WHEREA�bepartment of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one and one-half story, wood frame, duplex with a detached, two stall, wood
frame, garage located on properry hereinafter referred to as the "Subject Property" and
commonly lrnown as 282 BAKER STREET EAST. This property is legaliy described as
follows, to wit:
WOODBURY AND CASE'S ADDITION TO ST. PAUL, MINN. EX ALLEY W 6 FT OF LOT
2 AND E 46 FT OF LOT 3 BLK 7
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before Apri12, 2007, the
following are the now known interested or responsible parties for the Subject Property: Hsbc
Bank USA Na Trustee/C/O Wells Fazgo Foreclosure MACX7801-013, 3476 Stateview Blvd,
Fort Mill, SC 29715; District 3— West Side Citizens Organization.
WHEREAS, Depariment of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated December 13, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair
or demolish the shucture located on the Subfect Property by January,l2, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public heazings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties haue been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, March 11 and March 25, 2008 to hear testimony and evidence, and
after receiving testimony and evidence, made the recommendation to approve the request to

order the interested or responsible parties to make the Subject Property safe and not detrimental
to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure in accordance with all appiicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with
all applicable codes and ardinances. The rehabilitation or demolition of the structure to be
completed within fdteen (1� days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
April 2, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 282 BAKER STREET EAST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to conect the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the norification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the structure in accordance with all applicable codes and ordinances. The
�+�1� demolirion and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
2. If the above correcrive action is not completed withiu this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislarive Code.

The Department of Safety and Inspections has declared this building(s) to constitute a"nuisance"
as defined by Legislarive Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on January 14, 2008. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this
property. It is the reaommendation of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a one and one-half story, wood frame duplex with a detached two-stall garage on
a lot of 6,098 square feet.
According to our files, it has been a vacant building since May 1, 2007.
The current property owner is HSBC Bank USA c/o Wells Fargo, per AMANDA and Ramsey
county property records.
The city has had to boazd this building to secure it from trespass.
There have been two (2) SUMMARY ABATEMENT NOTICES since 2007.
There have been two (2) WORK ORDERS issued for:
- Removal of tall grass and weeds
On November 14, 2007, an inspecrion of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BLTILDING was posted on December 13, 2007 with a compliance date
of January 12, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Ta�carion has placed an estimated market value of $52,800 on the land and $128,300 on the
building.
As of December 24, 2007, a Code Compliance inspection has been completed.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On November 14, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condifion. You
may also be required to post a£►ve thousand dollar ($5,000.00) performance
bond with the Buiiding Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

This is a one and one-half story wood frame, duplex with a detached two sta11, wood
frame, gazage.
I. The exteriar walls and/or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
2. 'I'he stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of mare that three (3) risers with handrails which
are grippable and installed 34" to 38" above the nose of the stair h�eads.
3. The front steps of the house there aze missing or defective guardrails. Provide
all stairways, pozches, decks or steps which are more than 30" high with
guardrails and intermediate raiis with openings in the guazdrail no more than
four (4) inches apart and in accordance with the State Building Code.
4. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
S. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
6. DEFECTNE STAIRS. The front concrete steps are broken, defective, or in
disrepair. Repair in a professional manner.
The window and/ar door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
8. The windows ancUor storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
9. The exterior wa11s are open, exposed wood surfaces, rodent andfor rot
damaged. Repair walls to meet current code requirement. Permit required.
10. The east side parch is settling and pulling away from the main structure.
Repair the porch and its foundation/footings to meet current code
requirements. Permit required.
ll. The exterior walls of the garage are defective. Repair all holes, breaks, loose
or rotting siding, to a professional state of maintenance.
12. The exterior walls and/or trim of the garage has defective, peeled, flaked,
scaled or chalking paint ar has unpainted wood surfaces. Scrape and re�aint
to effect a sound condition in a professional manner.

