WI�REAS, Deparlment of Safety and Inspecrions has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecldng
and removal of a two and one-half story, wood frame dwelling with a steel storage shed located
on property hereinafter refened to as the "Subject Property" and commonly known as 839
AURORA AVENUE. This property is legally described as follows, to wit:

WHEREAS, Department of Safety and Inspecrions has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated November 27, 2007; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subj ect Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested ar responsible parties that they must repair
or demolish the structure located on the Subject Property by December 27, 2007; and
WHEREAS, the enforcement officer has posted a placud on the Subj ect Property
declaring this building(s) to constitute a nuisance condition; subj ect to demolition; and
WHEREAS, this nuisance condirion has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings befare the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saant Paul Legislative Code, of the time, date, place and
purpose of the public hearings, and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, March 11, 2008 to hear testimony and evidence, and after receiving

testunony and evidence, made the recommendation to approve the request to order the interested
or responsibie parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by rehabilitating
this shucture in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within one hundred-eighty
(180) days after the date of the Council Hearing; and
WIIEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
AprII 2, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced pubiic hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 839 AURORA AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Depariment of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 haue been fulfilled.

accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolirion and removal of the structure must be completed within one
hundred-eighty (180) days after the date of the Council Hearing.
If the above corrective action is not completed withiu tlus period of tune Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I,egislative Code.

The property was re-inspected on January 8, 2008. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this �
property. It is the recommendation of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a two and one-half story, wood frame, single-family dwelling on a lot of 3,920 square
feet.
According to our files, it has been a vacant building since June 26, 2007.
The current property owner is Aurora 39 Trust c/o Matthew Favorite, per AMANDA and Ramsey
county property records.
The city has had to board this building to secure it from trespass.
There have been six (6) Si.)MMARY ABATEMENT NOTICE5 since 2007.
There have been six (6) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
- Removal of snow and ice
On October 24, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE
A NUISANCE BUILDING was posted on November 27, 2007 with a compliance date of December
27, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by
the legislative code.
The Vacant Building registration fees are delinquent in the amount of $250.00.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Tnspections, Division of Code Enforcement, hereby declares the premises located at:
839 AURORA AVE
and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On October 24,2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this
time. As �rst remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Section, 8 Fourth Street
East, Suite 200, Commerce Building (651)266-9090. That inspection will
identify spec�c defects, necessary repairs and legal requirements to
correct this nuisance condition. You may also be required to post a£ve
thousand dollar ($5,000.00) performance bond with the Building

Inspection and Design Of�ce before any permits are issued, except for a
demolition permit.
This building(s) is subject to the reshictions of Saint Paul Ordinance Chapter
33.03 and shall not again be used for occupancy until such time as a Certificate
of Compliance or a Certificate of Occupancy has been issued.
This is a two and one-half story, wood frame dwelling with a steel storage shed.
l. The eaves and soffits are in a state of disrepair or deterioration. Repair
a11 defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
2. The exterior walls andlor trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Serape and repaint to effect a sound condition in a professional manner.
The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation defects in a professional manner to a
weather-tight, water-tight and rodent-proof condition. Permit may be
required.
4. The roof is deteriorated, defective, or in a state of disrepair. Repair or
replace the roof covering to a sound, tight and water impervious
condition. Permit may be required.
The exterior walls of the house and/or garage are defective. Repair all
holes, breaks, loose or rotting siding, to a professional state of
maintenance.
6. DEFECTIVE STATRS. Stairs are broken, defective, or in disrepair.
Repair in a professional manner.
7. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.
The windows and/or storm windows are in a state of disrepair. Replace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hardware and associated trim in a professionai manner.
Permit may be required.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not conected by December 27, 2007 the Department
of Safety and Inspections, Division of Code Enforcement, will begin a substantial
abatement process to demolish and remove the building(s). The costs of this action,

including administrative costs and demolition costs wiil be assessed against the property
taxes as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspecrion and Design 3ection, 8 Fourth Street, 3uite #200, Commerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, iransfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by Iaw to post a placard on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard sha11 not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. The departrnent is fiuther
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective acrion is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution staring what action if any, it deems appropriate.
If the resolution calls far abatement action the Council may either order the City to take
the abatement acrion or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

