1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecl�ng

WHEREA5, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before Apri12, 2007, the
following are the now known interested ar responsible parties for the Subject Property: Shawn
Green, 328 Harrison Ave, Upper Unit, St. Paul, MN 55102; Shawn Green, 695 Blair Ave, Apt
#1, St. Paul, MN 55104; Central Mortgage Company, 801 John Barrow, Suite #1, Little Rock,
AR 72205; Ameriquest Mortgage Company, 1100 Town & Country Road, Suite #200, Orange,
CA 92868; Sununit-University Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legisiative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated November 27, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the sh located on the Subject Property by December 27, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties haue been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time, date, place and
purpose of the public hearings; and
WIIEREAS, a hearing was held before the Lea slative Hearing Officer of the Saint Paul
City Council on Tuesday, March 11, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

41 or responsible parties to make the Subject Property safe and not detrimental to the public peace,
42 health, safety and welfare and remove its blighting influence on the community by demolishing

WHEREAS, a hearing was heid before the Saint Paul City Council on Wednesday,
April 2, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 772 FULLER AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paui
Lea slative Code, Chapter 45.
That the costs of demolation and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That tlus building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within Tifteen (1� days after the date of the Council
Hearing.
If the above corrective action is not completed within this period of time Department of
Safety and Inspecrions is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Properly pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy o�this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Deparhnent of Safety and Inspections has declared this building(s) to constitute a'huisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies ar by razing and removing this building(s).
The property was re-inspected on January 8, 2008. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this
property. It is the recommendation of the Deparhnent of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and £ailing that, authorize the Deparhnent of Safety and
Inspections Yo proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a one and one-half story, wood frame, single-family dwelling on a lot of 4,356 square
feet.
According to our files, it has been a vacant building since August 10, 2006.
The current property owner is Shawn Green, per AMANDA and Ramsey county property records.
The city has had to board this building to secure it from trespass.
There have been fourteen (14) SUMMARY ABATEMENT NOTICES since 2006.
There have been fourteen (14) WORK ORDERS issued far:
- Removal of improperly stored refuse and debris
- Removal of tall grass and weeds
- Removal of snow and ice
On November 6, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE
A NUISANCE BIJILDING was posted on November 27, 2007 with a compliance date of December
27, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by
the legislative code.
The Vacant Building registration fees are paid.
Taxarion has placed an estimated market value of $45,600 on the land and $95,600 on the building.
As of Mazch 10, 20�8, a Code Compliance inspection has not been completed.
As of January 16, 2008, the $5,000.00 performance bond has been posted.

Dear Sir or Madam:
The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and Inspections, Division
of Code Enforcement, hereby declares the premises located at:
772 FULLER AVE
and legally described as follows, to wit:
BUTTERFIELD SYNDICATE ADDITION NO. 1 LOT 10 BLK 8
to comprise a nuisance condition in violation of the Saint Paul Legislafive Code, Chapter 45.02, and
subject to demolition under authority of Chapter 45.11.
On November 06, 2007, a Building Deficiency Inspecrion Report was compiled and the following conditions
were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As first
remedial acfion, a Code Compliance Inspection must be obtained from the Building Inspection
and Design Section, 8 Fourth Street East, Suite 200, Commerce Building (651)266-9090. That
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition. You may also be required to post a five thousand dollar ($5,000.00)
performance bond with the Building Inspecfion and Design Office before any Qermits are
issued, except for a demolition permit

This building(s) is subject to the restricrions of Saint Paul Ordinance Chapter 33.03 and shall not
again be used for occupancy until such time as a Certificate of Compliance or a Certificate of
Occupancy has been issued.
This is a one and one-half story wood frame dwelling.
1. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is
impervious to water and easily cleanable throughout the bathroom and seal uound the edges
and fixtures.
2. The cliimney is defective, deteriorated or in a state of disrepair. Replace all missing or
defective bricks, tuckpoint as needed to restore the chimuey to a professional state of
maintenance and repair. Pernut may be required.
3. Lack of Electricity. Immediately restore electrical service. Failure to provide proper
electrical service will result in these premises being declared Unfit for Human Habitation and
ordered vacated for lack of this basic facility. Use of candles, fuel operated lighting or
extension cord wiring is not permitted while the power is off.
4. FLJILNACE: Have a licensed heating contractor service and clean the fixrnace or boiler and
make any necessary repairs. Perform a C/O test on the heating plant. Then, send the attached
form back to the Inspector. Repair of gas fired appliances requires a permit.
Lack of Natural Gas Service. Immediately restore natural gas service. Failure to provide
natural gas service will result in these premises being declared Unfit for Human Habitation
and ordered vacated far lack of this basic facility.
6. The stairs have missing or defective handrails. Provide all interior and exterior stairways and
steps of more that three (3) risers with handrails which are grippable and installed 34" to 38"
above the nose of the stair treads.
7. The interior ceilings aze defective. Repair all ceiling defects and finish in a professional
manner.
8. The interior wails are defective. Repair all wall defects and finish in a professional manner.
9. There is evidence of a rodent infestation. Immediately exterminate and eliminate all rodents
from the entire building. Remove rodent harborages in the yard areas. Tuckpoint the
foundarion if necessazy to rodent-proof the building to prevent re-infestation. Immediately
remove any dead rodents from the premises.
10. Smoke Detector: Lack of properly installed and operable smoke detector. Provide functioning
smoke detectors in accordance with the attached requirement, within 24 hours.

