet and had been vacant since August
10, 2007. A code compliance inspection had been done for both buildings on October 23, 2007.
The vacant building registrarion fees were delinquent in the amount of $250 and the $5,000
performance bond had not been posted. On November 7, 2007, an inspection of the building was
done and a list of deficiencies which constitute a nuisance condition was developed. An order to
abate a nuisance building was posted on December 13, 2007 with a compliance date of January 12,
2008. To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Taxation estimated the market value of the land to be
approximately $40,000 and the buildings to be $210,000. Real estate tases for 2007 were
delinquent in the amount of $1,367.34, plus penalty and interest. Code Enforcement estimates the
cost to repair the building to be approximately $40,000 to $50,000 for each building. The cost for
demolition was estimated to be approximately $12,200 to $16,200 for both buildings. There had
also been four summary abatements issued to this property since 2007, eight of which went to work
order: to secure the building and the City had to board the building to secure it from trespass,
remove improperly stored refuse, remove snow and ice, and an emergency boarding. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the properties.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that both of these buildings
did not have permit informarion available as they were constructed prior to 1885. They estimated
them to likely be built in 1880 and were unique since they were two single-family homes built on
one lot; they had a common retaining wall, and shared stairs and walkway from the sidewalk up to
the house. The integrity of these buildings was considered fair as there had been some alterations to
them. One of the buildings did have an open porch while the other had a closed porch. She stated
that they weren't surveyed as part of the Payne Avenue potential historic district; however, they are
just outside of the national register eligible Payne Avenue district. Staff would encourage the
buildings be rehabilitated.

Ms. Moermond recommended the buildings be removed within 15 days with no option for repair.