13. The structure is a registered vacant building and must have a Code
Compliance Certificate before the shucture may be occupied. Immediately
vacate the shucture or obtain a Code Compliance Certificate from L.I.E.P.
You may contact 7un Seeger at L.I.E.P. for code compliance inspection,
permits, and issuance of Code Compliance Certificate. Under Chapter 33.03
of tbe Saint Paul Legislative Code, failure to obtain a Code Compliance
Certificate or to vacate the sh may result in issuance of criminal
summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by January 12, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessazy repairs and legal
requirements to correct this nuasance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate° to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placazd on this property which declares it
to be a"nuisance condition", subject to demolition and removal by ttie City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Bnforcement. The deparhnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessuy. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

8. Ordering the owner to remove or repair the building(s) at 282 Baker Street East within
fifteen (15) days from adoption of resolurion.
The property owner of record, HSBC Bank USA c/o Wells Fargo, did not appear. Tom Sawyer,
ReMas Resources, appeared with Mike Cassidy, potential buyer.
Mr. Magner stated the building was a one and one-half story, wood frame, duplex with a detached
two-stall garage on a lot of 6,098 squaze feet and had been vacant since May 1, 2007. A code
compliance inspection had been done on December 24, 2007 and the vacant build'mg registration
fees were current. The $5,000 performance Bond had not been posted. On November 14, 2007, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on December 13, 2007 with a
compliance date of January 12, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value ofthe land to be approximately $52,800 and the building to be $128,300. Real estate
taxes were current. Code Enfarcement estimates the cost to repair the building to be approximately
$80,000 to $90,000. The cost for demolition was estimated to be approximately $8,365 to $11,365.
There had also been two summary abatements issued to this property since 2007, two of which went
to wark order: to secure the building and the City had to board the building to secure it from
trespass and to cut tall grass and weeds. Code Enforcement recommends the building be repaired or
removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that there wasn't any original
permit information available as the street was originally been called Midway Avenue. She believed
that the building was built in 1890 and there was a loss of integrity to the exterior of the building. It
appeared that that there was a second entrance that was added making the building into a duplex.
There were properties at 306 and 348 Baker that had been surveyed; however, they were not located
in the immediate area to this property.
Mr. Sawyer stated that Wells Fazgo currently owns the property and they were in the process of
negotiating an offer to purchase the property. He stated that he would be talking to the asset
manager today regazding the status of this property if a bid is not accepted.
Ms. Moermond asked when the suimnary abatements had been issued. Mr. Magner responded that
they were issued in April, 2007 and May of 2007.
Ms. Moermond stated she would require the following be submitted by the end of business on
March 21: 1) a signed purchase agreement; 2) the performance bond must be posted; 3) a work
plan needs to be done in accordance with the code compliance inspection report; 5) financial
documentation demonstrating the ability to make the repairs; and 6) the property must be

Tom Sawyer, ReMaY Results, realtor, and Mike Cassidy appeazed. Mr_ Sawyer presented a copy of
the signed purchase agreement. Ms. Moermond stated that she was also in receipt of the work plan,
and a financial letter. She asked whether the performance bond had been posted.
Mr. Cassidy responded that he had not yet posted the bond; however, he could do so after the
hearing.
Mr. Magner stated that in reviewing the wark plan, he had concem that there were no bids listed
from the trades.
Mr. Sawyer stated that they had requested two bids from every trade; however, they have not
received anything to date. Mr. Cassidy stated that he believed they should receive the bids soon.
Ms. Moermond expressed concern with the financial letter that had been presented. The letter
indicated that Mr. Cassidy did not have final approval for the loan and she requested further
information from his bank guaranteeing the financing. She stated that she also had concern that he
had not listed the supplies that he had on hand to do the rehab and the supplies that he needed to
acquire listed on his work plan.
Mr. Magner suggested that since CTX Mortgage was providing the financing to acquire the
property and to finance the rehabilitation, they should indicate on the letter how much they are
fmancing for the cost of the rehabilitation. He asked Mr. Cassidy whether he had fiiled out the
vacant building registration form. Mr. Cassidy responded that he had not. Mr. Magner stated that
he would need to haue the form on file.
Ms. Moermond asked whether the title work had been completed Mr. Sawyer responded that he
would haue to check the recards on the computer to see whether this had been done.
Ms. Moermond asked when the closing was scheduled. Mr. Sawyer responded that the closing
currently was scheduled for Apri130; however, they would like to close on the purchase prior to the
30th.
Ms. Moermond stated that the following items must be completed by Apri12: 1) the $5,000
performance bond must be posted; and 2) the registration form must be fi11ed out and filed with
Code Enforcement. If this is submitted by April 2, she will recommend continuing this matter to
the April 16 Council Public Hearing. The following items must then be completed by the end of
business on April 14: 1) a revised wark plan including bids from electrical, mechanical, and
plumbing trades; and 2) a revised financial statement.
