4 rigjit-of-way hereinafter described is hereby vacated and discontinued as public property, and
5 subject to the herein stated objections the easements within those public properties are hereby
6 released, subject to the following conditions:

This vacation sha11 be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
That the petitioners, their successors and assigns shali pay $1200.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That the petitioner, their successors and assigns agree to indemnify, defend and save
hamiless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any chazacter brought as a result of injuries or damages received or sustained by any
person, persons or properiy on account of this vacation, or the petitioners' use of this
properry, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any clanns or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petifioners or any of their agents or employees.
3. That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolution, file with Public Works, City Rea1 Estate, an acceptance in writing of the
conditions of this resolution and shall, within the period specified in the terms and
condirions of this resolution, comply in all respects with these terms and conditions.

RE: Public Works Vacation File No.4-2008 (Vacate Streets and Alleys)
I recommend a public hearing befare the City Council be held on April 2, 2008 to
consider the petition of Warehouse Rental Company, LLC.
This petition is to vacate platted alleys and parts of Baker and Hersey Streets
between Capp Road and Endicott Street.
The purpose of this vacation is to "clean up" title work for re-platting. There is
currently building overthe areas to be vacated.
This property is located in City Council Wazd 4, Platuiing District 12.