Re-level structure as much as is practical.
Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
Prepare and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).
Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) are to be reconstructed as per
code.
Habitable rooms with new usage, replaced windows shall have glass area equal to 8%
of floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all
bedroom windows shall meet emergency egress requirements (20" wide minimum,
24" high minimum but not less than 5.7 sq. ft. overall).
Provide general clean-up ofpremise.
Provide smoke detectors as per the Minnesota State Building Code.
Repair soffit, fascia trim, etc. as necessary.
Provide proper drainage around house to direct water away from foundation.
Install downspouts and a complete gutter system on west side of building.

7. Ordering the owner to remove or repair the building(s) at 839 Aurora Avenue within fifteen
(15) days from adoption of resolution.
The property owner of record, Aurora 39 Trust c/o Matthew Favorite, did not appear. Kelly Hadac,
attomey with Mumane Brandt, appeared on behalf of Deutsche Bank National Tmst.
Mr. Magner stated the building was a two and one-half story, wood frame, single-family dwelling
on a lot of 3,920 square feet and had been vacant since June 26, 2007. A code compliance
inspection had not been done, the vacant building registration fees were delinquent in the amount of
$250 and the $5,000 performance bond had not been posted. On October 24, 2007, an inspecrion of
the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on November 27, 2007 with a
compliance date of December 27, 2007. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation estimated the
market value ofthe land to be approximately $46,000 and the building to be $137,300. Real estate
taxes were current. Code Enforcement estimates the cost to repair the building to be approximately
$70,000 to $80,000. The cost for demolirion was estimated to be approximately $11,865 to
$14,865. There had also been six suuunary abatements issued to this property since 2007, six of
which went to work order: to secure the building and the City had to board the building to secure it
from trespass, remove improperly stored refuse, cut tall grass and weeds, and remove snow and ice.
Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1906 and the original owner was also listed as the builder, Swanson. In reviewing the photographs,
it appeared that a lot of the original materials had been covered and there was an "insensitive"
egress out of the front gabble. This was a very solid, contiguous block and this particular building
was prominent on the block face given its height. She also noted that it was behind similar housing
on University Avenue and there had been recent discussion concerning the housing in the Central
Corridor area. From a historic perspective, staff would encourage rehabilitation.
Mr. Hadac stated that the property was in fareclosure and the redemption period would expire on
March 27. They had now hired a realtor to market the property and would like to find a buyer,
preferably a rehabber, who was interested in making the necessary repairs who could bring fonvard
a plan. The realtor had indicated to him that he had paid the vacant buiiding fees and he would
check need to check on this with him. He submitted two repair esrimates that had been done which
indicated the amount ofrepairs to be between $120,000 to $150,000.
Mr. Magier stated that according to STAMP, the vacant building fees had not been paid; however,
if they had been paid within the past day, it was not yet recorded in the system. He noted that a
code compliance inspection had been ordered on March 10.
Ms. Moermond expressed concern with the number of suminary abatements that had gone to work
order which indicates that the City has been maintaining the property. Clearly, the Bank had the
ability to protect its investment and maintain the property. She stated she would require the
following be submitted by the end of business on March 28: 1) a signed purchase agreement; 2) the
vacant building fees must be paid; 3) the vacant building registration for must be filed; 4) the
performance bond must be posted; 5) a work plan needs to be done in accordance with the code

compliance inspection report; 6) financial documentation demonstrating the ability to make the
repairs; and 7) the property must be maintained. If necessary, she will schedule another legislative
hearing on March 25 for the potential buyer to submit documentarion.