11. The window and/or door screens aze missing, defecrive or in a state of disrepair. Provide
proper window and door screens for all openable windows and doors. Screens must be
tight-fitting and securely fastened to the frames.
12. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken
window glass. Make all necessary repairs to frames, sashes, hardware and associated trun in a
professional manner. Permit may be required.
13. Unapproved exterior electrical wiring; open electric on rear porch. Repair electrical wiring to
meet current NEC standards. Pemut required.
14. Unsanitary conditions on interior of house. Thoroughly clean and sanirize the interior of the
house.
15. Open elechical components on the interior of the house; missing or unapproved lighting
fixtures; unapproved electrical wiring. Repair all interior electrical wiring and fixtures to
meet current NEC standards. Pernut required.
16. Unapproved basement bedroom. Remove or bring bedroom up to current code requirements.
17. Unapproved water heater installation. Repair installation to meet current code requirements.
Permit required.
18. Unapproved bedroom in bathroom. Remove bedding from the l floor bathroom.
19. Lack of Water Service. Ixnmediately restore water service. Failure to provide water service
will result in these premises being declared Unfit for Human Habitation and ordered vacated
for lack of this basic facility.
20. Open plumbing lines on interior. Repair plumbing to meet current plumbing code
requirements. Permit required.
2 L The siructure is a registered vacant building and must have a Code Compliance Certificate
befare the structure may be occupied. Immediately vacate the structure or obtain a Code
Compliance Certificate from L.I.E.P. You may contact Jim Seeger at L.I.E.P. for code
compliance inspection, permits, and issuance of Code Compliance Certificate. Under Chapter
33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance Certificate ar to
vacate the structure may result in issuance of criminal summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by December 27, 2007 the Deparhnent
of Safety and Inspections, Division of Code Enforcement, will begin a substantial
abatement process to demolish and remove the building(s). The costs of this action,
including administrative costs and demolition costs will be assessed against the property
t�es as a special assessment in accordance with law.

As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Secrion, 8 Fourth Street, Suite #200, Comznerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subj ect to demolition and removal by the City.
This placard shall not be removed without the written authority of the Deparhnent of
Safety and Inspections, Division of Code Enforcement. The department is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If correcrive action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

10. Ordering the owner to remove or repair the building(s) at 772 Fuller Avenue within fifteen
(15) days from adoption of resolution.
The property owner of record, Shawn Green, did not appear. David McCalip, attorney with Wilford
& Geske, appeared on behaif of Central Mortgage Company, the property owner.
Mr. Magner stated the building was a one and one-haSf story, wood frasne, single-family dwelling
on a Iot of 4,356 square feet and had been vacant since August 10, 2006. A code compliance
inspection had not been done. The vacant building registration fees were current and the $5,000
performance bond had been posted on January I6, 2008. On November 6, 2007, an inspection of
the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on November 27, 2007 with a
compliance date of December 27, 2007. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation estimated the
market value of the land to be approximately $45,600 and the building to be $95,600. Real estate
taa:es were current. Code Enforcement estimates the cost to repair the building to be approximately
$75,000 to $85,000. The cost for demolition was estimated to be approximately $9,200 to $12,200.
There had also been 14 summary abatements issued to this property since 2006, 14 of which wenY to
work order: to secure the building and the City had to board the building to secure it from trespass,
remove improperly stored refuse and debris, cuY tall grass and weeds, and remove snow and ice.
Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was a
bungalow-style building and was built in 1915. The integrity was good as there had been few
exterior alterations and the block appeared to be a contiguous row of homes.
Ms. Maermond asked how they became aware this was a vacant building. Mr. Magner stated this
building was condemned on August 26, 2006 after a drug raid and the inspector transferred the $le
to the VacanC Buildings Program.
Mr. McCalip stated that he had a check to pay far the code compliance inspection and planned to
file the necessary paper work with DSI after the hearing. He stated that the sheriffs sale occurred
on October 18, 2007 and the redemption period would expire on April 18, 2008. He stated that his
client indicated to him that they were willing to make the necessary repairs to the building.
Ms. Moermond stated that the code compliance inspection would need to be done first to determine
what repairs wouId need to be made. She suggested he hire a conh to go through the report
and come up with a work plan for the rehabilitation of the property. She stated she would aiso need
to see financial documentation dedicating the amount of the City's estnnated cost between $75,000
to $80,000 of the repairs. She stated that the property would also need to be maintained. She
recommended laying this matter over to the March 25 Legislative Hearing.
