1 VVF�artment of Safety and Inspections has requested the Ciry Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking

4 located on property hereinafter referred to as the "Subject Property" and commonly lmown as
5 152 HING STREET WEST. This properiy is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before April 2, 2007, the
following are the now known interested or responsible parties far the Subject Property:

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated December 13, 2007; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair
or demolish the shucture located on the Subject Property by January 12, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, March 11, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or resporisible parties to make the Subject Property safe and not detrimental to the public peace,

this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accardance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fdteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held befare the Saint Paul City Council on Wednesday,
Apri12, 2008 and the testunony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced pubiic hearings, the Saint Paul City Councii hereby adopts the following Findings and
Order concerning the Subject Property at 152 HING STREET WEST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Depariment of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacanUNuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting ali
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in

accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demoIition and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
If the above corrective action is not completed within this period of rime Department of
Safety and Inspecrions is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
102 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
103 parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Department of Safety and Inspections has declared this building(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then lrnown responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on January 14, 2008. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this
property. It is the recommendation of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a two story, wood frame, duplex with a detached one-stall garage, on a lot of 7,405
square feet.
According to our files, it has been a vacant building since Apri127, 2007.
The current property owner is Deutsche Bank Trust c/o AMC Mortgage Services, per AMANDA and
Ramsey county property records.
The city has had to board this building to secure it from trespass.
There have been three (3) SLJMMARY ABATEMENT NOTICES since 2007.
There haue been two (2) WORK ORDERS issued for:
- Emergency boarding up of property
On November 15, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE
A NUISANCE BUILDING was posted on December 13, 2007 with a compliance date of January 12,
2008. As of this date this property remains in a condition which comprises a nuisance as defined by the
legislative code.
The Vacant Building registration fees are paid.
Tasation has placed an estimated market value of $58,400 on the land and $163,500 on the building.
As of November 15, 2007, a Code Compliance inspection has been completed.
As of March 10, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes for the year 2007 are delinquent in the amount of $1,286.17 plus penalty and interest.
Code Enforcement Officers estimate the cost to repair this shucture is $65,000 to $75,000. The
estimated cost to Demolish is $8,360 to $11,360.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes the
Division of Code Enforcement to demolish and assess the costs to the property.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

45.02, and subject to demolition under authority of Chapter 45.11.
On November 15, 2007, a Building Deficiency Tnspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Cpde Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That ins�section will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a category tluee registered vacant building that has a code compliance report
pending. Please see attached report for the list of deficiencies.

Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
Provide complete storms and screens, and repair all door and window openings.
Repair walls and ceilings throughout, as necessary.
Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
Prepare and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).
All charred members will have to be scraped or sandblasted completely clean and
any water warped members replaced. A determination as to necessary corrective
measures will have to be made by this department or a registered structural engineer
as to replacement, repairs, etc. All smoked or charred members are to be sealed and
deodorized.
Provide general clean-up of premise.
Provide smoke detectors as per the Minnesota State Building Code.
Repair soffit, fascia trim, etc. as necessary.
Provide proper drainage around house to direct water away from foundation.
Install new downspouts and a complete gutter system.

All plumbing work requires permit(s) and must be done by a plumbing contractor Iicensed in
Saint Paul.

Boiler release valves to be piped in an upright position.
Ventilation hoods over ranges to be installed according to code.
Appropriate Mechanical, Wann Air and Ventilation Permits are required for this
work.
This property was inspection as a duplex.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by January 12, 2008 the Department of Safety and
Inspections, Division of Code Enfarcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance withlaw.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite �200, Commerce Building
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.

As an owner or responsible party, you are required by law to provide full and complete
disclosure oF this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Depariment of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy o£this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enfarcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings hefore the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs oFthis
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

11. Ordering the owner to remove or repair the building(s) at 152 King Street West within
fifteen (15) days from adoprion of resolurion.
Ryan Krumiie, attorney with Shapiro, Nordmeyer & Zielke, appeazed on behalf of Deutscbe Bank
National Trust and Citi Residential Lending, the mortgage company.
Mr. Magner stated the building was a rivo-story, wood frame, duplex with a detached one-stall
garage on a lot of 7,405 square feet and had been vacant since April 27, 2007. A code compliance
inspection had been done on November 15, 2007 and the vacant building registration fees were
ciurent. The $5,000 performance bond had not been posted. On November 15, 2007, an inspecrion
of the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on December 13, 2007 with a
compliance date of January 12, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taacarion esrimated the
market value of the land to be approximately $58,400 and the building to be $163,500. Real estate
tases for 2007 were delinquent in the amount of $1,286.17, plus penalty and interest. Code
Enforcement estimates the cost to repair the building to be approximately $65,000 to $75,000. The
cost for demolition was estimated to be approximately $8,360 to $11,360. There had also been
three suimnary abatements issued to this property since 2007, rivo of which went to work order: to
secure the building and the City had to board the building to secure it from trespass. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1930 as an American four square and the original owner was listed as OJ Brach. Originally, this
house was on a double lot and a similu house was built next door with a shared garage. The block
had houses that were considered mid-century infill buildings; however, most of the houses were
considered revival style.
Ms. Moermond stated that the order to abate indicated that there had been a fire. She asked how
they became aware this was a vacant building. Mr. Magner stated that the code compliance
inspection indicates that there had been a fire•, however, he did not have any record of the fire in his
file. He stated that their office received a call that the building was found to be open and vacant.
Mr. Krmniie stated that the sheriff sale for this property had occurred in April, 2007 and the
redemption period ended in November. The property was currently being marketed for sale since
early December and his client had indicated to him that they were not anterested in making the
repairs themselves. If they are unable to sell the property, his client would proceed with
demolishing the building themselves.
Mr. Moermond asked Mr. Magner about the sun�inary abatements that had gone to work order on
this property. Mr. Magner responded that the wark orders were for emergency boardings and it
appeared that the exterior of the property was being maintained.
Gerald and Mary Ann Firxner, 146 King Street West, appeared. Mr. Firmer stated that their house
was located right next to this property. It was his information that a property management company
was mowing the lawn and neighbars had been shoveling the walk after it snowed. They had
concerns with loose roofing flying onto their property which could potentially break a window ar do

exterior damage to their house. Ms. Firmer stated that the exterior was in complete disrepair and
was a terrible eyesore and detriment to the neighborhood.
Ms. Moermond stated she would require the following be submitted by the end of business on
Mazch 28: 1) a signed purchase agreement; and 2) the real estate tases must be paid. If this is
completed, she would consider granting additional time. If not, she will recommend removing the
building within 15 days with no option for repair.
